Consumer Complaint: I reached out to Credit Acceptance in XXXX of XXXX stating the retail installment agreement was invalid as there were many violation per 15 USC. I received a email from XXXX XXXX requesting a call to her to resolve. I later received a letter stating that all of the documents and reasoning I sent as to why the contract was invalid would not be upheld even though the laws stated the violations. No where in the contract does it say I can rescind at all. I then sent a cease and desist and requested to rescind the vehicle, after researching I found that not only was I not given the option to rescind 15 USC 1635 but I was violated as the dealership requested a down payment 15 USC 1638, the amount of {$2800.00} was added to the total but that was also subtracted from the down payment. The down payment took the total to {$32000.00}, how is a down payment added to the total of the car, shouldn't that be deducted if anything? The finance charge was {$11000.00} which should have been the sum of all charges per 15 USC 1605. The transaction was cash and credit which was unlawful per 15 USC 1638. The insurance should have been included in the finance charge. The vehicle was said to been sold for a little over {$8700.00}, leaving me still owing {$6700.00}. Per XXXX XXXX the car was only worth $ {$9500.00} on XX/XX/XXXX of XXXX Credit Acceptance along with XXXX XXXX have violated laws pertaining to this contract/ car transaction.

Consumer Complaint: Back in XXXXXXXX XXXX XXXX someone stole my identity and used it to purchase a vehicle and they also filed for unemployment benefits, credit cards, and other various accounts. Over the past 2 years Ive spoken with Credit Acceptance and XXXX several times and attempted to get this issue resolved with No result. Ive asked several times for a Letter of Validation from both Credit Acceptance and XXXX and havent received one although I was told it was mailed to me. I have done everything I was asked by both Credit Acceptance and XXXX with No updates or response in the past 6 months. Ive submitted both a Police Report and Affidavit of Fraud to show I am a True victim of Identity Theft. Still both Credit Acceptance and XXXX refuse to acknowledge my consumer complaint. I think its also a violation of my civil rights and discrimination. I almost at the point of retaining legal representation and filing a lawsuit against Credit Acceptance. I would like to know if I can get help here or what I can and should do next. Im attempting to fix this issue but its been a nightmare and XXXX stated they received something validating the account was mine however Ive never seen anything and they refuse to resend anything to me. I would just like to get this issue resolved promptly so that I can purchase a vehicle. It shows the vehicle as a repossession and someone named XXXX XXXX on the account. I have No knowledge of who this person is.
