Consumer Complaint: I declare under penalty of perjury ( under the laws of the United States, if executed outside of the United States ) that the foregoing is true and correct to the best of my knowledge. Further, I certify that I am permitted by FEDERAL and STATE LAW to file this dispute. I also understand that knowing and willful misstatements or omissions of material facts constitutes a FEDERAL CRIMINAL VIOLATION punishable under 18 U.S.C. 1001. Additionally, these misstatements are punishable as perjury under 18 U.S.C. 1621. This item found within my credit report is not related to any transaction that I made. I am alleging that a person or company- without my authorization- used my personal identifying information to apply for goods, services, or money ; and was successful in creating this account. Consumer Complaint: In XXXX of XXXX, I switched my cellular services from XXXX XXXX to XXXX. I activated under a Bring Your Own Device plan, and did not purchase any equipment. I was told this was a MONTH TO MONTH, contract free plan and never signed any contract. I had XXXX until XXXX of XXXX and ported two lines to XXXX, as XXXX 's service was poor at my home, and despite spending {$250.00} on a network extender, had continual service problems. XXXX also engaged in slamming constantly increasing my bill starting in XXXX. The company failed to provide and answer as to why taxes and fees were increasing. In XXXX, I received my final bill of {$88.00} which I paid in full. Later that month, I received an additional invoice for {$350.00} which XXXX claims was for " early termination fees '' because I cancelled my service before a " mandatory one year agreement '' that I never signed. I attempted on three different occasions between XX/XX/XXXX and XX/XX/XXXX to get XXXX to credit this and disputed this amount. On XX/XX/XXXX at XXXX hrs I received a call from XXXX which lasted XXXX from a company identifying itself as Convergent Outsourcing , Inc. claiming to be a debt collector on behalf of XXXX. I explained to two different people that I do not owe XXXX anything and that I officially dispute this under the Fair Credit Reporting Act as not a valid debt. I was told that per their records, the debt is valid as the outstanding balance was for a failure of me to adhere to the agreement to maintain service for 1 year. I explained I never signed a contract, did not purchase a device under a payment plan, and was on a month to month plan and fulfilled all my financial obligations with XXXX and transferred both my lines to XXXX I instructed them to cease and desist contacting me as this is not a valid debt and I believe in good faith that XXXX and it's third party agent, Convergent Outsourcing, is engaging in fraud trying to get me to pay money I do not lawfully owe. Furthermore, when I stated I would take legal action as is my right under the FCRA against anyone who places negative remarks on my credit file with the three credit agencies, I was then offered to settle this for a lower amount by " knocking a XXXX dollars off ''. I refused and requested a supervisor. The supervisor was rude, and asserted I owed them the money. I once against again told them to cease and desist all contact as this is not a valid debt. I have also attempted, in good faith, containing XXXX at XXXX on XX/XX/XXXX at XXXX and representative XXXX said she could not do anything and transferred me to " billing '' which brought me right back to the above named firm. It is my belief that this company is engaged in fraud and I have also reported them to the Georgia Department of Consumer Affairs as well as XXXX, who demonstrate ZERO good faith in resolving their error.
