Subissue: Debt was result of identity theft
Consumer Complaint: My identity was stolen about a year and a half ago. This case was closed after doing all of the reports and case filings. Today, I received an additional letter in the mail from a debt collector. This was for an energy company that I have never heard of. This is one of the same energy companies that had an account opened by fraudulent information on myself. I did not open the account and this account is opened for about {$2000.00}. I called the energy company and The debt collection agency. Both opened referrals and cases against this fraudulent account. The energy company told me to file a report here so that is what I am doing.

Consumer Complaint: This debt is cellphone bill. When I contacted the company that is attempting to collect the debt, they sent a contract that did not belong to me. I wanted valid proof that the debt belonged to me. The contract they sent to my address was a different person on the contract and in a whole different state. I called the company but nothing has happened.

Issue: Improper use of your report
Subissue: Reporting company used your report improperly
Consumer Complaint: This is in reference to complaint submitted to the CFPB : XXXX. This company has failed to provide specific documents and is still within violation of the federal law that governs them as a debt collector. As a natural living person and consumer I am writing in regards to the alleged debt associated with Convergent Outsourcing account number ending in : XXXX Pursuant to the Fair Debt Collection Practices Act ( FDCPA ), I am requesting that you provide evidence of a forward flow agreement between your agency and the original creditor, and not merely a bill of sale, to establish the validity and legality of the debt in question. This includes documentation that clearly demonstrates that I have knowingly and willingly entered into a contractual agreement with your agency, outlining the terms and conditions of the debt. I have sent multiple complaints about this company violation of federal law. This company is complicit at this point in the federal law that governs and regulate them. They responded with false documents and did not provide proper proof per the law and regulations. As per the Uniform Commercial Code ( UCC ), a credit card is not a negotiable instrument that can be used to collect on a debt. Furthermore, the charge-off of a debt is considered income and reporting it as a debt is a violation of the FDCPA. I am also aware if there is a 1099-C for this alleged debt, it will be illegal for you to continue collecting on it. Therefore, I demand that you delete the account from my credit report and cease all collection efforts immediately. Please provide documentation to confirm that you have ceased all collection efforts and have deleted the account from my credit report. Please note that any failure to comply with this request may result in legal action being taken against your agency. Thank you for your attention to this matter.
