Consumer Complaint: Request For Debt Validation Pursuant to 15 USC 1692g Be Advised this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act ( FCRA ) [ 15 USC 1692g ] stating your claim is disputed and validation is requested. This is NOT a request for verification or proof of my mailing address, but a request for VALIDATION made pursuant to the above-named Title and Section. Consumer Complaint: Convergent Outsourcing ( CO ) is a debt collector for XXXX XXXX ( XXXX ). CO has information on my credit report as an unpaid debt with XXXX. On XX/XX/, I paid the debt with XXXX to XXXX on their website and received confirmation of the payment in full. I have sent multiple emails and have disputed the entry for CO multiple times on my credit report however, CO is not responding to my emails and CO reports that the information is accurate on my credit report - even though it is not accurate. I finally received a statement from CO on XX/XX/XXXX showing the account as paid off however a dispute I had filed to have the information removed was closed on XX/XX/XXXX stating CO says the account is still not paid off.

Consumer Complaint: In response to CPFB complaints # XXXX - XXXX my name is XXXX XXXX a federally protected consumer, and Iam making this complaint against Convergent Outsourcing Inc. for violating a cease and desist order notice they received on XXXX XXXX and for continuing to invade my individual privacy by committing abusive, deceptive, and unfair debt collection practices. I have attached a debt validation letter, a cease and desist notice, Exhibit A. which is a copy of the account reporting on my Experian consumer report, Exhibit B which is copy of response to CFPB complaint # XXXX - XXXX, and a pdf of an FTC Report that will be labeled as Exhibit C when filing for litigation in Federal Court to this complaint. Convergent Outsourcing Inc. position that this account will remain reported to credit reporting agencies with accuracy as disputed, because I never contract with them and they have no reason to have my identifying information. Also, pursuant 15 USC 1692g ( c ). I have not validated any alleged debts with Convergent Outsourcing Inc. and my failure to dispute the validity of this alleged debt shall not be construed as an admission of liability. Convergent Outsourcing Inc. As of XX/XX/XXXX, I have not received any documentary evidence, such as a trilateral contract giving Convergent Outsourcing Inc any right to collect on this alleged debt. It is my belief that Convergent Outsourcing Inc are attempting unlawful extortionate activities and theft company are attempting unlawful extortionate activities and theft by deception by attempting to furnish false and deceptive forms. The Company also stated The Balance have been validated with the original creditor XX/XX/XXXX. I have never received any documentation requesting validation from Convergent Outsourcing Inc. before they committed multiple violations under the FCRA and the FDCPA by furnishing this alleged debt to my consumer report. If Convergent Outsourcing can not provide me with proof such as a tracking number that they attempted to lawfully validate this alleged debt with me the consumer, prior to furnishing it on my report, this has been a fraudulently furnished account with forethought and malice as an attempt to bring harm to me and my financial reputation. Consumer Complaint: I am writing to report on various violations of the Fair Credit Reporting Act ( FCRA ) from the following organizations, Convergent Outsourcing Inc, XXXX XXXX XXXX XXXX and XXXX XXXX XXXX ( further known as DEBT COLLECTORS ) and XXXX, XXXX and XXXX ( further known as CREDIT REPORTING AGENCIES ). First, all companies, including DEBT COLLECTORS, have agreed to follow the regulations to protect consumers ' information. The information that is shown on the consumer report has adversely affected my life as it bears on the credit worthiness, credit standing, credit capacity, character, general reputation, personal characteristics and mode of living. The violations are as followed : Opt Out Laws - Exhibit A shows an example of a letter sent to the debt collectors expressing my choice to opt out. 15 USC 1681 section 604 ( a ) section 2 states that In general subject to subsection, any consumer agency may furnish a consumer credit report under the following circumstances and no other : in accordance with the written instructions of the consumer to who it relates. The CREDIT REPORTING AGENCIES and DEBT COLLECTORS do not have, nor did I ever give, my permission to and written or any other consent to furnish this information. Any and all consent to the CREDIT REPORTING AGENCIES and DEBT COLLECTORS for these collection items have been revoked. 15 USC 6802 ( b ) ( c ) states that A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless- the consumer is given an explanation of how the consumer can exercise the non disclosure option. The DEBT COLLECTORS never informed me of my right to exercise my nondisclosure option. To add, this account is an adverse item that is in violation of of USC 1681 ( c ) ( 5 ) which states : Except as authorized under subsection ( b ), no CONSUMER REPORTING AGENCY may make any consumer report containing any of the following items of information : Any ADVERSE item of information other than records of convictions of crimes which antedates the report by more than seven years. Further, the credit reports shows information that falsely represents the DEBT COLLECTORS as ATTORNEYS. These agencies are not attorneys and should not appear as falsely representing themselves in accordance with Title 15 USC 1692. It is stated that every consumer reporting agency shall maintain reasonable procedures when there is cause for information to be inaccurate. 15 USC 1681 ( a ) states A person shall not furnish any information relating to a consumer to any consumer if the person knows or has reasonable cause to believe that the information is inaccurate. All of this is also in violation of the Privacy Act of 1974. The CREDIT REPORTING AGENCIES are not maintaining reasonable procedures to avoid violations of for fair credit reporting. Per 12 CFR 1026.7, A consumer may exercise the right to opt out at any time : Convergent Outsourcing Inc, XXXX XXXX XXXX XXXX and XXXX XXXX XXXX, I am opting out of your reporting services per the attached written notices. XXXX, XXXX and XXXX, I am opting out of the reporting of Convergent Outsourcing Inc, XXXX XXXX XXXX XXXX and XXXX XXXX XXXX and I am holding you accountable to ensure these measures are taken.

They do not verify and continue to report and change information. I had disputed with XXXX and they had deleted it and then convergent outsourcing reported again as past due. They have not sent any bill and continue to not verify this debt. XXXX also does not investigate and validates the debt in less than a day. Indicating absolutely no investigation.
