Subissue: Reporting company used your report improperly

Consumer Complaint: This collection agency keeps disregarding the laws. I have sent letters asking them to provide the original signed documents ( by me ) proving the debt is mine and have not received a response or proof. Ive shown them multiple times how they are violating the Fair Credit Reporting Act. This is holding me back from purchasing a home for my family. Issue: False statements or representation

Subissue: Attempted to collect wrong amount

Consumer Complaint: Dear Sir or Madame : I am writing this complaint in regards to an alleged {$1300.00} debt that Convergent Outsourcing , IncXXXX is reporting to the credit bureaus. According to the information reported to the Credit Bureaus, the date of first delinquency was XXXX, XXXX. The Statute of Limitations on this alleged debt, even should it be mine, is 5 years in the state of Missouri. Since the debt is out of the statute of limitations, and they are reporting this on my credit report, they are conducting collection activities on zombie debt. Not only is this zombie debt, the documents I have attched show the account has been re-aged and the status misrepresented to the credit bureaus in order to continue collection attempts via reporting the information. This is being reported as an " Open '' account when in fact it has been closed for many years, according to the original creditor, and the company gone out of business. The computer generated print out of the alleged debt that this collection company has sent to me did not meet the legal standard of validation as requested ; However, their own document shows the 1st date of delinquency as XXXX, XXXX, yet they as reporting the account as opened as of XXXX, XXXX, as evidenced by the printed screent shot of the account. Additionally, they are reporting it as an alleged {$1300.00} debt, when I have evidence of a statement from a previous collection company showing an alleged debt for a different amount, which brings intoi question the entire history of the alleged account as inaccurate. I have atteched this document for your reference. This is why I requested the account history from both the Original Creditor, XXXX, and this collection company, Converegent Outsouring , IncXXXX which neither has provided as requried pursuant to a request for investigtation into the accuracy of the records via the FCRA Section 623. Reporting the alleged account as being opened XX/XX/XXXX, is impossible evidenced by the date of 1st delinquency reported by their own firm. This is merely and attempt to re-age the account by this collection company, which I am sure you are aware is a violation of the FCRA. I'm sure you are aware of the provisions in the FDCPA. However, I would liiketo point out that this company has violated provisions of the FDCPA by implying that the legal status of the debt is collectible by reporting the alleged debt to the credit bureaus. The exact statute can be found in 15 USC 1692e subsection 2 The false representation of - ( A ) the legal status of the alleged debt AND ( B ) any services rendered or compensation which may be lawfully received by any debt collector for the collection of a debt. This alleged account is zombie debt which has been re-aged to misrepresent the staus. I am also certain this company does not have, and has in fact failed to provide on serval occations as requested, adequate documentation to prove in court they have a right to report this negative information on my credit report, and therefore are in violation of the FCRA as well as the FDCPA.

Issue: Written notification about debt

Subissue: Didn't receive enough information to verify debt

Consumer Complaint: I spoke with a representative named XXXX from the Fraud Department of XXXX Credit Bureau, who was very rude, I stated to him the debt has not been validated. However upon reading the response from the company, I never received a packet to the address on file to complete and return. I was also made aware today the debt was verified. If the Company can send it via email to XXXX so that I may fill out the packet for completion stating its FRAUD. Under the FDCPA I do not have an obligation to pay a 3rd party ( Convergent Outsourcing ) who does not own the debt originally. If the company can send me the documents with a WET signatures that I made a agreement to pay the alleged debt.

Issue: Attempts to collect debt not owed

Subissue: Debt was paid

Consumer Complaint: Hello, I cant provide the exact dates because it happened a couple of years ago, I had a XXXX XXXX account, probably around XXXX or XXXX. This account was paid by XXXX XXXX when the Switch to us program was available. I visited a XXXX company back in the days and offered me the promotion of paying the account to switch to them. It is not the first time that XXXX provide the wrong information to me causing me to own money. Before I had to solve owning a phone after it was informed to me that removing that line wouldnt affect me, that situation was fix successfully but now Im dealing with this unpaid account that I wasnt aware of and trusted that it was paid off by XXXXThe information that was provided to me was that this balance was paid off. If a employee made a mistake or misinformed me, I should not be having this reported. Since I am disputing this debt, CONVERGENT OUTSOURCING should not report it to the credit reporting agencies. Reporting information that is known to be inaccurate, or failing to report information correctly, violates the Fair Credit Reporting act. Total amount supposedly own {$2400.00}

Issue: Attempts to collect debt not owed

Subissue: Debt was result of identity theft

Consumer Complaint: At some point my identity was stolen to purchase a XXXX XXXX in Illinois using an Illinois address, I have never purchased a XXXX XXXX from XXXX nor have I lived in Illinois. I have brought this to the attention of CONVERGENT OUTSOURCING but they have not responded or investigated and only rubber stamped their own verification. It is horrible to be the victim of identity theft and it is made worse when people affect your credit and come after you for things other people stole.
