I am requesting a signed confirmation with my signature that I opened this account. Under the Fair Credit Reporting Act, 15 U.S.C. 1681g I have the right to demand that you disclose to me all of the documents that you have recorded and retained in your file at the time of this request concerning the accounts that you are reporting on my credit report. Please don't respond to my request by saying that this account has been verified. Send me copies of the documents that you have in your files that were used to verify this account. If you do not have any documentation in your files to verify the accuracy of this disputed account then please delete them immediately as required under Section 611 ( a ) ( 5 ) ( A ) ( i ). By publishing these inaccurate and unverified items on my credit report and distributing them to 3rd parties you are damaging my reputation and credit worthiness. Under the FCRA 15 U.S.C. 1681i, all unverified accounts must be promptly deleted. Consumer Complaint: Upon applying for a mortgage refinance in XX/XX/2018, I found that a company XXXX XXXX dba XXXX had opened a collection item that was reflecting on both credit /bureaus and negatively impacting my credit score. I called XXXX who told me they could not help me as the account was being handled by their subsidiary XXXX XXXX. I called XXXX XXXX and explained to an agent that I never applied for or received the XXXX 's debit card their company is negatively reporting as a collection item on my credit profile. I was told something to the effect that XXXX XXXX could not access the information on the account but the agent took my information and submitted the negative item as fraud. I also questioned the validity the item since it is reported as a XXXX 's debit card which is a card that draws directly from the applicant 's bank account. A debit card verifies and draws funds upon approval that the funds are present and accessible. The agent did not have any answers. A few days later, I received a letter from XXXX stating that they were not currently handling the negative item. I also received a couple of letters from XXXX XXXX one acknowledging my call/dispute and another requesting all of the same information I submitted to them over the phone. I completed the information and sent it back. I have called twice since for updates, but am repeatedly told there are no updates reflected on the file. In the interim, I am in the middle of a mortgage refinance and this negative item is driving down my credit score.

Consumer Complaint: This is the third time I have requested actual proof of ownership, proof of contract from XXXX XXXX XXXX # XXXX per XXXX XXXX Taking assignment of Debt ( C ) No collection agency shall commence litigation for the collection of an assigned account, bill , or other evidence of indebtedness unless it has taken the assignment in accordance with all of the following requirements : ( 1 ) The assignment was voluntary, properly executed, and acknowledged by the person transferring title to the collection agency. ( 2 ) The collection agency did not require the assignment as a condition to listing the account, bill, or other evidence of indebtedness with the collection agency for collection. ( 3 ) The assignment was manifested by a written agreement separate from and in addition to any document intended for the purpose of listing the account, bill, or other evidence of indebtedness with the collection agency. The written agreement shall state the effective date of the assignment and the consideration paid or given, if any, for the assignment and shall expressly authorize the collection agency to refer the assigned account, bill, or other evidence of indebtedness to an attorney admitted to the practice of law in this state for the commencement of litigation. The written agreement also shall disclose that the collection agency may consolidate, for purposes of filing an action, the assigned account, bill, or other evidence of indebtedness with those of other creditors against an individual debtor or co-debtors.
