Consumer Complaint: I scheduled a payment from my XXXX XXXX XXXX checking account to PAY my Capital One Quick Silver account. The payment was scheduled for XX/XX/XXXX and settled on XX/XX/XXXX. I wanted to make a larger payment than usual, typically they are under {$1000.00}, but since we are trying to buy a house and apply for a mortgage I thought it best to clear up some of this card 's {$12000.00} balance. In my haste, intending to pay the card {$3200.00} I keyed in {$32000.00}. An alert hit my XXXX XXXX XXXX account on the morning XX/XX/XXXX that my account was overdrawn by {$640.00}. It seemed impossible as I have XXXX in the account. I logged in and saw the error and immediately called XXXX XXXX XXXX. They stated they could not really do anything because the payment was " In Process '' but should be rejected because there was a negative balance in my account. I explained the neg balance was caused by this ELECTRONIC payment being sent to Capital One. XXXX XXXX XXXX XXXXXXXX said to call back on the very slim chance that it is not rejected but It may take 1 or 2 business days to see the funds back in the account. I was assured again by a team member at XXXX and the bill pay department that it would be rejected, Not entirely confident in the answer I called Capital One - XXXX in XXXX said they could not yet see the payment but would note the account. XXXX was polite and concerned but wasn't sure what to do in this instance and called her supervisor who said to call back tomorrow IF it settles and they will address it. IT SETTLED - and I had a {$19000.00} credit in my account on XX/XX/XXXX with other bills pending to be paid in my account. I called XXXX and again explained the problem now that the payment was not rejected and was settled at Capital One. XXXX from XXXX bill pay dept called Capital One and the team member XXXX could see the payment in the account and was willing to assist. Just as she was getting my routing information we were disconnected. We called back and spoke to I BELIEVE XXXX had XXXX interest in assisting us and said that they would cut me a check in XXXX - XXXX billing cycles. XXXX and I both said that's impossible. She was quite abrupt stating that is how it works. I said NO it does not. It was an electronic payment the money has already been settled. She would not pass me to a supervisor or another team member. We'd have to call the Specialty Dept tomorrow but that is the same resolution they will give. I said I have a large savings account with Capital One, can they please transfer the funds there if it would be easier and I would get it back into my XXXX account? XXXX just kept saying, " That is not how this works. '' We hung up and XXXX at XXXX couldn't help me further. I have to pay my mother 's quarterly taxes from that XXXX account and now it had {$3000.00} that I pulled from my saving account to cover a few payments. I called Capital one again and spoke with XXXX who was willing to assist. She said that they would back out the entire transfer of {$32000.00} within XXXX business days, IF they couldn't they would send a letter stating they will mail a paper check at that time. I asked where would I get these communications and she said in my Capital One banking portal. I said. " Just send me the overage and it will be fine '' she said the specialty Dept felt it would be better to back out the entire transfer. That was on the evening of XX/XX/XXXX AS OF TODAY - XX/XX/XXXX. The funds have not been returned. They remain on the Capital One credit card with a negative balance of $ XXXX. Capital One has not contacted me by phone or letter or portal message. I had to move {$29000.00} to my XXXX checking account from a high-interest saving account, IRONICALLY at Capital One, in order to cover my bill payments and my mother 's taxes until whenever this money is returned.

Consumer Complaint: I went into the local branch to inform representatives that my account was fraudulently accessed. I also requested to close the account or even place a restriction on my account so the suspect can not gain further access to my accounts. I was denied such requests. I was then refused service to deposit my payroll. During the time my balance was {$2.00} cents. During my time away with no access to the local branch nor any means of communication with Capital One I have not received any mail correspondence from Capital One. When I became well enough to visit the local branch I recently learned Capital One charged off my account then took the money from a deposit recently posted. The teller acknowledge the fact that I came into the branch and notified of my accounts being compromised. My checking account was still in open status at the time although my payroll was rejected by another representative. Also my account should have never been charged off and closed. She also produced to me my available balance. She took notice that yesterday another female and her partner of a different race came in and spoke of the same problem with the only difference being the young lady balance was XXXXXXXX XXXX shorter than my balance. The young lady literally requested her funds and the teller next to her cashed the young lady and her partner out releasing all of her funds. I was sent to the branch on several occasions at the direction of the BCR claims team to retrieve my funds with a claim number. A branch manager tried to get me access to my funds as they are very needed. He had me deposit XXXX XXXX into my savings account to make my savings account active to transfer funds. He stated my account has a lot of notes and the fast way he could possibly get my funds was to transfer my funds or give me a cashier 's check. I did not get the cashier 's check because the back office refused to release my funds without admitting fraudulently closing my account. I have never been yelled at, discriminated against and treated worse than I had ever imagined in front of a full branch of customers, employees and my XXXX. I have a very stressed out XXXX. Capital One reprensation showed no remorse as they charged off my account very inappropriately. Now as we are homeless at the hands of Capital One as they refused to release my funds. I am currently leaving the branch for the 4th time where as representative are upset that my funds are clearly there but can't be released because Capital One without notification to me charged off my account then fraudulently took the charge off amount back and locked my account thus wanting to open a case to close and already charged off closed account. I have photo proof of Capital One fraudulently trying to fix what they fraudulently did to my children and I funds and all contact information.

Consumer Complaint: In XX/XX/XXXX, my personal funds were seized by my bank ( Capital One ) because it was assumed that I fraudulently obtained an EIDL loan. I have submitted all my documents to the bank to assure them of the legitimacy of my loan request and subsequent award. I have received my loan documents with the scheduled payment arrangement and amount from the XXXX and currently repaying my loan. I do not see any reduction in that amount of {$4800.00}, which was the amount taken from my savings and personal checking account over XXXX years ago. This amount was removed, and my accounts closed because they alleged me transferring money from my Sole-proprietorship business account to my personal savings account at the time was fraudulent. The bank alleged that I didn't use the loan money for which it was given to me and made the decision to seize my funds and close my bank accounts. I received my EIDL loan six months prior in XXXX and I didn't receive any assistance or funding from Capital One. I secured my EIDL loan independently. I applied for and received my EIDL loan in XX/XX/XXXX while working as an XXXX XXXXXXXX as a XXXX XXXX XXXX XXXX XXXX. Those funds coupled with contract payments were deposited in my business account with Capital One. Yes, I periodically move a portion of my business funds to my personal savings account as a XXXX XXXX but that doesn't mean fraudulent intent. That is prudent financial management for a small business owner. I disagreed with the banks ' decision and sent my complaint through channels to the Vice-president of consumer affairs however, it was intimated to me that the decision was final, and the monies were sent to the XXXX XXXX for return to the XXXX. I have been in contact with XXXX XXXX XXXX for almost 2 years, inquiring as to whether this can be reversed, and my funds returned to me or if not, when will the funds be applied to the balance owed on my EIDL loan? Nothing has happened as of today, XXXX years later. The funds seized were not even from an EIDL, but a personal loan I received from XXXX XXXX in XXXX of XXXX which I have paid off. I am currently repaying my EIDL as agreed. I now want my funds returned to me with interest as I believe should be fair. Consumer Complaint: On XX/XX/XXXX, I made a purchase on Kohls.com. Order # XXXX, for {$630.00}. I returned the item with a return label issued by a Kohls Supervisor on XX/XX/XXXX. The label was for XXXX and the tracking number is XXXX. I received confirmation that the package weighing over 90 pounds was received by Kohls within five days of being sent. I called Kohls a total of 11 times from XX/XX/XXXX to XX/XX/XXXX in an attempt to receive my credit refund on my Kohl 's account. a few of the managers I spoke to at Kohl 's were : XXXX, XXXX, XXXX, XXXX, and the gave me multiple stories my refund would be processed. Consumer Complaint: I made a purchase online with XXXX XXXX XXXX XXXX for {$310.00} and {$14.00}. I returned entire order to company but they refused to pay me my refund. I put dispute in with Capital One. Once decision was made by Capital One to chargeback {$310.00}, one of the two purchases, I uploaded letter to Capital One dispute department on XXXX. Included with letter was all the emails, purchase order, XXXX letter, and Return policy. Capital One replied that I was denied due to XXXX XXXX XXXX said they had " Confirmation showing No Cancellation policy received ''. I called Capital One to tell them that was not true and to refer to the emails XXXX XXXX XXXX sent me confirming they would refund my money once order was received as well as to look at my purchase order showing nothing about Cancellation policy, only the return policy. Capital One replied, " at time we began an investigation into your dispute and requested information from you. While we have received your response to this request, it lacks all of the previously requested information needed to validate your dispute. Unfortunately, based on the information we have, we are unable to assist with your claim.If you still want to dispute the charge, please contact the merchant and work directly with them. At this time, we consider your case closed. '' I then emailed XXXX XXXX XXXX asking for a copy of the Cancellation policy. Their reply was a link to the Return Policy. So I sent in another letter to Capital One along with XXXX XXXX XXXX XXXX reply email, not being able to show me Cancellation policy. I was denied again by Capital One. Why isn't Capital One asking XXXX XXXX XXXX for a copy of their Cancellation policy? And, why did I get refunded for {$14.00}, but not {$310.00}? So end result, Capital One denied my dispute to refund me for remaining balance, {$310.00} to my Capital One Quick Silver Credit Card. I have also filed a complaint on XXXX XXXX XXXX with California State Attorney General and trade commission. Thank you for your time,

Consumer Complaint: My car was broken into on XX/XX/2023 my cell phone and debit cards where stolen .and my driver XXXX license. I reported to police as soon as I could but I didnt have a phone to use, when o them called capital one the first time they said they were not able to file a claim because it was after fours and nobody was available this happened 2 days in a row when I borrowed a phone to use. Then few days later when borrowing someone else s phone again I was able to file a claim however I spent over an hour on the phone only to be told that they would not process my claim due to me lacking iD verification or a recognized phone number. So now its well past 2 or 3 days. I finally borrowed money to pay for have an old phone of mine reconnected to my number and was able to call and activate my new card and regain access to all my accounts and check emails. This is when I learned that they had closed my account and denied my claim for aprox. {$1500.00} in fraudulent charges yet they had refunded almost {$200.00} in unauthorized charges on a separate claim they had had me file that day. This is. about the time I read a couple emails I hadnt been able to receive until I had got a new device to use, and saw them. There were several of them asking me to verify some suspicious charges that were from the XXXX around those dates, I didnt even see these emails until the 14 th aprox. Now I had escalated these claims to the bank they still followed thru with closing my account and saying In the notice they sent me that they are entitle to close accounts at any time for any reason. Then I as told over the phone by an agent that the charges had been in line with previous spending patterns and that they were infact valid and claim is now resolved. They also said they had caught lying because, I had said that nobody else knew my pin # and the pin had been used. However thats not what I had said, I had said the pin to my account was on and in my phone and my phone had been stolen my Email and bank accounts had, both had been compromised the thieves had changed my pin and passwords and well as. ThEn a few days more and I recieved a check for XXXX $ from my closed checking account and a notice stating claims were officially closed and blah blah blah this is XXXX situation is causing me extreme Stress and I have bills I cant pay, Im constantly in a state of worry over ever since this occured
