Issue: Opening an account
Subissue: Unable to open an account
Consumer Complaint: Dear Consumer Financial Protection Bureau, I am writing to submit a formal complaint against Capital One regarding the denial of my application for a 360 Checking account. My name is XXXX, and I arrived in the XXXX on XX/XX/XXXX through a XXXX XXXX. In an effort to secure a safe place for my funds, I opened a XXXX XXXX XXXX XXXX XXXX XXXX account on XX/XX/XXXX, as the nearest bank. Given my current jobless and social benefit-less status, it is crucial for me to rely on my available funds for daily necessities until I secure employment. Upon learning about the advantages of Capital Ones 360 Checking, I eagerly sought to enroll but lacked my Social Security Number at the time. On XX/XX/XXXX, equipped with my SSN, I contacted Capital One to open both a Savings and a Checking account, aiming to link them, especially with an upcoming job starting on XX/XX/XXXX. Regrettably, while the 360 Performance Savings account was successfully opened, my application for 360 Checking was denied. The reason provided was a report from XXXX XXXX XXXX XXXX XXXX, indicating a bad deposit account score ( XXXX ) and, consequently, a negative banking history. I find this perplexing as my entire banking history spans a mere XXXX days, during which I struggled to meet basic needs without income. I am seeking your intervention to understand how a negative banking history was determined within this short timeframe, especially considering my circumstances. Without gainful employment, my financial activities have been limited to essential living expenses.

Consumer Complaint: I took advantage of capital ones sign on bonus for their XXXX checking account of {$350.00} add fulfilled their requirements less than two months. When I tried to create the checking account through their app which I already had installed, as I have already have XXXX of their credit cards. In going through the steps to Create the account ( nowhere was I given an opportunity to fill in the box with the special code I was given before signing up. I kept going through screen after screen, hoping the app would allow me to enter the special bonus code. When I got to the submit, I was still thinking the bonus code would be on the next page and it wasnt. Nowhere in the promo did it say I would have to go through the web browser to get an opportunity to fill in the code. By applying for the checking account through the app, I was set up for failure without knowing it. After fulfilling the requirements, I started making phone calls and asked Where is my bonus money??? several agents told me they would manually take care of it, and I would get my money, but Ive been waiting for almost a month and Ive gotten nothing posted in my account. Basically, it is a scam that I felt into a trap that they knew or should have known would never be attainable through the app.

Issue: Getting a credit card
Subissue: Application denied
Consumer Complaint: I am writing to file a formal complaint regarding discriminatory practices I believe I encountered during my recent credit card application with Capital One. On XX/XX/2023 I was denied for a Platinum Credit Card with Capital One and after receiving their Adverse Action Letter I responding back in writing that they received on XX/XX/2023. On XX/XX/2023 I reached out to Capital One via phone call to verify the delivery of the response letter and was told they didn't receive it yet and the representative was willing to provide a second review that was ultimatley denied as well that same day. I reached out to Capital One again via phone call on XX/XX/2023 to which they still had no knowledge of my response letter and for any questions I had regarding the denial should be taking up with the credit bureau. I spoke with a supervisor by the name of XXXX and asked her may I just retract my application giving its been denied for a second time and she advised me that they must keep applications in their possession for 25 months before a retraction could be possible. Despite applying in good faith, having the capacity and creditworthiness to credit my application was still denied. This discriminatory action is a clear violation of the Equal Credit Opportunity Act ( ECOA ), which prohibits credit discrimination on the basis of protected characteristics. I am seeking an investigation into this matter to ensure that fair and equitable lending practices are upheld as per federal law. Additionally, I request appropriate action be taken against Capital One if discriminatory practices are found to be true. Ill upload my response letter and other documentation supporting my claim.
