Consumer Complaint: I, XXXX : XXXX on behalf of XXXX XXXXPrincipal notified XXXX XXXX XXXX XXXX of Capital One Bank by certified mail XXXX XXXX XXXX instructing him to apply my principals balance to my principals account. I sent him my tender along with my instructions pursuant to the Bills of Exchange Act. I informed XXXX XXXX that it is not now, nor has it ever been, my intention to avoid paying any obligation that I lawfully owe. I am not refusing to pay. My account was immediately closed, and my instructions were refused. I notified XXXX XXXX, XXXX of Capital One Bank by certified mail again dated XXXX, and demanded my account be reopened for use, and again provided my instructions. Again, XXXX XXXX failed to perform his fiduciary duty. I received a letter from Capital One dated XXXX, stating that they do not accept my presentment. This is described as Dishonor pursuant to the Bills of Exchange Act ( Section 80 ). I notified XXXX XXXX, XXXX of Capital One Bank a XXXX time dated XXXX, by registered mail and again instructed him to apply my principals balance to my principals account. I sent him my tender along with my instructions pursuant to the Bills of Exchange Act. Once again, my instructions were refused. Pursuant to the Federal Reserve Act ( Section 29 ), XXXX XXXX has shown a pattern of misconduct and knowingly breached his fiduciary duty ( Third Tier ). I would greatly appreciate any assistance you can provide in this matter.

Consumer Complaint: I have never been a customer of Capital One. On XX/XX/2023, a Capital One 360 Performance Savings Account was opened using my name, phone number, SSN, old address, and old email address. I received another email that day that my phone number had been updated. On XX/XX/2023, I received an email saying that I was approved for a Venture Rewards credit card and another email saying that I confirmed receiving paperless communication. I never opened up either of these accounts or made any of these updates. I called Capital One to inform them of the situation. They opened an investigation, told me my account was frozen, and told me to contact the credit bureaus. I froze my credit with all 3 major credit bureaus. Today ( XX/XX/2023 ), I received an email saying my credit card was shipped out and on its way to me. I called Capital One back to see why this was happening when I never applied for one, an investigation was going on, and the account should have been frozen. The representative closed the savings account and forwarded me to someone who could close the credit card account. That representative asked for my name, SSN, and date of birth to close the account and then said they were not able to close the credit card account due to " system issues '' and asked me to call back later. I tried calling back 5 minutes later, and a different representative said they need at least 30 minutes. I will call back in 30 minutes. I don't know why both accounts were not closed in the first place.

Consumer Complaint: I made a purchase on my Capital One Spark Business credit card on XX/XX/2023 from XXXX XXXX XXXX for a 3 month marketing campaign. The deliverables were not per the contract, regular reporting was not being done, and the merchant was unresponsive/late with responding. After repeatedly contacting the merchant starting approximately the first week of XX/XX/2023, I requested to cancel my campaign, at which time the merchant threatened legal actions. I received no further communications after XX/XX/2023. So, I contacted Capital One and disputed the transactions on the grounds that I did not get what I paid for. On XX/XX/2023, Capital One recharged my card upon the merchant responding. The merchant presented both the original contract ( signed ), as well as their analytics to Capital one. Capital one gave me a chance to dispute this by XX/XX/2023. On XX/XX/2023, I submitted my response along with my contract ( unsigned ) and my own analytics from my website which does not match what the merchant reported. I contacted Capital One on XX/XX/2023 as I had not received any further correspondence. I was advised to check my account at capitalone.com for correspondence. Here I found a letter from Capital One dated XX/XX/2023 declining my response and reinstating the charge from XXXX XXXX. I, however, never received this correspondence and had no knowledge of it until XX/XX/XXXX. Also, the correspondence asked for further documentation which was not clear. After inquiring with the agent on the phone, I was told that I needed an original " signed '' agreement which was not previously stated. Capital One is also requesting a " second opinion '' from a competitor of XXXX XXXX, even though I did submit my own analytics from my hosting company. Further, my campaign was supposed to be for 3 months. My campaign went live on XX/XX/XXXX and I've had 0 correspondence from the XXXX XXXX since XX/XX/XXXX, XXXX s such, I believe they did not uphold our agreement and that Capital One has failed in holding them accountable, instead, they have me paying for services that I did not receive.

It has been 30 days and you are in VIOLATION of this law because I am a victim of identity theft!! Please delete these items IMMEDIATELY! These accounts should not be furnished on my consumer report as they are in VIOLATION under, 15 U.S. Code 1681b Permissible purposes of consumer reports ( a ) IN GENERAL subject to subsection ( c ) any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) In accordance with the WRITTEN INSTRUCTION of the consumer to whom it relates. I NEVER gave any consumer reporting agency WRITTEN COSENT to report anything on my consumer report which violates my rights as a federal protected consumer. NO CONSENT IS IDENTITY THEFT. Consumer Complaint: This is an ongoing issue with Capital One and I have had nothing but problems dealing with this credit card company. I opened up an account on XX/XX/2023 and which I was told I could do a balance transfer in which they did not happen because something was wrong with their computer system. Finally on XXXX XXXX XXXX XXXXI was able to get through to make a balance transfer but now I am finding out that its still pending and the balance transfer wont even go through before the XXXX of this month and which I told all customer service representatives and a supervisor that it needed to go through before XXXX XXXX XXXX XXXXXXXX. I was told it would only take 3 to 5 days once my balance transfer was not pending anymore. Now I am hearing for the first time from a supervisor that it will take 15 more days after the 3 to 5 days before a check can be issued to my other credit card company for the balance transfer amount. So today I had to cancel the balance transfer because Capital One did not start the balance transfer process when I first called initially because they were having computer issues. Had Capital One taken care of the balance transfer immediately The balance transfer would have taken place already and my other credit card company would have received payment for balance transfer.

Consumer Complaint: The Capital one account showed up on my credit report. I told them that I didn't request the credit card. They're asking me to pay for the credit card fees and they will match. I told them that I'm not paying because I never ask for the card. Pay them to boost my credit but they lowered my credit by XXXX points for this card. I told them to remove and close. The continue to charge the fee and now my credit is a XXXX for the card and missed payments. I never got this card. Please remove from my credit.
