Consumer Complaint: I requested for XXXX, XXXX and XXXX to remove multiple non-mailable addresses from report and XXXX told me that they can not remove addresses and you can never get in contact with XXXX and XXXX. I have multiple charged off accounts on my report that the bureaus keeps stating they are accurate but according to 15 usc 1681a ( 2 ) ( 1 ) late payments are illegal according to this law and under exclusions. Charge off is considered to be written off as a loss and considered when filing taxes as to be taxable income and should not be used and against the law to use in credit reporting and I have tried to fix this with the bureaus and they still have not corrected my report. And past reporting to credit. The Act ( Title VI of the Consumer Credit Protection Act ) protects information collected by consumer reporting agencies such as credit bureaus, medical information companies and tenant screening services. Information in a consumer report can not be provided to anyone who does not have a purpose specified in the Act. Companies that provide information to consumer reporting agencies also have specific legal obligations, including the duty to investigate disputed information. In addition, users of the information for credit, insurance, or employment purposes must notify the consumer when an adverse action is taken on the basis of such reports. The Fair and Accurate Credit Transactions Act added many provisions to this Act primarily relating to record accuracy and identity theft. XXXX XXXX Act transferred to the Consumer Financial Protection Bureau most of the rulemaking responsibilities added to this Act by the Fair and Accurate Credit Transactions Act and the Credit CARD Act, but the Commission retains all its enforcement authority. 15 U.S.C. 1681 ( 1 ) The banking system is dependent upon fair and accurate credit reporting. Inaccurate credit reports directly impair the efficiency of the banking system, and unfair credit reporting methods undermine the public confidence which is essential to the continued functioning of the banking system. With that being said you cant report a charge off and current late payments on a credit report and this is clearly a violation of fair credit reporting. I have been disputing this same is time and time again and this is causing a hassles for something that should be deleted because it violates the law of credit reporting by all agencies. And reporting a past due amount on an account that is charged off as well. According to the Fair Credit Reporting Act 15 USC 1681 section 602a states there is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. XXXX and XXXX are the consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isnt shared which is backed by 15 USC 6801 which states It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers or nonpublic personal information. 15 USC 1681s-2 ( A ) ( 1 ) A states a person shall not furnish ANY information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 USC1681e states that Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX, XXXX and XXXX are not maintaining reasonable procedures. 12 CFR 1016.7 states that a Consumer may exercise the right to OPT OUT at any time. Furnisher of information to credit agencies is a financial institution by definition under that title. 15 USC 1681 section 604a section 2 states that In general Subjection to subsection ( c ) any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. Furnisher of information to credit agencies the financial institution and the Consumer reporting agencies XXXX and XXXX do not have any consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX and XXXX ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that a financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. Furnisher to credit agencies Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states except as Authorized under subsection ( b ) no consumer reporting agency may make any consumer report containing any of the following items of information any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. This account is an adverse item they are reporting again without my permission which is against the law. Per the FCRA as a federally protected Consumer, I am now opting out of ANY and ALL authorization I the consumer may have given you written, no-written, verbal and non-verbal per 15 USC 6802. Im Rescinding that authorization per 15 USC 6802. This is effective immediately and indefinitely.

Consumer Complaint: The month closest to XXXX of XXXX my accounts with CAPITAL ONE - Savor ending in XXXX and Platinum ending in XXXX I was sent many times on my capital one account on my phone app to set up a financial hardship arrangement. I answered and did the steps needed to get right with capital one. I had submitted my hard ship due to 3 deaths in my family unexpected funeral expenses that was left to me to bare with making things worse I XXXX XXXX XXXX due to the business closing with much losses due to the pandemic. With doing my best with the past 3 months to keep up with my hardship arrangement capital one has continued to add high interest on top of that late fees on both of my accounts. How do capital one think that this is helping anyone on a hardship, jobless and with this inflation? Capital one has taken advantage of myself who has done nothing but try to make sure I make my payment as best as I can. I called Capital one on XX/XX/XXXX. I requested to return late fees and stop interests accrued to both accounts. When I called capital one representative XXXX did not find any where in the system my hardship arrangement ( Red flag for me ) I then asked for a manager spoke to XXXX whom was no help she kept saying unfortunately ther is nothing I can do. XXXX did not offer any solution nor budged to look into what options could possibly help my situation nor did she budge to look into how the interest could be paused and late fees be retuned to avoid more deep depth. I should NOT be charged minimum finance charges nor late fees in the duration of my hardship payment plan. Both accounts the APR should have been set at 0 % - Not even offer a temporary fee relief to help ease the burden on both my accounts. Both of accounts are restricted from it being used why am I still being charged and penalized? It is sad to know people like XXXX ( manager ) is running this type of company a person that do not care for others with hardship no sympathy nor understanding what so ever.

Consumer Complaint: On XX/XX/2023, I was charged XXXX XXXX XXXX XXXX. I experienced a multitude of issues with the services provided by this company and attempted for weeks to resolve the matter with the merchant. On XX/XX/2023, I contacted Capital One by phone to inquire about the ramifications of accepting a partial reimbursement of the {$1000.00} in overcharges I was due back from XXXX XXXX I was assured that accepting the partial reimbursement of {$320.00} the company was offering would not preclude me from disputing the remaining amount with Capital One. On XX/XX/2023, after the merchant refused to take responsibility for a vastly inaccurate estimate they admitted to having provided through not fault of mine, and after accepting their partial reimbursement of {$320.00}, I filed a dispute with Capital One for the remaining {$690.00} I was owed. On XX/XX/2023, I was notified by Capital One that the merchant had responded to my complaint and that the temporary credit for {$690.00} had been removed from my account. I was offered the opportunity to provide documentation supporting my claim and promptly did so, to the tune of XXXX pages. On XX/XX/2023, I was notified by Capital One that, despite my having provided all documentation the bank requested, my response was incomplete and that, as such, the dispute had been closed in the merchant 's favor. On XX/XX/2023, I contacted Capital One by phone and spoke with XXXX different representatives. I don't have the name of the first representative with whom I spoke that day, but the second representative advised that her name was XXXX. Both representatives gave multiple conflicting reasons as to why Capital One could not assist me with the dispute. Each time I pointed out in the documentation I had previously provided where I had given a piece of information they claimed it lacked, they came up with another, new reason why Capital One could not assist me. At one point XXXX claimed that, because the merchant 's invoice I provided did not have an invoice number on it, Capital One could not assist me. When I pointed out, referencing my own copy of the documentation I had sent Capital One, exactly where the invoice number was, XXXX then claimed that because the invoice did not have the word " invoice '' on it, Capital One could not help me. She later insisted that a receipt is provided before services are rendered, not after, which is clearly inaccurate. Based on my phone conversations with Capital One representatives on XX/XX/2023, I strongly believe that the XXXX pages of documentation I painstakingly compiled and provided to Capital One in support of my dispute either were not read or were not understood. I believe that language and/or cultural barriers likely prevented the dispute resolution team from properly and thoroughly reviewing my documentation and making the appropriate decision with regard to the outcome of the dispute. As such, on XX/XX/2023, I emailed Capital One CEO XXXX XXXX requesting that a dispute resolution specialist in the United States review the case thoroughly, including the XXXX pages of documentation I had provided. On XX/XX/2023, I received a mostly unintelligible voicemail from XXXX with Capital One 's XXXX office requesting a call back regarding the dispute. She provided a toll-free number that was different than the one on the back of my credit card. When I returned the call approximately 30 minutes after receiving XXXX 's voicemail, I reached a representative who had no knowledge of my dispute and no idea why or about what I was calling. She placed me on hold then returned to the line approximately XXXX minutes later saying that she had reached XXXX and was asked to inform me that Capital One 's previous decision regarding my dispute remained final. I was refused the option to speak with XXXX or anyone else regarding the matter further.
