Consumer Complaint: Called company daily beginning XX/XX/2023 through XX/XX/2023 and formally requested, in accordance with the Texas Freedom of Information Act, that copies of all information and data regarding my vehicle loan be sent to my current address. This was to include their reason for their decision to restrict my online access since XX/XX/2023. They have refused to do so. Also request copies verifying all payments made, interest paid, principal owed, and the documentation verifying the current status of the account. Subsequent request were made again in XXXX, XXXX, and XXXX. Capital One Auto Finance refuses to comply with my request. The last request for this documentation was made in mid XXXX. The current account status on my XXXX Credit report shows the account is CLOSED and that it has been CHARGED OFF and WRITTEN OFF. It also shows the payment status as Late for XXXX among other months. However when I call to Capital One Auto Finance they state the account is CURRENT and OPEN. I have ask them to CORRECT the errors on my credit report and filed several disputes with each of Credit reporting agencies ( XXXX, XXXX, and XXXX ) however my disputes are denied saying the investigation finds the information valid and accurate ( paraphrasing ). 1. Please allow me online access again since it has been 180 days since my request was made and it still remains ignored. 2. correct the credit report ( all 3 ) to reflect as OPEN and as current and due to the fact the payment history is filed with inaccuracies and due to the fact Capital One refuses to provide me with updates regarding my balance, confirmation of payments, etc I ask that the Credit report shall reflect no late payments or delinquencies. I request this due to the illegal, and egregious and retaliatory manner in which Capital One Auto Finance has administered my loan.

Consumer Complaint: XX/XX/XXXX - We discovered that our credit card was 4 days in arrears in paying our bill, and called Capital One to resolve. The clerk said she could initiate a transfer from our XXXX account, and I authorized the transer without giving her an account number. She initiated the transfer from her side, but using an old XXXX account number and sending to XXXX. The transaction number was XXXX. XX/XX/XXXX - I discovered online that the transfer of {$10000.00} from XXXX using acct # XXXX had been rejected by XXXX. XX/XX/XXXX - I called the bank for an explanation of the returned transfer and was tranferred to the Capital One Fraud Dept, hereafter referred to as, " XXXX XXXX XXXX. '' They told me I needed to pay the full amount again plus interest, and also to provide them a statement from my XXXX account, while they " investigated '' the transaction. This I did, immediately, sending them a copy of my XXXX statement ending in XXXX. XX/XX/XXXX - Noticing online that the accoount was still frozen, I called Capital One and was immediately routed to the XXXX XXXX where I was told my documentation was still not in order, and that the investigation could not proceed untill I sent them documentation for acct # XXXX. ( the account from XXXX that their clerk had erroneously used for the initial rejected transfer ). When I complained that I did not have that account documentation the customer service supervisor ( " XXXX '' ), hung up on me.

Consumer Complaint: Hello, I am a CapitalOne credit card customer. My payment was due yesterday on XXXX XXXX, however the website was down throughout the day. ( Screenshot attached below ). I made multiple attempts to login and kept getting the error message. When my work day concluded, I downloaded the app, and promptly made my payment. It was before XXXX in Colorado, so my payment was made on XXXX XXXX, 2023. However, a {$40.00} late fee was already assessed. I called CapitalOne and explained that I wasn't able to make the payment online b/c of the website glitch and that I wasn't able to make a phone call, and asked that they reverse the fee given that the delayed payment was due to errors with the website. I escalated it to a manager. They told me they would not reverse the fee.

Consumer Complaint: Ongoing FCRA Violations and Credit Reporting Discrepancies on my credit reports with XXXX, XXXX, and XXXX, specifically related to the charge-off account with the account number XXXX, originally held with Capital One Bank . Despite multiple disputes and Capital One 's confirmation that the account is not currently reporting, it persists on my credit reports. Capital One 's response on XX/XX/XXXX, clearly stated that " the credit bureaus are not displaying this account on your credit report. '' However, subsequent disputes with the three major credit reporting agencies ( CRA ) have yielded inaccurate verifications. This situation is further exacerbated by the XXXX representative 's statement on XX/XX/XXXX, asserting that Capital One needs to confirm that the account is no longer reporting to them not me. I find this perplexing, given that I have provided XXXX with my dispute letter to Capital One and the corresponding response, yet the account still reports as verified. Furthermore, the discrepancy in reporting among XXXX, XXXX, and XXXX raises serious concerns about the accuracy and consistency of the information they rely on. If Capital One asserts that the account is not reporting, why do all three CRAs independently verify its presence? I want to bring to your attention three critical issues that require immediate resolution : 1. **Expiration of Reporting Period** : The Capital One charge-off account has exceeded the permissible seven-year reporting period under the FCRA. It should have been removed from my credit reports upon reaching this time limit. 2. **Verification of Reporting** : Pursuant to the FCRA, I request verification of the accuracy of this charge-off account. Please provide the necessary documentation to substantiate its legitimacy. 3. **Sold to XXXX XXXX** : This account was sold to XXXX XXXX , making it a violation of the FCRA to continue reporting it under Capital One 's name.
