Consumer Complaint: I am writing to inform the Consumer Financial Protection Bureau ( CFPB ) about a distressing situation involving identity theft and inaccurate information on my consumer credit report. Despite my efforts to address this issue directly with the credit grantors and the three major credit bureaus, I have been unable to secure the removal of the fraudulent and inaccurate items from my credit report. As a victim of identity theft, I have diligently followed the appropriate steps to resolve this matter. I have filed a police report, reported the incident to the Federal Trade Commission ( FTC ), and provided all necessary documentation to support my case. However, despite my best efforts, the inaccurate and fraudulent accounts remain on my credit report. I have also directly contacted the credit grantors associated with the fraudulent accounts, as well as the three major credit bureaus, in an attempt to dispute and rectify the situation. Unfortunately, despite providing ample evidence and documentation, these inaccuracies persist on my credit report, causing undue distress and potential harm to my financial standing. I am committed to upholding the accuracy and integrity of my credit report, and I believe that your intervention will be instrumental in achieving this goal. I appreciate your attention to this serious matter and your dedication to safeguarding consumer rights.

Consumer Complaint: Credit inquiry received on XX/XX/2023 for a credit card with Capital One. This was not me. I immediately contacted Capital One and they said the account was not opened. However, Capital One has not reported this to XXXX even though they claim they sent he request. XXXX claims they have requested Capital One to respond to the false claim to remove from credit report but Capital One has not responded according to XXXX. I have waited 6 months to get this resolved and want this removed from my credit report immediately.

Issue: Problem when making payments

Consumer Complaint: I have not used my Capital One XXXX for XXXX XXXX before using my card on XX/XX/XXXX. I never received a bill. email, letter, text, or telephone call advising me that my payment was due or past due from XXXX to XXXX. My Alerts that I set up XXXX XXXX prior failed to work. I did not notice I owed for this card until I tried to activate my other Capital One XXXX on XX/XX/XXXX. I noticed my account was past due and immediately made a XXXX payment on XX/XX/XXXX and XXXX on XX/XX/XXXX. I called Customer Service to tell them what had happened and the Customer Service XXXX XXXX said the same thing had happened to her and you have to update the app once in a while but she can not do anything about it. I sent a letter to Capital One on XX/XX/XXXX and they never responded. I sent another letter to Capital One on XX/XX/XXXX and they finally responded. They sent copies of internal billing statements which I never received in XXXX and XXXX and they admitted that mistakes happen if you do not use your credit card much. I asked Capital to remove the XXXX late mark on my credit report but they refused. I asked them to delete my account from the credit reports but they refused. They reduced the credit limit on both accounts XXXX from XXXX to XXXX and the other from XXXX to XXXX I have had this account since XXXX and I have never been late. My XXXX Credit Report was XXXX. Please help.

Specifically, as it relates to credit inquiries that I did not authorize, made by the following companies : Inquiries : I did not authorize anyone employed by these companies to make any inquiry and view my credit report. This is a violation of the Fair Credit Reporting Act Section 1681b ( c ) and a serious breach of my privacy rights. I am making this final goodwill gesture to allow you to correct your erroneous reporting, and I am maintaining a careful record of my communications with you for the purpose of filing a complaint with the Consumer Financial Protection Bureau and the Attorney Generals office, should you continue in your non-compliance. Consumer Complaint: On the date of XX/XX/XXXX, I purchase a car from XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, a leased vehicle XXXX miles with Capital One Auto Finance ( COAF ) as the lienholder. Shortly, after purchasing the car, I continuously had mechanical issues with the car. But, on the date of XX/XX/XXXX, the car had a major engine failure, which I had towed to the local XXXX XXXX XXXXXXXX XXXX XXXX, XXXX XXXX XXXX XXXX, XXXX, VA XXXX, because the car can not be driven, but do start. After a diagnostic test on the engine the minimum estimated repair cost is {$5200.00}, not including labor cost. I contacted XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, XXXX, VA XXXX, and I also contacted COAF to make them aware of the situation that I was having with the car. Due to my persistent and sought after legal advice, XXXX was willing to take accountability, and buy the car back, because of the mechanical issues that I was continuously on having with the car. On the date of XX/XX/XXXX, Legal Supervisor of XXXX XXXX informed me that XXXX would be willing to appraise the car as is, and make an offer to buy the car back, if I had the car towed to the nearest XXXX dealership. So, I had the car towed to XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, XXXX XXXX, VA XXXX to have appraised. After the car was appraised I received a very fair offer of {$17000.00}, which was {$4000.00} less than XXXX XXXX XXXX value of {$21000.00} due to mechanical issue of the car. But COAF was not willing to release the title to XXXX XXXX XXXX for what the car is actually worth, because the think the are entitled to over {$17000.00} in negative equity in the car. I informed COAF of a reasonable solution to the issue, which in turn they declined. During the fourteen months that the car was operational, and I was able to drive the car I made my monthly payments on time. The car has not been drivable, and jus been parked in my driveway since XX/XX/XXXX. I did stop making payment on the car for the past three months. So, COAF is fully aware of this major mechanical issue with the car, but still wan me to make monthly payments. I recently checked my credit report, and COAF has added this negative item to my credit report in the amount of {$34000.00}, plus two missed payments, which to date has reduced my credit score over a XXXX points. For, COAF to add this amount of {$34000.00} to my credit report is an abuse of debt collection, and the use of negative credit reporting as a threat. Because, not one time has COAF reached out to me about repossessing the car or nothing. The reason why COAF has not repossessed the car is because of the minimum estimated repair cost of {$5200.00} or more, not including labor cost, and because of the car resell value, but would like to keep this negative item on my credit report even though they do not want the car.

Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services. I also requested all corporations to fill out a form 1020 and return back to me and still haven't gotten it

Consumer Complaint: I overnighted a check to Capital One per their instructions. They could not verify receipt for several days even though I provided tracking. They continued to give me excuses like it must be processing. The check posted on XX/XX/XXXX with an available date of XX/XX/XXXX. I called customer service to inquire and the customer service department out of the country is asking for too much information. They asked why I have the check. I explained the check earlier. Its not every customer service reps business Why I have a check! They should verify funds and release my money. Enough is enough. They are holding my funds unnecessarily. I have business to take care of. At this point they are giving me the run around. This is unacceptable! Please have someone contact me to resolve this matter.
