Consumer Complaint: As a consumer I have researched and discovered that there have been multiple reporting violations to not only my privacy but accuracy of information. This has causes hinderance in my daily life as a consumer as I have tried to resolve these reporting issues plenty of time only to receive denial and rejection of every attempt when removing inaccurate items from my credit report. I have attached a letter directed to 3 main financial institutions and 3 main Credit reporting agencies that have hindered my progress as a consumer and created great hardship and mental strain. Please refer to the attached letter for further details of this situation. I have noticed multiple inaccuracies and unfair consumer reporting practices amongst XXXX, XXXX, and XXXX along with Capital One Auto Finance, XXXX, and XXXX XXXX which are financial institutions that have negatively impacted my credit report. They are in direct violation of the Fair Credit Reporting Act 15 USC 1681 section 602 a which states " There is a need to ensure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX. XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared this rule is mentioned in 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. " Capital One Auto Finance, XXXX, and XXXX XXXX are all financial institutions by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. Capital One Auto Finance, XXXX, and XXXX XXXX, the financial institutions and the Consumer reporting agencies XXXX, XXXX, and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, XXXX, Capital One Auto Finance, Stellantis, and XXXX XXXX whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' Capital One Auto Finance, XXXX, and XXXX XXXX never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX, XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. I, XXXX XXXX XXXX, am opting out of your reporting services. Any and all reports that have previously unlawfully reported must be removed upon notice of this letter.

Consumer Complaint: Capital One Walmart Credit card is the company. It started when our online account was hacked for over XXXX dollars. They made it horribly impossible to get it taken care of. I have requested payoffs that they say they never recieved. I got a loan through XXXX XXXX XXXX XXXX to pay off the Wal-Mart card with capital one. The check was mailed on XX/XX/2023 from XXXXXXXX XXXX to Capital one on 2 different accounts as well as other credit companies we had. Everyone recieved and cleared on the XXXX of XX/XX/2023. All except Wal-Mart capital one. I called again today to request another copy via email as well as paper. They still on this day the XXXX of XXXX claim they have not recieved the payoff check, at that time was for XXXX. I now have a missed payment, late fee as well as outrageous interest occurring totalling XXXX. We have been trying to get away from this company since our accounts was hacked from another state with people using our account to do in store pickups. How that was even possible without proper identification is beyond me. Made me think it is inside jobs going on. I feel they intentionally haven't sent that check through their system so they can occur more fees and interest at 27.99 % please help!

Consumer Complaint: CAPITAL ONE has entered into a consumer credit transaction with via using my social credit card defined under 15 USC 1602 to extend me my on credit on multiple accounts. In the year of 2022 CAPITAL ONE has committed ADVERSE ACTION and has discriminated against me and my RIGHT TO CREDIT as defined under 15 USC 1691 by shutting down my accounts and denying me a Granted Right which is access to extend credit. CAPITAL ONE has been in violation of the ECOA and Tittle 18 USC 242 for denying me a federally protected right to extend credit and have access to credit. CAPITAL ONE once aft er taking ADVERSE ACTION discriminating against me has reported false statements on my consumer report hurting my reputation and hurting my credit worthiness further negatively impacting my right to extend credit in the banking system. CAPITAL ONE is reporting an alleged debt that arose out of a consumer credit transaction via a FINANCE CHARGE and is falsely reporting charged off accounts as Income on my reputation as defined under IRS Guidelines. TENDER of payments were attempted to be made on the accounts to satisfy the alleged debt In Good Faith but was REFUSED by CAPITAL ONE. Such Refusal of legal tender has now discharged the debt under UCC 3 -603 and has placed CAPITAL ONE under a violation of the Federal Reserve Act Sec 29. CAPITAL ONE has been given the opportunity to perform and provide VALIDATION of the alleged debts by providing key information that which if provided payment in FRN would be made. CAPITAL ONE has failed to provide Lawful validation of any Lawful debt and despite lawful payment attempts being made and continues to furnish false statements on my reputation harming my character and right to credit.

Consumer Complaint: I am writing to address a pressing matter related to my Capital One account Recently, my wife XXXX XXXX submitted a request to update her profile, specifically to replace her ITIN with her Social Security Number on her accounts. She is an authorized user on one of my credit card account. Unfortunately, it appears that during the process of updating her information, an error occurred within Capital One 's system. This error has led to the creation of a duplicate entry and a mismatch in my account details that requires immediate correction. Regrettably, this significant oversight by Capital One has rendered me unable to access any of the products associated with my account, including my checking accounts, savings accounts, and credit cards. It is evident that this situation is causing undue financial strain, as Capital One is currently withholding my funds without any legal mandate, thereby causing unwarranted delays in meeting my financial obligations. Consumer Complaint: XX/XX/2023 CAP ONE refuses to fix this issue that is stressing and causing great emotional stress on my life. They are reporting a charge off for alleged debt that they never proved to me it was mine. All they sent were printed statements however this is not considered proof in court. CAPITAL One is reporting a charge off and this is against FCRA VIOLATIONS and they know this. A charge off means Capital One told the IRS they cant collect on this debt, the IRS gave Capital One a tax credit however CAP ONE is still trying to collect this alleged debt basically violating the law. I need them to send me proper verification or remove this account, immediately. Shame on you Capital One. Cap ONE XXXX
