Consumer Complaint: RE : Fraud and dispute of charges Case XXXX XXXX XXXX XXXX XXXX, I was reviewing my Capital One checking account statements, and noticed an ATM Withdrawal from XX/XX/XXXX for {$110.00} plus {$3.00} fee. It immediately caught my eye because WE DONT USE ATMs. There was no way to identify the location other than XXXX, where we live. I then went to look at past statements and found additional ATM Withdrawals, all in XXXX except for one in XXXX, WHERE I HAVE NEVER BEEN. I contacted Capital One in XXXX ; you cancelled my previous card ( ending in XXXX ) and sent me a new one, crediting my account for the 5 ATM withdrawals that I DID NOT MAKE. I received the new card ( ending in XXXX ) and activated it on XX/XX/XXXX. I have it in my possession and have cut up the old card. Today I was contacted via email that the credit is being reversed because your investigation showed that a chip card was used in these locations. How could my card have been used in XXXX, where IVE NEVER BEEN. Please review these facts : 1. Again, we dont use ATMs. I cant remember the last time I used one, except twice in XXXX when we were OUT OF THE COUNTRY in XXXX. 2. My husband is a XXXX who gets paid in cash ; we always have cash in the house. XXXX. I use my XXXX XXXX 90 % of the time, and use Capital One when XXXX isnt accepted. But its always a DEBIT not a WITHDRAWAL. XXXX. The only time I take money out is AT A STORE, when purchasing something, I might also ask for Cash Back in small amounts, like {$20.00}. XXXX. I am a good customer of Capital One ; I have friends who work there. I have sufficient funds in my account and have no reason to falsify or take the time to argue and fight these withdrawals. BUT WE DID NOT MAKE THEM. I dont understand how these things work but I DID NOT MAKE THESE WITHDRAWALS and REQUEST TO APPEAL THIS DECISION. As for the specific ATM withdrawals, which I am guilty of not noticing before XXXX : XXXX. XX/XX/XXXX {$60.00} + {$3.00} fee Location XXXX XXXX in XXXX I was not there on that day and can prove that with family and friends who were with me that day. XXXX. XX/XX/XXXX {$120.00} + {$3.00} XXXX XXXX XXXX in XXXX, a XXXX XXXX of where I live, where I have NEVER BEEN, with a company I DONT KNOW. XXXX. XX/XX/XXXX {$70.00} + {$3.00} XXXX XXXX in XXXX, a location I recognize where I have shopped but where Ive NEVER USED AN ATM XXXX. XX/XX/XXXX {$70.00} + {$3.00} XXXX XXXX XXXX XXXX a very seedy and questionable motel where I HAVE NEVER BEEN. I do shop at a retail establishment located at XXXX XXXX XXXX XXXX, and use my debit card there, but NOT AT AN ATM XXXX. XX/XX/XXXX {$110.00} + {$3.00} XXXX is only identified as XXXX, and I was told no one can identify it, other than it being in XXXX. I sent all of this information to appeal their decision on XX/XX/XXXX. Investigations team said they do not accept the appeal, as of today, XX/XX/XXXX, although I have not received the formal response yet. I dont know how this happened, but I am NOT trying to cheat Capital One out of money by claiming fraud for {$440.00}.

Consumer Complaint: I purchased tickets to a broadway show, same day, via the capital one entertainment portal with my capital one credit card. I did this directly through the capital one app on my phone. I intended to pay roughly {$570.00}, but instead we were charged XXXX and XXXX XXXX XXXXXXXX. I do not know how this happened. As soon as I got the confirmation receipt, I noticed. I was boarding a flight to XXXX XXXX. I did manage to get ahold of both the bank and capital one entertainment. they told me there was nothing that could be done, including an immediate refund. By the time I landed, I got to the show right as it started and went to it. After the show, I called and spoke to several different representatives who all said there was nothing that could be done. I verbalized that this was a billing error. I then went to the capital one cafe and a physical banking location. They called customer service with us, and we spent about an hour and a half. I finally gave up, and am disputing the transaction as a billing error. I am fine paying {$570.00} for the show of course, but I want my miles back. Otherwise, I suppose I will need a full refund as this is clearly an error on their part, and I made a good faith effort to rectify it.

Consumer Complaint: Ref CFPB Case : XXXX Capital One stated that XXXX charge of {$530.00} was not fraudulent. However, it was proven in a court of law that XXXX charge was fraudulent. Per communications with Capital One, I clearly showed that XXXX charge was fraudulent. Yet, Capital One ignored the proof. Their claim that XXXX charge was not fraudulent was based on a XXXX Statement, which upon closer examination supported my statement that XXXX charge was fraudulent. See attached This is what I sent to consumer finance protection bureau.docx, which I sent on my first complaint to CFPB. Capital Ones solution to the fraudulent charge was for me to take XXXX to court. Upon researching XXXX charge of {$530.00}, I discovered that they had previously fraudulently charged me twice, once for {$59.00} and once for {$250.00}. Therefore, when I took XXXX to court, I asked for {$59.00} + {$250.00} + {$530.00} = {$850.00}. This was a no-brainer : The court awarded me {$850.00} + {$89.00} in interest. Note : I did not ask for interest on the {$59.00} + {$250.00} + {$530.00} ; the court decide on their own to award me the {$89.00} in interest. Attached are the results of trial ( XXXX ) and a copy of the check that XXXX sent me ( XXXX ). It should be noted that these two pdf files were sent with the first complaint.

Consumer Complaint: On XX/XX/XXXXXXXX I was in XXXX and purchased two pictures and a figurine. I gave the guy my credit card to charge me for the merchandise and a few days later I saw the charge for over {$2000.00} on my card in two separate transactions. I got home on a Monday night Tuesday morning I called my Credit card to dispute the charges. They looked into it and on Thursday I got a letter telling me that the charges were found to be not fraud, and it would be credited back to my account. I called on Friday morning to talk to the manager of the fraud department and explain to her what happened and she told me that nothing could be done and that am going to be resonible for paying you for paying that {$2200.00} that I didn't spend. They told me because the actual card was used to make the purchase. This guy used to machines the first one. He told me it didn't work and then he ran my car to get on something else and I believe that he scammed me out of this money and I should not be responsible to pay for it. I don't have a receipt because the guy was supposed to mail me a receipt and never did for the items that I actually purchased. Here is a list of the purchases I did make in XXXX XXXX XXXX {$58.00} SXXXX XXXXL {$56.00} XXXX XXXX {$83.00} XXXX XXXX XXXX {$270.00} I did not purchase the following - I have no idea where this came from. XXXX XXXX XXXX XXXX {$1300.00} XXXX XXXX XXXX XXXX {$910.00} When the credit card company saw this kind of large charges they should have contacted me right away. And they should have been flagged.

Consumer Complaint: On XX/XX/2023, CapitalOne issued a credit of {$2800.00} to my account with the intention of sending it to me as a check. I was overseas for the last XXXX weeks due to work commitments and only had the opportunity to check my mailbox on XX/XX/2023, upon returning from my business trip. On XX/XX/2023, I proceeded to deposit the check through my online XXXX account. However, on XX/XX/2023, I received an unexpected email notification from my banking institution where I had deposited the check, indicating " Clearing Check Deposit Return - {$2800.00} ''. This resulted in my account having a negative balance, and I am now seeking to understand why CapitalOne would issue a check that ultimately could not be processed. Upon contacting the banking institution where I deposited the check, they advised me to get in touch with CapitalOne, the issuer of the check, as it had been reversed after initially being cleared into my account. Consequently, I contacted CapitalOne today, but they have yet to reissue the {$2800.00} credit. Essentially, they issued a faulty check that caused my other account to go into the negative. CapitalOne claimed that the check had " cleared '' sometime in XXXX, but this seems improbable since I was away until XX/XX/XXXX. XXXX for another XXXX business days for the credit to be resolved is not feasible for me, especially considering my frequent business trips. I am anxious about potentially missing any future checks they send by mail, and their customer service has not been able to provide me with a clear timeline for resolution or an explanation for the credit mishap.
