Consumer Complaint: I am submitting this complaint to CAPITAL ONE due to improper used of my report and reporting inaccurate information on my file. I sent them a letter requesting to have an investigation to the unverifiable account, they stated that they did a proper investigation however when I checked my report the inaccurate information such as date opened, date of last activity, date reported, account status and payment history are still reporting. My rights were violated under 15 U.S.C 1681 section 602 A that states that I have the right to privacy, and 15 U.S.C 1681 section 604 A Section 2 stated a consumer reporting agency can not furnish an account without my written instructions.

Consumer Complaint: my flight to get to my family members funeral in Florida was cancelled within several hours of departure time. I had to get help to find an alternate way to get there! One option was calling XXXX XXXX XXXX XXXX. It appeared as an affiliate of XXXX XXXX. They insisted they were XXXX XXXX XXXX XXXX. They ended up charging this addtl XXXX over and above full flight fee paid to XXXX XXXX. I later found out this is a fraud company & they had no viable way to be contacted. I contacted capital one regarding this fraudulent company & this addtl fee. I included detailed dates, timeline, copy of a documents, phone numbers etc. Capital One then CREDITED my account for XXXX. However on XX/XX/23 they reapplied the XXXX charge to my account stating they are closing the case. We were to contact the merchant. But the merchant is no longer in business & I feel they had no right to charge me! ( again XXXX XXXX had received their full payment ) I believe a fair resolution would be for Capital One to honor this XXXX credit as was originally done!

Consumer Complaint: I contacted XXXX XXXX XXXX on XX/XX/2023, after receiving an alert that my payment was past due. I didn't understand why I had not received a paper copy of my statement. The representative I spoke with waived the {$39.00} late fee. However, she was unable to explain why I did not receive a bill. Initially she told me I was on paperless billing as the reason. I did not sign up for paperless billing. I use my mailed bills to determine when to pay. I have all my other statements coming on paper. She told me I should get a paper bill as well. She also told me that I should get electronic billing, which I don't. She was all over the place. When I started asking more questions, the story kept changing. She even tried to change my story, telling me what I said. I requested a supervisor. I planned to pay my bill off on time every month. The supervisor took the call. I told her that I wanted the recording reviewed, so she could let me know why the representative said what she said. She explained they do not review recordings unless it has to do with a problem with the account. I told her the problem and that I had to go. I asked her to review the information and contact me back. She told me to call back and did not say she would flag the call or anything. Since it was so difficult to explain why my billing is or is not paperless, it should be paperless as I explained to the representative. I got charged two late fees of {$39.00} and {$28.00} and two finance charges of {$60.00} and {$48.00}. I paid the balance up minus the charges of {$190.00}. It is very upsetting when you can not get the proper assistance. I believe the charges I have remaining should be removed.

Consumer Complaint: About 2 months ago I called Capitol One to tell them that we are having financial issues. So they went to get a specialist to help me. I told them that we were having financial issues and can't pay on any of my accounts until the 3rd of the month. I am on XXXX. We also found out that my husband is on a breathing ventilator. And he can't work as much due to his condition. I told him all this and he agreed to a solution. So, I agreed too. Well, two weeks later Capitol One closed all my credit cards and put 30 to 120 days late on my credit reports. They have destroyed my credit. I can't get another credit or personal loan. They have lied and a has used deceptive practices. They used to be a good bank. Now they are one of the worst banks.

XXXX and XXXX has removed the account from the report but XXXX hasn't complied. According to the Fair Credit Reporting Act XXXX XXXX section XXXX a states '' There is a need to insure that consumer reporting agencies exercise their graveresponsibilities with fairness, impartiality, and a respect for the consumers rightto privacy. '' XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' CAPITAL ONE is a financial institution by definition under that title. 15 U.S. Code 1681e - Compliance procedures ( b ) Accuracy of report Whenever a consumer reporting agency prepares a consumer report it shall follow reasonable procedures to assure maximum possible accuracy of the information concerning the individual about whom the report relates. By violating section 1681b for permissible purpose and 1681c for information contained in consumer reports they are also violating compliance procedures under this title. CAPITAL ONE is a financial institution by definition under that title.

Consumer Complaint: On XX/XX/XXXX I went by my old apprtment I see my old mail box was open, and all the mailboxes were gone through. My mailbox there never had a working lock, so I wasnt surprised. A few days later I open all of the mail I found the statement for the capital one card. I was confused, I havent owned a credit card recently nor did I open one. I figured someone took one of the offer letters they sent to my old XXXX . I called capital one and explained to them that the account was opened fraudulently. They reviewed the account, I was shocked to be told most information did not match mine such as birthday, address, SS number. To verify my identity they asked for the same info that was missing/ incorrect on the account. XX/XX/XXXX l got a letter stating I am responsible for the account & charges because it appears the charges or account would have helped me & the information on the account matched mine. This felt confusing as they would not have any correct information if I did not verbally verify my identity when reporting the account. While speaking to XXXX from the fraud department, I was informed that if the account was closed it would no longer incur charges/fees, even with the account closed it has still received charges and fees. Since then I have received multiple confusing statements about the account and how to proceed with getting help. Now i am looking for a straightforward answer.
