Consumer Complaint: I made a {$1000.00} retainer payment on XX/XX/XXXX for an appraisal from a company named XXXX XXXX XXXX. Per Uniform Standards of Professional Appraisal Practice ( USPAP ) adopted by Congress in 1989, this entails reporting the findings and/value. I have not received an such report or information of any sort. In XXXX of XXXX, I notified Capital One that I wished to dispute the {$1000.00} charge as I never received any product or service. On XX/XX/XXXX, I received a letter from Capital One acknowledging they had credited my account during the investigation. XXXX XXXX XXXX responded. I submitted answers to his responses. On XX/XX/XXXX, Capital One notified me via mail that they had declined my dispute and billed me {$1000.00} again. Subsequently, I spoke with a Capital One representative over the phone. He voiced Capital One had sided with XXXX XXXX XXXX because I made the payment unconditionally. My contract reads " For services rendered by us, you unconditionally agree to pay ... '' I am disputing that services were rendered by the vendor, so that second part of this sentence requiting payment is not valid. Despite use of the word unconditionally, the contract sentence has a condition, specifically services have to be rendered. Yes I can agree to unconditionally pay for a XXXX, but it still depends on my receiving a XXXX. I have no evidence of any service being provided and have not seen any appraisal. Capital One does not seem to understand the payment without receiving product or service equates to a scam. XXXX XXXX XXXX also answers that he has financial dispute with a third party that I work with called XXXX XXXX XXXX. In his answers, he provides an email to this third party detailing his dispute. I don't feel I need to get involved in this and certainly should not be responsible for a dispute between him and a company not party to the agreement. The signed agreement is only between me and the vendor. His account status with another company not party to the agreement is not of my concern. Capital One wants me to address this. Why is Capital One holding me responsible for another company? In the end, the representative says they will not credit my account unless the merchant issues a credit because they have no way of recovering the {$1000.00}. I don't think whether Capital One will be made whole is how to fairly decide the outcome of a dispute process. To summarize, I entered into an agreement to pay vendor for an appraisal. I did not receive an appraisal. Capital One is aware of this and sides against my dispute for reason above as explained to me.

Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' The financial institution and the Consumer reporting agencies XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' XXXX, XXXX XXXX XXXX Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services.

I have history of submitting complaints with cfpb & I have an attorney now so at this point, with my records I will build a lawsuit and sue every party involved for aiding & abetting XXXX, XXXX, XXXX, XXXX & the employees thereof

Consumer Complaint: I had a Capital One Walmart XXXX XXXX XXXX XXXX. The account was in good standing the problem began when I lost the card in XX/XX/2022, I called Capital One to request a new card. I was told I would receive it in 5-7 days. After the seven days I never received the card I immediately called the company back and I was told I wouldnt receive the card until I sent proof of my identity at first I didnt mind initially they wanted my drivers license, ssn card, and copy of my bank statement all the things I had to submit to open the account in the beginning. Which was two months prior to this issue. Needless to say they gave me the runaround I was told they would follow up the never did. I went back and forth with them from XXXX till XX/XX/2022 down to the point I was conferenced in with my bank along with Capital One to verify my address. After that I thought it was finally over and they would send the card. They never did they claimed that I didnt send them the proper documents when I did several times. I was so frustrated their customer service was horrible all the hundred plus people I spoke to there, no one properly notated the account. Constantly repeated myself over and over nothing was resolved. Essentially they closed this account my credit score dropped tremendously. They lied to cover themselves I never have dealt with anything like this ever. They said they put a fraud alert in the account because I hadnt had the card long enough and had already lost it and was requesting a new one. They would change what they wanted me to send in as proof of my identity and address they wanted proof of my salary which was ridiculous. The way they carried on someone would have thought this account had a XXXX credit limit. Because the new person that I would speak to wouldnt look at the other pages in the account they would tell me I hadnt sent in the necessary documents. This was so frustrating, I got to a point where I had ask to escalate my issue to the executive offices and by the way the account was in good standing with a XXXX balance.

Consumer Complaint: Capital One has closed my 2 credit card accounts due to a payment being returned. This payment was returned because only because I made a payment of {$200.00} weeks prior which didn't reflected in my available balance yet it was withdrawn from my bank account and shown as posted, this was for almost an entire month these funds were withheld and they refused to give me a reason even though they let me make payments in the meantime, one of which was returned. I called on XX/XX/XXXX at XXXX CST and spoke with a fraud specialist manager who told me that if I made a payment of {$110.00} within 10 days and then called 5 business days after the payment that they would reopen my accounts. I did just that, I made a payment of {$120.00} within the 10 days and called today XX/XX/XXXX to have the accounts reopened and they told me I didn't meet their criteria to reopen the accounts. I mentioned that I spoke with a women and that she took notes and in addition there's a recorded call, but yet the gentlemen I spoke with today said he saw that I called on XX/XX/XXXX but that there was no notes and said that I didn't speak with a manager. I said I did and that if they listen to the recording they can hear exactly what I was told. He indicated that they don't have access to the recordings, which is a lie because after a few minutes of back and forth he said the recordings are kept with quality control. Fine, but then he refused further steps of finding said recording and said I could try calling back. This is outrageous. The fraud specialist even said it's possible someone was posing as a manger to get me off the call. The recording exist. This is the 3rd time I've called Capital One with issues, mostly being about not updating my available credit after I make payments. When the payments don't reflect it looks to me like I didn't make it and so I make another payment not knowing it's coming out of my bank account twice and causing the payment to be returned due to insufficient funds. This is the fault of Capital One 's system and due to there refusal to assist me further I feel this is in retaliation or a way to discriminate me based on my age, gender and XXXX and I will be making this a very public nuisance if Capital One doesn't resolve this.
