Consumer Complaint: For background details - I have a credit limit on the Capital One XXXX XXXX of {$14000.00}, balance on it is {$290.00} as of XX/XX/XXXX. I have substantial limit remaining to be utilised. On XX/XX/XXXX, I contacted the customer service department of Capital One to inform them of a large purchase I was to make later that evening for the repair of my husband 's car which amounted upto {$6000.00}. I spoke to representative XXXX and was told that I do not require to inform Capital One of such purchases as I have no restriction on my account. Later that evening when I went to pick up the car from the auto shop, I tried to use my Capital One XXXX Credit card but was immediately declined. I then contacted the customer service department again and come to find out that they restricted my account with XXXX explanations or notifications. And the rep mentioned that it is being reviewed by a specialist and that I will not be able to use my card for 7-10 days or until the restriction is removed completely. I contacted them again and was connected to the fraud department, this time rep XXXX and XXXX repeated the same thing and refused to tell me the reason for this restriction on my account. They declined to help me and just asked me to wait to be contacted by Capital One directly after 7-10 business days. Due to this my husband and I have been placed in a difficult situation with no reliable transportation until this Bank reviews my account which was opened recently. I had a balance of {$590.00} as of XX/XX/XXXX, of which {$300.00} was paid same day. This payment was above the minimum payment of {$25.00} required. Capital One has failed to resolve this issue with a reasonable cause. I did not even attempt to utilize more than half of the credit limit, I informed them prior to making the purchase and I have no late payments, yet my card/account has been restricted or blocked from being used. Very disappointing and terrible experience. Will advise others to be very careful before banking with Capital One.

My credit monitoring software shows nothing. I even checked my states judicial website for a small claims issue that maybe Im unaware of and there is nothing. The information is false and when I called to request where they obtained that from so I could file a dispute two women said they did not have the information and there is no way to find out where the info came from. But one was able to check and she showed they have no knowledge of any pending legal case against me. So this is a false accusation and I want it removed promptly from my records.

I have recently reviewed my credit report and noticed that late payments have been recorded on my account for the months of XXXX, XXXX, and XX/XX/2023 on SOME not ALL reports. I would like the status updated to paid as agreed or okay. In light of this, I would like to draw your attention to Law 15 USC 1666b, which pertains to timing of payments ( a ) Time to make payments A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose, on consumers reports furnished to credit reporting agencies. According to the law transactions ( late payments ) are not to be on my consumer report. I understand the information reported is by choice and not required. Your company according law is violating my rights and breaking the law. I've communicated this information to you all twice now and in writing in the mail with no response.

Consumer Complaint: 15 U.S. Code 1691 ( a ) ( 3 ) states that it shall be unlawful for any creditor to discriminate against any applicant, with respect to any aspect of a credit transaction because the applicant has in good faith exercised any right under this chapter. This means the definitions and rules of construction set forth in this chapter are also applicable for the purposes of any subchapter within. 15 U.S. Code 1602 ( f ) defines the term " credit '' as the RIGHT granted by a creditor to a debtor to defer payment of a debt or to incur debt and defer payment. By denying my application, you have discriminated against my RIGHT of credit and have therefore become in violation of not only the Fair Credit Reporting Act but also the Equal Credit Opportunity act. ECOA makes it unlawful for any creditor to discriminate against any applicant, with respect to any aspect of a credit transaction, on the basis of race, color, religion, national origin, sex or marital status, age ( provided the applicant has the capacity to contract ), because all or part of the applicants income derives from any public assistance program, or because the applicant has in good faith exercised any right under the Consumer Credit Protection Act. Creditors must be able to provide applicants against whom adverse action is taken with an accurate statement of reasons. The statement of reasons must be specific and indicate the principal reason ( s ) for the adverse action. A creditor can not justify noncompliance with ECOA and Regulation Bs requirements based on the mere fact that the technology it employs to evaluate applications is too complicated or opaque to understand. Secondly in your denial letter you refer to information received on my credit report also known as a " consumer report. '' 15 U.S. Code 1681a clearly states that the term " consumer report '' does not include ; report containing information solely as to transactions or experiences between the consumer and the person making the report ; any authorization or approval of a specific extension of credit directly or indirectly by the issuer of a credit card or similar device ; any report in which a person who has been requested by a third party to make a specific extension of credit directly or indirectly to a consumer conveys his or her decision with respect to such request, if the third party advises the consumer of the name and address of the person to whom the request was made, and such person makes the disclosures to the consumer required under section 1681m of this title. Therefore I am also requesting the information you relied on, outside of the scope of what is considered information applicable to a consumer report according to 15 U.S. Code 1681a, to discriminate against me and my right to credit. I have included this information to show that not only have you discriminated against me according to the Fair Credit Reporting Act and Equal Credit Opportunity act, you have done so based on inaccurate information. I am asking that you cease your discrimination practices and extend me a line of credit for your Capital One Spark 1 % Credit Card..
