Consumer Complaint: XX/XX/2023, I noticed an ATM charge in the amount of {$180.00} that was charged to my debit card on XX/XX/2023 in XXXX XXXX, XXXX When the charge was made, I was in XXXX, XXXX. After returning to the XXXX, I called Capital One to file a fraud claim. Capital One provided a provisional credit, then sent an email on XX/XX/2023 stating the claim was denied due to the assertion about the debit card possession and transaction information and the credit would be removed on XX/XX/2023. After receiving the denial email, I called Capital One to assess the reasoning behind the denial and request documents with evidence used to research my claim. The agents I spoke with said the claim was denied because the card chip and pin were used. I let them know that I was not in XXXX XXXX at the time the charge was made, and I had my boarding pass as proof. I sent an email with my boarding pass on XX/XX/2023 to prove that I was not in XXXX XXXX. My flight went from XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX to XXXX XXXX ( XXXX ). Even though I provided my boarding passes as proof, Capital One still removed the provisional credit on XX/XX/2023. I called again that day to check whether my boarding pass was used to reopen the claim and inquire on why I had not received documents of their evidence. I resent my boarding pass and requested the documents once again. On XX/XX/2023, I received an email from Capital One card investigations with an attachment stating they were standing by the denial of my claim and provided a screenshot of an excel spreadsheet that was illegible.

Under the FCRA 15 USC 1681 section 602 states that I have the right to privacy as a consumer. 15 USC 1681 section 604A also states that a consumer reporting agency can not furnish an account without my consent or willing instructions. Furthermore, under 15 USC 1666B section A, a creditor may not treat a payment on a credit card under an open-end consumer credit plan as late for any purpose. Capital One - made reports of late payment about my open-end credit card account in the months of XXXX and XXXX for the year of XXXX ; in XXXX late payment reports were made for the months of XXXX, XXXX, XXXX, XXXX and XXXX.

THERE IS A BALANCE XXXX INTEREST WHICH I WILL NOT PAY. CAPITAL ONE SAID THEY MAILED MY STATEMENT 4 TIMES AND SHOW DELIVERED AT XXXX XXXX OR CLOSE EACH TIME. MY MAIL IS PUT IN A COMMUNITY MAIL BOX AT XXXX OR LATER EACH DAY BY POSTMAN. I CAN SEE MAYBE A POSTMAN MAKING 1 OR 2 MISTAKES BUT 4 ( FOUR ) IS BULL. I THINK THIS IS A SCAM BY CAPITAL ONE TO GET INTEREST FROM PEOPLE THAT PAY ON TIME AND DONT PAY THEM INTEREST. I HAVE A CREDIT SCORE BETWEEN XXXX AND ALWAYS FOR XXXX YEARS PAID ON TIME.
