Consumer Complaint: On XX/XX/XXXX I noticed overdraft in my Capital One Checking account. I called Capital One and they acknowledged that duplicate payment ( I did not set up ) was sent to my Capital One credit card. They refunded overdraft fees and told me to call the Credit Card to see why it was taken. Capital One Credit Card told me that it was the bank that sent the duplicate payment. I told them I would be making a big deposit soon and wanted to ensure they would not RETRY the duplicate payment. On Thursday, XX/XX/XXXX, I deposited money into my checking account and on Friday XX/XX/XXXX, the credit card company DID retry to take the duplicate payment and were now successful because there were sufficient funds. The money was deposited into my account because I have to pay other bills to pay. I called the credit card and bank on XX/XX/XXXX to have the duplicate payment refunded to my account. I was told that I can dispute the charge and an automatic provisional payment would be returned to my account. That did not happen. I was told it would be expedited because both banks are Capital One. Upon calling today, XX/XX/XXXX, I was told that there is no way to expedite this, and it would take 10 business days to return my duplicate payment. They also told me that someone on their side " made a mistake '' when filing the claim, which has reset the clock. Capital One is not returning the overpayment that they made in a timely fashion and now I can not pay the bills that are due. I have had to call them multiple times without any satisfaction.

After she realized she used the wrong account she called me and told me and told her credit card companys however they told her I needed to work it out with capital one 360. I opened several claims ( Claim # XXXX for account ending in XXXX ) and told capital one these were unauthorized charges and needed to be kicked back to her credit card companies. There were other claims open as well however the rep I spoke with couldnt find them. I come to find out today they capital on denied my claims and stated I capital one I gave them authorization which I didnt. They pulled they call and told me I was right however they wouldnt reopen my claims of unauthorized credit card payments

( 5 ) A computation error or similar error of an accounting nature of the creditor on a statement. As i know the creditor didnt notify me 21 days before with a statement so there should be no late payments on this accounts. I demand to see hard solid proof from the creditor bank account that i didnt pay and was marked late because this clearly a billing error. The items below should all be updated to paid as agreed on my consumer report. ( the missed payments are inaccurate ). As a consumer by law these accounts on this letter must be updated or deleted immediately or I will seek monetary compensation for violation of my rights in small claims court in my city and state under 15 USC 1681n civil liability because Ive been violated. Also, we already involved and sent this letter to the Complaint portal for ( Consumer Financial Protection Bureau, State Attorney Generals Office, Better Business Bureau, and Federal Trade Commission ). Consumer Complaint: This is my second claim reguarding this. Capital One responded to my first claim stating that XXXX needed to submit for the funds to be returned to them. After struggling with them to get them to do this they sent it over for the amount that was deposited of {$110000.00} and capital one denied it stating that there was insufficient funds. I have been trying to get this worked out with XXXX from capital one talk to her last week on Friday she let me know she would be returning to the office on Tuesday have tried multiple times to contact her and she will not return my call. I have provided Capital One with the document they were asking for yet they are still denying to release my funds back to XXXX capital one has held my funds for over two months now I need help getting them to do their job. I did get a quick response from the first claim I put in however they have not kept up there end And sent the money back as they requested per XXXX. I have contacted XXXX at least three times a day since Tuesday and have yet to hear a response I think waiting over two months is long enough and I feel like capital one is intentionally holding my funds.
