Consumer Complaint: This is my second time in this situation. On XXXX XXXX a payment to Capital One posted from my XXXX bank account. Capital Ones website states that payments made before XXXX will be posted same day and payments after XXXX will be next day. My mom made a payment on her account it went straight through and her available credit reflected the payment immediately. My payment is still pending. I contact Capital One which caused many contradictories. On one hand they say I can not get a refund for my payment because it has posted but they claim my available credit can not be released because of a review to verify my funds. I asked them to explain how a payment can post but not be cleared and they can not give any explanation besides they just do that sometimes. Thats unacceptable as Ive done nothing wrong to be placed under review for EVERY payment i make. Capital One also revoked ability to pay via debit card leaving you NO choice but to pay ACH but turn around and hold your money. As stated before the payment posted from my bank account on XX/XX/XXXX at XXXX. It is not in pending status. Capital One sent me email at XXXX same day indicating my payment was posted in their system as well.

Consumer Complaint: On XX/XX/2023, I placed an order for one piece of furniture with walmart.com. I used my XXXX sponsored Capital One credit card. For many years I have a perfect history of payments and have had no issues with unauthorized. Within a minute my order was cancelled. In an email, I was advised that the order was cancelled " because it was flagged by our credit and fraud team. '' No explanation was given, despite my online request for same. Furthermore, a " hold '' for " XXXX business days '' - XXXX weeks- was placed on my card by the " bank '' - obviously Capital One. These XXXX actions were apparently done not by a human person, but by an algorithm, since they were done in seconds, not enough time for a human to read or research or even compose the email message. Despite XXXX and Capital One never ever having contacted me about any issue of fraud throughout the many years of my account, Capital One is illegally suppressing my consumer rights.

Consumer Complaint: I was on vacation and I checked my email on XX/XX/23. There was a survey from Kohls saying if I filled it out I would get a XXXX XXXX XXXX set. I did and they said I had to pay {$5.00} shipping. I gave my Capital One credit card number. I received a text from Capital One asking if I had authorized it and I replied yes. Once I was home and checked on my computer I realized it was a scam. I then checked my credit card charges online on XX/XX/23 and see a pending charge of {$71.00}. I immediately called Capital One to cancel this but they would not. I said it was pending still but they refused because I had authorized a charge in the past and they would cancel the card and mail a new one. I told them I did not want a new one and to cancel my account. I don't know if it is related but now I can't send or receive personal emails, businesses still get through.

Consumer Complaint: I am complaining about Capital One Bank. I have a checking, savings and credit card account with them. In XXXX my checking account was debt XXXX. I inquired about this charged only to learn that the XXXX XXXX XXXX had taken this money out of my account without my permission. I filed a report with the bank and reported this as fraud. Capital One issued me a new card and refund my account. On XX/XX/21 they reverse the refund stating that their investigation with XXXX XXXX XXXX showed they had my IP #, address, and correct information to charge my card. I told them, I DID NOT GIVE THEM PERMISSION TO TAKE THIS MONEY OUT OF MY ACCOUNT, regardless of what they have. Do they not know that's how scammers operate! Regardless of what I said, the representative refused to honor my word the account holder. I told them this is my money, not Capital One and how dare they tell me someone has a right to take money out of my account without my approval. I don't care what their investigation revealed I DID NOT approve this charge. I asked to speak to a supervisor, and she repeated what the representative said, the company had the right information to validate me and the charge. I questioned them as to how are they protecting the consumer if they are allowing anyone who get my banking information illegally to go into my account take money which I did not approve. They had no answer for me. I am still fighting to get my money back. I also contacted XXXX XXXX XXXX and told them I will be reporting the fraud to the Better Business Bureau and the attorney 's XXXX XXXX as XXXX. I still want to hold Capital One accountable for their action and failure to protect customers. The money that customers deposit in their bank is the customer 's money and the bank has no right to determine whether a transaction should be paid after a customer reports fraud, regardless of the merchant 's possession of information. THIS SHOULD BE ADDRESSED WITH CAPITOL ONE THEY HAVE AN OBLIGATION to PROTECT CUSTOMERS!

XX/XX/XXXX of XXXX round XXXX I was on a Highway, Car enter into Limp mode, engine light start blinking and car didn't move more than XXXX, I almost cause a accident with a car behind of me... End up calling a a tow company to bring car home and contacted XXXX XXXX immediately the next morning and learn about this car have multiple Recalls but the most important is that XXXX have already a Lawsuit in place and Settlement due the fact this is going on and on, on a daily basis with XXXX XXXX and XXXX XXXX XXXX Here is the Link to the Settlement : XXXX XXXX XXXX Well I also immediately contacted Capital One Auto Finance and inform me about the situation and they stated their only concern is to get paid monthly for this car loan. After struggling for almost 2 weeks Finally XXXX XXXX XXXX in Fair Lawn XXXX XXXX took the car in on the XXXX of XX/XX/XXXX and few days Later they send a video diagnose of the car stating clearly the same problem of the XXXX settlement with this car and that the engine need to be replace immediately. I learn this can take weeks and or 2-3 months before they can replace this engine due the long wait for new engines for other cars with the same problem.. I have been renting a car out of my own pocket due the fact that XXXX XXXX doesn't have car for loaner and they stated that per the settlement only after the car is repair/engine change I can go ahead and summit the rent a car receipts for a reimbursement as well the tow reimburse. Consumer Complaint: Opened account with capital one bank on XX/XX/23. Capital one closed my account for suspicious activity. Ive been calling capital one for several months to release my funds. Ive uploaded an ID for verification. I spoke with XXXX ID # XXXX and he stated they dont have a time frame as to when my funds will be released. I have several credit cards and auto loan with capital one so Im not sure how my account is fraudulent. Its now XX/XX/XXXX and still no returned phone call from the XXXX that was left on XX/XX/23.

Consumer Complaint: I have not supplied proof under the doctrine of estoppel by silence, Engelhardt v. Gravens ( mo ) 281 SW 715,719, I presume that no proof of the alleged debt, nor therefore any such debt, in fact therefore exists. 15 U.S. Code $ 1681c-2 a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than 4 business days after the date of receipt. It has been 30 days and you are in VIOLATION of this law because I am a victim of identity theft!! Please delete these items IMMEDIATELY! These accounts should not be furnished on my consumer report as they are in VIOLATION!!! Under, 15 U.S Code 1681b - Permissible purposes of consumer reports ( a ) IN GENERAL Subject to subsection ( c ) any consumer reporting agency may furnish a consumer report under the following circumstances and no other : ( 2 ) In accordance with the WRITTEN INSTRUCTION of the consumer to whom it relates. I NEVER gave any consumer reporting agency WRITTEN CONSENT to report anything on my consumer report which violates my rights as a federal protected consumer. NO CONSENT IS IDENTITY THEFT.
