Consumer Complaint: I paid my last month 's statement ( XX/XX/2023 ) in full. Through the website there is an option to pay in full. Since I paid the statement in full the Automatic payment I had scheduled was offered to cancel and initiated by Capital One. However this left me with a shortfall, which triggered additional interest accrued on the next statement. I tried several times to resolve over the phone and the company refused to credit me. There website is deceptive and unfair and predatory.

Consumer Complaint: On XX/XX/2023, I made a purchase with merchant XXXX for {$2300.00} for a pair of sneakers. I received the item on XX/XX/2023, but it was not what I had ordered. I received a completely different brand of sneakers. A common scam in shoe marketplaces. After speaking with the merchant, I sent the shoes back via their company provided XXXX label on XX/XX/2023. Once the merchant verified that they received the item, the merchant offered me a choice between store credit OR a refund to my original payment method. I requested a refund to my original payment method, and shortly after, I received a confirmation email from the merchant that the refund was on the way. On XX/XX/2023, I was forced to open a claim with Captial One after not receiving my refund from the merchant, nor any further communication after multiple email attempts with the merchant. I provided the tracking number to Captial One and explained the situation. Captial One verified that the return was made. A very easy open and shut case. On XX/XX/2023, just three business days later, I received an email from Captial One stating that the claim was denied and closed, which was shocking. Captial One didnt even request any further information from me aside from our initial brief phone call. I called Captial One once again to attempt to understand what occurred. Captial One stated that the merchants Terms and Conditions state that there were no refunds, only store credit for returns. This is untrue. If Captial One researched this for themselves, the merchant has a Buyer Protection Policy which covers receiving an incorrect item AND within their Terms and Conditions, it states, If you would like a refund to your original payment method, please include the request when you contact support. I have the email conversation from the merchants support team where they stated that they would refund my original payment method. Once I received confirmation of the refund being processed from their agent, I received a confirmation email of the refund being processed to my original payment method shortly after. I will include evidence that before I even shipped the item back, the merchant guaranteed a refund to my original payment method. Captial One did not even request any further information from me. The case was closed within three business days, which shows a lack of consideration for their bank clients. Captial One is understaffed, which is obvious by the 20 minute wait times when calling in, and they were more concerned with closing my case than actually spending time to gather information from me to review it. I was scammed out of {$2300.00} and received no help from Captial One.

Consumer Complaint: I was advised via us mail that my 2 accounts with Capital one was closed due to activity that was against their standards. I've been basically unemployed for the summertime and was struggling with a part time school position with reduced hours and wages. My last paycheck for the summertime hours was only {$140.00}. Capital One was still trying to get payments out of my checking account and it wasn't consistent with my paydays. I believe their actions may have been discriminatory in nature and geared towards people in the minority class and income level.

Consumer Complaint: My XXXX account was hacked on XX/XX/XXXX which I became aware of via ele electronic notification. A purchase of a bed for {$780.00} was charged to my Capital One credit card on file and being delivered to my address on file. I did not make this XXXX order, it was fraud. I couldn't get the shipment stopped through XXXX or XXXX and the bed was delivered to my home on XX/XX/. I completed dispute process with Capital One and informed them that I had the bed at my address. They provided a provisional credit and upon investigating, determined insufficient evidence of fraud since I had the disputed item in my possession at my address on file and I would have to handle this myself with XXXX. Between all my conversations with XXXX, XXXX, and Capital One, I was waiting for someone to make the attempt to pick up this box and return it to XXXX, but wasn't hearing anything. I have been trying to resolve this with XXXX from XX/XX/XXXX XXXX XX/XX/XXXX and still don't have a refund! I followed the instructions on the back of my Capital statement : Your Rights If You Are Dissatisfied With You Purchase and mailed a Certified Letter to the address provided. I have a receipt from XXXX that it was signed for and haven't heard a word from Capital One regarding receipt of this or if they assist further. I am attaching all detailed conversations.

This complaint is going over some of the violations and pointing out the laws that where broken. In USC Title 31 Section 3123 States that '' The Us Government has an obligation to pay 'dollar for dollar ' principal and interest in legal tender ALL DEBTS accrued by the American People '' ( which I Am an American Citizen ) My Social Security belongs to the SSA and any transaction in regards with my social security pays for whatever it is being used for which clearly it was used in the attach documents below stated in TRUTH IN LENDING 15 USC 1601. BEST XXXX XXXX XXXXCAPITAL ONE falsely misrepresented in stating that they are the Seller-Creditor. 15 USC 1602 TRUTH IN LENDING Definitions and rules of construction states " A Creditor refers only to A PERSON who both ( 1 ) regularly extends, whether in connection with loans, sales of property or services, or otherwise, consumer credit which is payable by agreement in more than four installments or for which the payment of a finance charge is or may be required ( which in this case was Me, I was the one who extended the credit. I ask Capital one to send a validation of debt breaking down all fees and charges. They didnt send the Finance Charge breakdown. Also XXXX XXXX XXXX XXXX CAPITAL ONE never disclose to me MY RIGHTS OF RESCISSION ( 15 U.S. Code 1635a ) which is a violation of Truth in Lending, this makes them criminally liable for willingly holding out this information and civil liable which is double the FINANCE CHARGE ( {$8000.00} ). ALSO within the first letter i sent i ask to cease all contact and for them to stop reporting to the credit bureaus until all matters are handle and they have not yet accept my wishes i still get calls text messages which is harassment and consider a civil violation as well under 15 USC 1692D!

I took a taxi to a nearby hotel ( XXXX XXXX XXXX XXXX ) in XXXX XXXX of XXXX and agreed on a XXXX peruvian Sol ( USD {$13.00} ) fare with the driver which is a standard fare rate. The driver took my credit card info to pay and charged me XXXX peruvian Sol ( USD {$130.00} ) without my permission. The driver committed fraud by not showing me the amount and forging my signature. I never agreed to the amount or payment and I was not provided a receipt when I asked for it. The driver was confrontational and rude so I did not feel comfortable escalating the situation in the moment. I was a victim of credit card fraud.
