Consumer Complaint: I deposited my check from an an account closure check I received from XXXX after contacting the Consumer finance protection Bureau to my capital one savings account and a few days after i received money back from a reversal from when I got hacked. They froze my account and told me to call them. I asked them to verify my funds and they told me theyre closing my account and that they will issue my balance basically whenever they feel like it. This feels like abuse now. Something does not feel right and Im going to find out. This feels extremely discriminatory especially with who I was speaking to on the phone. Now I have to wait for my money another month because of this

Consumer Complaint: Last month I used XXXX XXXX at Capital One to pay my XXXX XXXX XXXX. The total I wanted to pay was {$210000.00}. This was a payment for my husband and my retirement trip. I could not make it in XXXX lump some. I paid XXXX to be delivered by XXXX XXXXXXXX XXXX XXXX by XXXX XXXX, and XXXX by XXXX XXXX XXXX. The XXXX was taken out on XXXX and delivered to XXXX XXXX by XXXX. XXXX XXXX confirmed this. XXXX was taken out on the the XXXX and XXXX and said delivered on the XXXX and XXXX. XXXX XXXX did not get this payment. When I called Capital One they said because of the weekend and XXXX XXXX XXXX it was probably running a little late. I did not understand this. Yesterday I went into Capital One and was told that XXXX XXXX XXXX have these payments. When they checked further they found it was a paper check that was sent by mail and would take 4 to 5 business days. It told them that is not what I was told or how the other payment of XXXX was done. When they call to get a negotiation of funds letter that person told them it might take 7 to 10 days to get he funds. I transferred the money to them back in XXXX and allowed 7 to 10 days for it to clear. They had it cleared and sent. The bank person at the XXXX XXXX in XXXX XXXX - XXXX told me they would pay up to {$100.00} if it was a problem with them. My fees will be a lot more than that with XXXX XXXX. I feel that I have been misled and they are using my money incorrectly. If I had wanted to put my check in the mail I would have done that. Since I have had checks stolen from the mail I do not do that. If I send anything I use XXXX XXXX so it can be traced and I do it overnight. There is no reason Capital One should do this and their employees didn't know what was going on. If I stop payment on the check that will take at least 3 days and my bill will be delinquent.

Upon shuffling through my emails, I explained I did not receive an email. The associate then stated to check my spam account, I checked there as well and no emails from capital one were found regarding the data breach class action lawsuit. I then asked how can I continue or go about submitting a claim since I was not properly notified by capital one and was told this was closed as of last year and was nothing they can do.

Consumer Complaint: I noticed an account on my credit reports from a company called CAPITAL ONE that I had no business relationship with. CAPITAL ONE was attempting to collect on a an alleged debt in the amount of {$940.00}. I have had my identity stolen and sent CAPITAL ONE a letter via certified mail XXXX, XXXX notifying them about this fraudulent account including a copy of my Identity Theft report asking them to please delete the fraudulent account from my credit reports. I also disputed this fraudulent CAPITAL ONE account with the credit bureaus. CAPITAL ONE however continued reporting this fraudulent CAPITAL ONE account with the credit bureaus. I noticed CAPITAL ONE still reporting this fraudulent CAPITAL ONE account with the credit bureaus after I notified them about the identity theft. I then sent CAPITAL ONE a DEBT VALIDATION LETTER via certified mail XXXX, XXXX requesting the agreement between CAPITAL ONE and myself and the original application for the account. CAPITAL ONE violated the XXXX XXXX XXXX. XXXX ( XXXX ) by failing to provide the evidence requested after being notified about the identity theft. XXXX XXXX XXXX. XXXX ( XXXX ) states .... a business entity that has provided credit to, provided for consideration products, goods, or services to, accepted payment from, or otherwise entered into a commercial transaction for consideration with, a person who has allegedly made unauthorized use of the means of identification of the victim, shall provide a copy of application and business transaction records in the control of the business entity, Pursuant to the XXXX XXXX XXXX. XXXX ( XXXX ) CAPITAL ONE was required to cease collection efforts until the alleged debt was validated but failed to do so. CAPITAL ONE continued reporting the alleged debt to the credit bureaus in its attempts to collect on the alleged debt thereby violating the XXXX XXXXXXXX XXXX. XXXX ( XXXX ). I saw the fraudulent CAPITAL ONE account XX/XX/2023 on my credit reports. I then sent CAPITAL ONE a FAILURE TO RESPOND letter via mail XX/XX/2023. CAPITAL ONE violated the XXXX XXXXXXXX XXXX. XXXX ( XXXX ) In its attempt to collect on an alleged debt by falsely representing the character, amount, or legal status of any debt. CAPITAL ONE violated the XXXX XXXX XXXX. XXXX In their attempts to collect on the alleged debt by collecting an amount that was not expressly authorized by an agreement creating the debt or permitted by law. CAPITAL ONE violated the XXXX XXXXXXXX XXXX. XXXX ( b ) by not ceasing collection efforts until the debt was validated. Case law is well settled that reporting an alleged debt to the credit reporting agencies is " an attempt to collect on a debt ''. Pursuant to the XXXX XXXX XXXX. XXXX ( XXXX ) CAPITAL ONE was required to cease collection efforts until the alleged debt was validated but failed to do so. CAPITAL ONE continued reporting the alleged debt to the credit bureaus in its attempts to collect on the alleged debt thereby violating the XXXX XXXX XXXX. XXXX ( XXXX ). Additionally, CAPITAL ONE FAILED TO RESPOND to the DEBT VALIDATION LETTER within XXXX days causing me to send a CAPITAL ONE letter via certified mail XX/XX/2023. CAPITAL ONE violated the XXXX XXXXXXXX XXXX. XXXX by not validating the alleged debt within XXXX days. I saw the fraudulent CAPITAL ONE account XX/XX/2023 on my credit reports and it is still there as of this filing.

Consumer Complaint: I was a victim of fraud and Capital One Fraud department charged back fraudulent charges while ignoring my request to send proof that they had deemed my or an authorized user responsible for these charges ( I had no authorized users to be clear ). Additionally, the declined to re-open my investigation. When asked if it was the policy or Capital One to see their users as legally responsible for fraudulent charges, they skirted around this saying, Well, our investigator closed the case. In my request for the name or employee number of the investigator, I was not given any requested information ( again ). Several times I requested another supervisor and was denied. Now, I have a payment due for charges I never made and have to ding my perfect credit or pay balances Im not responsible for. I will be filing a complaint with the CFPB, FTC, and any further legal action necessary. DO NOT OPEN AN ACCOUNT WITH THESE CRIMINALS! The woman I spoke with was XXXX, empl # : XXXX. The end result was nobody wanted to provide merchants, delivery information, who was responsible for the decisions made, refusal to re-open investigation and many other failures to supply consumer information.
