Issue: Improper use of your report
Subissue: Reporting company used your report improperly
Consumer Complaint: I am writing to file a formal complaint against Capital One, a financial institution subject to the Gramm-Leach-Bliley Act ( GLBA ), for their failure to comply with my GLBA opt-out request. OnXXXX-XXXX, I sent a written request to Capital One, exercising my legal right under the GLBA to opt out of the sharing of my nonpublic personal information with credit reporting agencies. This request was submitted in accordance with the GLBA regulations and guidelines. Despite the clear and lawful nature of my request, I have yet to receive any acknowledgment, confirmation, or response from Capital One. Their lack of communication has caused me significant frustration and concern regarding the privacy of my financial information. I have attached a copy of my initial opt-out request, which includes all the necessary information required by the GLBA, to this complaint for your reference. I believe that Capital One 's non-compliance with the GLBA poses a serious violation of my consumer rights and privacy, and I kindly request the intervention of the Consumer Financial Protection Bureau to investigate this matter. I request that the CFPB conducts a thorough investigation into the non-compliance of Capital One with GLBA regulations and takes appropriate action to ensure that they promptly acknowledge and process my opt-out request. Furthermore, I request that [ Creditor Name ] be held accountable for their failure to adhere to GLBA guidelines and that they are made aware of the potential legal consequences of their non-compliance. Please consider this complaint as a formal request for investigation. I appreciate your attention to this matter and your dedication to ensuring consumer protection and privacy. I trust that the Consumer Financial Protection Bureau will take the necessary steps to address this issue promptly and effectively. Thank you for your assistance in resolving this matter.

Consumer Complaint: In XXXX XXXX XXXX my checking account was used without my knowledge to make unauthorized fraudulent charges. These were in various similar amounts all around XXXX XXXX each. I called immediately and filed a claim. I was out of town and my phone was missing/not in my possession during this time and I believe that's how the fraudulent charges were made. This was described by me to CapitalOne. The representative failed to note one of the charges in the claim even though I mentioned them all. I had to call back later once I discovered this to correct their error. I provided all documentation requested. Months later I get a decision saying that about half the charges were approved, and half were denied. This made no sense to me as they were all similar amounts from the same vendor during the same time period. These should all be approved or denied equally! If one is fraudulent, they all are! Seeing as this made no sense, I requested documentation used to make their decision. They provided me documentation that said since 1 charge wasn't claimed fraudulent, that some of the charges were considered legit ( the 1 charge that the capital one representative failed to note which I had to call back and correct!!! ) This was an error on capitalone! I still have not received my money for these fraudulent charges. I was assured multiple times by multiple agents that I would get this money back. I have provided all documentation requested. THEY MADE AN ERROR, AND I WAS PUNISHED FOR IT!

Issue: Incorrect information on your report
Subissue: Account information incorrect
Consumer Complaint: On XX/XX/XXXX Capital One arbitrarily reported a balance of {$630.00} to the credit bureaus adversely impacting my credit score. The information reported is incorrect based on the following factors. Last and Previous Statement balance was {$0.00}. {$630.00} will not show as an amount due anywhere at any time. The report was made on XX/XX/XXXX although the statement cycle is the XXXX through the XXXX. On XX/XX/XXXX I called Capital One as my disputes with the credit bureaus did not result in the deletion of the incorrectly reported item as Capital One responded to the agencies that this information was correctly reported. I was informed that I needed to send written correspondence to Capital One in order to dispute the incorrectly reported item with them. On XX/XX/XXXX Capital One responded electronically ( although customers are not able to correspond with them any way other than writing a MAILING in a letter ) indicating that they will revise the incorrectly reported amount to another arbitrary amount of {$9.00}. How can Capital One not delete the incorrectly reported item, but revise it to another incorrect amount. The {$9.00} amount is likely based off of the XX/XX/XXXX statement that has NOTHING to do with the incorrectly reported amount on XX/XX/XXXX. I called again today XX/XX/XXXX and was told that I would need to write another letter to dispute the dispute results and try to explain in better detail. I chose instead to reach out to the CFPB as I have already done my due diligence and provided documentation to bring this error to Capital Ones as well as all three credit bureaus attention and provided visual aids on why the information was incorrect. Capital One is reporting random amounts instead of statement balances that may be a violation of Fair Credit Reporting as per Capital Ones call center rep they should only be reporting what is on the statement. What is to prevent this from happening again? Why do customers have to mail in correspondence, but they can respond electronically?

Issue: Problem when making payments
Subissue: Problem during payment process
Consumer Complaint: I have XXXX credit cards that had the ability to pay the balance using a debit card from my bank. I have paid the full statement balance, on-time, every month. XXXX ( XX/XX/2023 ), I opened the app to make a payment that is due on XX/XX/2023, and the option to make a payment using a debit card is gone and the only option is to link your bank account and routing number. No communication from Capital One that this was going to happen and it affects my ability to honor the agreement we had. I understand they have a right to change terms but proper communication is expected. When I talked with Customer Service, no options or explanations were given.

Consumer Complaint: Capital One Bank in XXXX, Tx allowed 4 unauthorized checks totaling {$19000.00} to be mailed out in checks to fake people names across the country. The checks were XXXX and XXXX. I notified them immediately when I noticed this and they stopped some, but the four checks above got through and they said I was liable. These checks got through even after I had informed them of all the fraud going on in my account. I kept calling them asking why are they continuing to mail new checks out for these large and unusual amounts to people I have never heard of. They had no answer. They also never informed me once by text, email nor phone to see if these large and unusual payments were legitimate. I am also on XXXX and can not afford this loss.

Consumer Complaint: The existence of a derogatory rating on my account is causing me significant concern. I am deeply worried about its potential impact on my credit. It has already resulted in the denial of a recent loan application and an increase in the interest rates on my existing credit accounts. I want to emphasize the severe financial and emotional distress that this negative rating has caused me and will continue to cause until it is resolved.
