Consumer Complaint: XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Capital One XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX XXXX XXXXXXXX ( XXXX ) XXXX Request Exchange on Debts Due to XXXX XXXXXXXX To Whim It May Concern : I have been dealing with XXXX XXXX since XXXX. XXXX XXXX XXXX XXXX XXXX XXXX, and I am XXXX XXXX XXXX There is simply no way I could keep a job and support a credit history. So, I respectfully ask that your institution write off permanently the credit card debt that charged off in XXXX XXXX XXXX XXXX As you know, in past few years, the citizens of the United States suffered through a deadly pandemic the likes of which our nation has not seen in over one hundred years. Crippling fear and an abundance of caution resulted in government-imposed shutdowns, curfews, and moratoriums, which prevented millions of Americans from working and conducting their business and pushed many thousands of businesses to fire their staff and, endured the indignity of having to close their doors for good. This devastated the economy, drained peoples savings, forced millions of consumers into insolvency, and destroyed their previously good credit ratings. In the post-pandemic, the country has not fared much better. Unable to find workers, a great many of the businesses that managed to cling on by the skin of their teeth and survive the nightmare that was COVID -19, found that perseverance and determination are not enough. Exhausted, demoralized, and out of options, they too had to shutter their businesses and experienced the heartbreak of financial ruin. Unsurprisingly, bankruptcy filings are near an all-time high. I would like to work out this matter without any costly litigation or unnecessary protracted court procedures. In lieu of any current long-term indebtedness, I am respectfully asking for a 1099-C Exchange that I believe will benefit all parties involved. This requested 1099-C Exchange will clear the business between the parties, allowing me a fresh start. Any debt that I owe is canceled, forgiven, or discharged, and in this way becomes taxable income to me. Your institution receives a true write-off for a debt that was likely previously deducted in your prior 10-Q SEC filings. A win-win! Please respond in written form only through the Consumer Financial Protection Bureau ( CFPB ), or directly to my email referenced above. Sincerely, XXXX XXXX XXXX XXXX

Issue: Fees or interest
Subissue: Problem with fees
Consumer Complaint: It seems that Capital One has found a way to extract exorbitant fees by unilaterally recategorizing a class of transactions as " cash advance '' transactions without notice or informed consent from the consumer. I have used my Capital One credit card for an automatic monthly transaction/payment with an online vendor, which I began charging to my credit card in XX/XX/XXXX. Since the inception of this transaction, there were no additional fees aside from the normal credit card interest for all transactions. Then, without notice or my informed consent, in XX/XX/XXXXXXXX Capital one began charging me a " Cash Advance Fee '' of {$10.00} per transaction plus a separate variable APR which is currently at 30.15 %. Since XXXX, I've been charged a {$10.00} fee plus the 30.15 % APR for a $ 56 monthly transaction. When I spoke to a Capital One rep, he explained that there was a " promotional offer '' that I accepted when my account opened that had expired in XX/XX/XXXX. Given that I've had this card since XXXX, it's hard for me to believe that I had opted in to a promotional offer that happened to expire after 18 years. When I spoke to the rep, I expressed my frustration with their practice, but he did not remove the fees. This seems like a sneaky and deceptive method of extracting exorbitant fees from consumers.

Issue: Closing your account
Subissue: Company closed your account
Consumer Complaint: I submitted 3 credit card payments for 3 different accounts. As I have done for years. The problem came about after the default setting on the credit card payment system automatically selects the first account listed on your list of accounts as a default account. If you forget to change the account selection or it doesn't register when you do change it, the payment comes out of the wrong account. I have been a Capitol One member since XXXX. I have had at least 5 credit cards with them all in good standing up until closed. Capitol One has a system that is tricky and if you don't make sure that all boxes have the correct selected info, an error can occur. When I made my payment for the month of XX/XX/XXXX. The payment was made under the wrong account. When I saw that the payment was made from the wrong account. I immediately called Capitol One and tried to get the payment cancelled. I was told once a payment is made that i could not cancel the payment. So I logged into my XXXX XXXX to transfer money into my account, I found out that my account had been closed for no apparent reason and I wasn't even notified. I have 6 accounts with XXXX and the account was closed without notification. i have filed a complaint with the OCC regarding XXXX and this matter and I am waiting for a response. In the meantime while I was out of the country for a week, Capitol One called this fraud and closed my accounts that were all in good standing. This is the second time I have had a problem with their faulty system. There are several accounts listed that I use to pay all my bills and the first one listed is the default account. The fact that this has negatively impacted my credit rating is absolutely ridiculous. I have paid my bills on time and yet because of an error on 1 account, which I called them about, Capitol One closed all 3 of my credit card accounts, which has negatively affected my credit rating. I will also be sending a letter to my congressman because this usually gets nothing done about the situation at hand!
