Consumer Complaint: Re : Cease and Desist Letter Pursuant to 15 USC Dear Capital One I am writing this letter to formally demand that you cease and desist from any further activities or actions that involve my name, signature, or personal information in connection with any contracts or agreements, in accordance with 15 USC, Title 15, Chapter 41, Subchapter I - Consumer Credit Protection. I am exercising my rights under 15 USC 1602, which defines my Social Security Number as the source of credit used in transactions, thereby making it the basis for any financial agreements entered into. It has come to my attention that my signature has been utilized without my knowledge or consent in various contracts and agreements. Furthermore, I have reason to believe that these actions are related to unauthorized use of a credit card, which is prohibited by 15 USC. This serves as formal notice that I am rescinding my signature from all contracts associated with these fraudulent activities. I would like to emphasize that under 15 USC, the credit card referenced is intended for personal use and is not associated with any credit lending or loaning activities. Any representations made to the contrary are inaccurate and, as such, violate my rights and protections under federal law. I hereby request that you : 1. Cease any further use of my signature, personal information, or Social Security Number in any contracts, agreements, or transactions. 2. Immediately provide me with any and all documentation, records, or evidence related to the contracts or agreements in question. 3. Confirm in writing, within 10 days of receiving this letter, that you have ceased the unauthorized use of my personal information and have taken appropriate steps to remedy this situation. 4. Return to me all monies paid into or reported on my credit report under 15 U.S. Code 1635 ( b ) within the 20 days specified by law. Failure to comply with this cease and desist letter will leave me with no option but to pursue legal remedies available to me under the law, including but not limited to seeking injunctive relief and damages. This letter is not intended to be a complete or exhaustive statement of my rights, remedies, claims, or defenses. I expressly reserve all rights and remedies available to me under the law. I expect your immediate attention to this matter. Please consider this letter as a final opportunity to resolve this issue amicably and without further legal action. If I do not receive a satisfactory response within the stipulated time frame, I will have no choice but to seek legal redress in accordance with applicable laws and regulations. Sincerely, All Rights reserved XXXX XXXX XXXX estate Signature on file

Issue: Managing an account
Subissue: Banking errors
Consumer Complaint: I have been banking with ING direct for a long time to get best interest for saving account. ING direct have given us interest as promised never tricked. In XX/XX/XXXX, Capital one bought ING direct and converted our accounts to Capital One 360. They have been managing same way till XXXX. We got under the impression that they are doing the same as ING direct. In XXXX all of sudden they created another type of saving account ( 360 performance ) for better interest and brought down interest on this account without any information. We always thought what ever account we have is giving the best interest they are showing on their website. Only this year we realized that our account type is giving lowest saving interest. for the last 3 years we received lowest interest possible. We believe they purposeful did this trick by not informing. ING direct always very straight forward and maintain only one type of saving account. Capital One never bothered to inform when they introduced new type saving account. Like us lots of customers would have lost interest because of this trick. I have lost lots of money because of this trick by capital one. Can you please help us resolve this issue. Please let us know if you need any details to prove this Thank you

Issue: Improper use of your report
Subissue: Credit inquiries on your report that you don't recognize
Consumer Complaint: Hello I am coming here today to let it be known that I went sent to capital one a letter notice via certified mail to let them know that they are permitting an unauthorized inquiry on my XXXX credit report. There is an inquiry on my XXXX report which is connected to an existing account that I have with capital one so I do not want that to be affected but there is an inquiry on my XXXX report dated XX/XX/2023 that is not connected to any accounts and that I wish to get wiped off of the report. I already sent capital one a letter of notice and demand for settlement concerning this situation and I wanted the CFPB to be aware of this so they can be alongside me through this journey just in case. Below I have attached the exact same letter I sent to Capital One via certified mail. The tracking number to the certified mail letter is XXXX

Issue: Advertising and marketing, including promotional offers
Subissue: Didn't receive advertised or promotional terms
Consumer Complaint: This is a follow up complaint to the initial complaint # XXXX. As a response to that complaint, Capital One was supposed to issue a {$100.00} credit. However, that has still not happened. Capital One is continuing their dishonesty about the resolution. They credited XXXX miles to my rewards account claiming the XXXX miles have a value of {$100.00}. That is BLATANTLY incorrect and dishonest! The value of of XXXX miles according their own redemption website is ONLY {$5.00} and NOT {$100.00} as they claim. Please see attached screenshot where I am trying to redeem XXXX miles for statement credit. They are calculating that as {$0.00}. If XXXX miles equal to {$0.00}, by simple math XXXX miles have a value of only {$5.00}. Please see attached screenshot and their letter. In order to credit my account by {$100.00}, the reward miles need to be XXXX and NOT XXXX. They have only credited {$5.00} and not {$100.00} per their letter.
