Consumer Complaint: On XX/XX/XXXX, I called into Capital One call center to file a dispute for a charge of XXXX for a service I did not receive back in XX/XX/XXXX for car repairs. I spoke with a representative about this matter, and I inquired if it was too far out to dispute a charge like this, and she informed me that she will process the dispute and that everything should be approved. I received a credit to my account on XX/XX/XXXX for the XXXX. Several weeks went by and I thought everything was fine until I received a notification on XX/XX/XXXX that my dispute was denied due to the time that has passed and that I technically only had 60 days to dispute a charge. I called back in on XX/XX/XXXX and immediately asked for a supervisor, but was told all I had to do was send in documents so the dispute team can review these documents. I sent them in, and didn't receive a notification that they where received. I called back in for the XXXX time to Capital One call center, and asked for a manager. I was then told by the manager that there was nothing she could do and that they are not responsible for the outcome. I was told by the manager that I actually had 180 days to submit a dispute, so I kept getting different answers from different sources.

Consumer Complaint: I looked at a Capital One Venture credit card. I didn't like the APR, and I never arrived at the approval screen. Thus I was surprised to see that the card had been shipped to me without my consent. When I called to ask about this, the agent asked me to " admit '' that I had opened the card. I told her I never saw a button to give my consent. I asked her to close the account, which I told her I particularly wanted to do given the rude way in which she treated me as if I had done something wrong or was on trial. I am concerned that this experience will affect my very good credit score. The CapitalOne Venture card site is very misleading, even for well-informed customers like me.

In which was the total amount of credit provided ( disclosed in the FEDERAL TRUTH-IN-LENDING DISCLOSURES ), XXXX XXXX XXXX behalf as I am the natural person who has actual, implied, and apparent authority to use my consumer credit card. As defined in 15 U.S.C. 1602 ( i ) The term " credit card '' means any card, plate, coupon book, or other credit device existing for the purpose of obtaining money, property, labor, or services on credit. I used my social security card as the credit device existing for the purpose of obtaining my property on credit : XXXX XXXX XXXX XXXX Furthermore not only did a credit transaction occur but I also transferred Capital One Auto Finance XXXX Inc. a receivable as RETAIL INSTALLMENT SLAE CONTRACT-SIMPLE FINANCE CHARGE ( WITH ARBITRATION PROVISION ) is a security itself. Receivables are motor vehicle retail installment sale contracts that are secured by new and used automobiles, light-duty trucks, SUVs and vans. As Capital One Auto Finance, Inc. ( " COAF '' ) was previously a wholly-owned subsidiary of CONA ( `` CAPITAL ONE NATIONAL ASSOCTICATION '' ). CONA, operating through its Capital One Auto Finance division and in its capacity as the " servicer, '' will service the receivables held by the issuing entity. ( " Capital One Prime Auto Receivables Trust '' ) CONA has participated in the structuring of the transaction ( securitization of the receivables ) described in the Capital One Prime Auto Receivables Trust prospectus and has originated the receivables to be assigned to the issuing entity. CONA is responsible for servicing the receivables. Making the amount of {$13000.00} a billing error as such amount was never properly credited to my account. Pursuant to 12 C.F.R. 1026.13 ( a ) ( 1 ) A reflection on or with a periodic statement of an extension of credit that is not made to the consumer or to a person who has actual, implied, or apparent authority to use the consumer 's credit card or open-end credit plan. As I never got credited the amount on any billing statement since the opening of this account in which would fulfill the total amount that was ever owed for my property. Making such attempts to damage my credit and myself in violation of 18 U.S.C. 892 ( a ) - ( b ) ( 1 ) : ( a ) Whoever makes any extortionate extension of credit, or conspires to do so, shall be fined under this title or imprisoned not more than 20 years, or both. ( b ) In any prosecution under this section, if it is shown that all of the following factors were present in connection with the extension of credit in question, there is prima facie evidence that the extension of credit was extortionate, but this subsection is nonexclusive and in no way limits the effect or applicability of subsection ( a ) : ( 1 ) The repayment of the extension of credit, or the performance of any promise given in consideration thereof, would be unenforceable, through civil judicial processes against the debtor ( A ) in the jurisdiction within which the debtor, if a natural person, resided or ( B ) in every jurisdiction within which the debtor, if other than a natural person, was incorporated or qualified to do business at the time the extension of credit was made. Consumer Complaint: Capital One offered a {$350.00} new account bonus ( Promo code XXXX ) when certain conditions met ( direct deposits, etc. ). The prior deadline bonus eligibility for applying/opening an account was shortened to XX/XX/XXXX I applied and finished everything at XXXX PDT XXXX, but was told they need to process a few more things before opening. Received an email XXXX PDT saying " The application you submitted for a new Capital One 360 account, which was in a pending state for review, has been cleared. This means you can now proceed with your application. '' Saw this email about XXXX same day. Proceeded with application, which was regarding account funding ; prior to submitting I noticed that it said " The promotion code has expired ''. I immediately called customer service ( XXXX PDT ) and spoke with Nat XXXX After verifications were done, he said to go ahead and submit the funding and that Capital One could fix the timing issue regarding the {$350.00} bonus. I followed his instructions, opened the account, but it came back again saying " promo code expired ''. XXXX put me on hold XXXX PDT to call specialists, he came back XXXX PDT to say sorry they can't apply the promo code as application not finished until today ( after expiration ). I was misled by agents at Capital One, it's not my fault they couldn't finish the application in time. I definitely started the application and performed all necessary tasks in order to open the account prior to the bonus expiration deadline.
