Under 15 USC 1666B a creditor may not treat a payment on credit card account under an open consumer credit event as late for any purpose.

Consumer Complaint: I contacted Walmart Capital One and asked for temporary assistance with my bill. I have never been late once and since the account was opened years ago. I had a medical problem went into the hospital ( have proof Drs note hospital etc. ) I missed one payment and I called as soon as I got out of the hospital with my mother as I was still weak and needed her help. We were told there was nothing I was eligible and had to make the minimum payment off {$490.00} by the next due date XXXX I was shocked and hurt t the same time and stated I would be filing a complaint to let someone in Corporate know what was going on if they did not know. And to let other consumers know that after missing one payment Capital One would not work with me or credit any late fees. This is truly a punch in the gut to me because I am still not back to work and I can not believe Capital One Walmart has no option to help me on a temporary level. I would like to speak to someone at the Corporate level regarding my concern as this could happen to anyone if they are not rich and get hospitalized.

Consumer Complaint: At XXXX checked my email, received emails from capital one saying I was approved for a Platinum credit card for the amount of {$500.00} and 30 % interest. Another email from capital one saying I had a change on my credit report. I had previously had an account with Capital one, that has been closed for years now. Capital one sends emails when anything on my credit changes. I also had an email from XXXX saying there has been a hard inquiry to my credit. I called capital one and was transferred to the fraud department. Verified information with the representative and she said everything was correct except my phone number. She said she couldnt disclose what phone number was used. She let me know they will do an investigation to see if the inquiry was fraudulent.

Consumer Complaint: Yesterday, on XX/XX/2023, Capital One Platinum emailed me a dispute update letter stating a merchant ( XXXX XXXX XXXX XXXX ) responded to my credit card dispute of a {$250.00} unauthorized charge to my credit card weekend of XX/XX/2023. Merchant erroneously claims I stayed for XXXX nights at its hotel. In contrast, I only stayed XXXX night where they properly charged {$190.00} to my credit card. Inexplicably, merchant charged each night in 2 separate credit card transactions. Merchant ignored my telephone messages so I filed a formal dispute with Capital One Platinum. The Merchant 's dispute response to Capital One was deficient, lacked explanation and completely ignored my formal request for merchant 's electronically stored information related to my hotel room key which will provide I only stayed for one night instead if two nights. Merchant supplied no documents to prove this, documents with my signature to validate the {$250.00} charge, or the requested documents about the exact dates and times of my check in/out. Capital One 's dispute update letter sets forth the next steps in the dispute resolution process for me to upload rebuttal documents on its secured website for the dispute team to review. After speaking by telephone with a Capital One customer care representative yesterday morning who urged me to submit my rebuttal the same day, I uploaded my rebuttal documents yesterday afternoon. Yesterday evening, I called Capital One again who confirmed my rebuttal records were received and would be reviewed within the next few days. But, this morning, my Capital One online account indicates the dispute is closed without further explanation and the unauthorized {$250.00} charge was placed back on my account. As discussed in my attachments, Capital One 's actions violated its own internal dispute resolution written policies, its written customer fraud protection policy and everything its two employees said to me in two separate phone calls yesterday.

Loss of housing opportunities : The inaccuracies on my credit report have resulted in the denial of housing opportunities, depriving me of suitable housing options. This violation of my rights under the FCRA has caused financial hardship, emotional distress, and mental anguish. 2. Emotional stress and mental anguish : The ongoing struggle to rectify the inaccuracies on my credit report, despite my diligent efforts, has caused substantial emotional stress and mental anguish, infringing upon my rights under the FCRA. Therefore, I implore you to fulfill your obligations under the FCRA and take immediate and appropriate action to rectify this situation. I kindly request that you : 1. Conduct a thorough investigation into the accounts listed above and their association with my identity, in accordance with the FCRA. 2. Remove all fraudulent and incorrect accounts from my credit report, as mandated by the FCRA. 3. Update my credit report to reflect accurate and updated information, in compliance with the FCRA. 4. Provide me with written confirmation of the actions taken to resolve this matter, as required by the FCRA. Please be advised that the damages caused by these inaccuracies extend beyond mere financial losses. Under the FCRA, I am entitled to fair compensation for the harm I have endured as a result of these errors, including financial losses, mental stress, and mental anguish. Consumer Complaint: I have a XXXX card issued by Capital One. My Capital One statement shows a charge for {$190.00} on XXXX XX/XX/2023 from a merchant called XXXX XXXX XXXX XXXX. I did not authorize this charge. I tried to contact the merchant directly twice to dispute the charge but the merchant did not respond. Then I contacted Capital One to dispute the charge. On XXXX XX/XX/2023 Capital One sent me a letter in which it acknowledged that it I had disputed the charge and that it was looking into the matter. On XXXX XX/XX/2023 Capital One sent me a second letter in which it said that it had rejected my dispute because the merchant told Capital One that " goods were as described and in good condition. '' I then called Capital One and spoke to agent. I told the agent that I was disputing the charge not because I did not receive the goods from the merchant but rather because I never authorized the charge to begin with. I pointed out to the agent that when I filed my dispute I had told Capital One as much. The agent then asked if I had proof that I had tried to contact the merchant. I told the agent I had a copy of an email I sent to the merchant on XXXX XX/XX/2023 disputing the charge, so the Capital One agent sent me a link to upload that document which I did. On XXXX XX/XX/2023 Capital One sent me another letter in which it said that I did not provide Capital One with the " previously requested information '' and that as a result, Capital One was closing my dispute and that I would have to pay the {$190.00}. To summarize, a merchant charged me {$190.00} with my authorization, Capital One has no proof that I authorized the charge and is instead claiming that according to the merchant I received services, and finally Capital One is claiming I didnt provide it with documents which I did in fact provide and so it is sticking me with a fraudulent charge.

Instead of Capital One providinng me the opportunity to rectify the account ; it was sold to XXXX XXXX XXXX. I established a verbal agreement, along with email verification that an agreed upon payment plan with rectify the outstanding balance in ( 4 ) payments of {$60.00}. We also agreed that the account would be deleted from my credit report as well as satisfactory reporting to XXXX, XXXX and XXXX. With that being said, both accounts are being reported as collections to the ( XXXX ) credit reporting bureaus listed above. Per the Fair Credit Reporting Act 611.
