Consumer Complaint: My checking account with Capital One was closed without any notice to me at the end of XX/XX/2023. When I contacted Capital One early XX/XX/2023, I was told by a manager that my account was in violation of their terms. The manager would not explain to me what the violation ( XXXX ) were. I am XXXX and had set up my XXXX XXXX to be deposited directly into the Capital One checking account. The last such deposit was made into my Capital One Checking Account was for XX/XX/2023 XXXX XXXX XXXXXXXX Income. Since they closed my account, I have not had access to any of my money from my XXXX payments. Capital One is holding almost {$5000.00} from my XXXX deposits and has not returned them to me. This has prevented me from being able to by medically necessary medications and it prevented me from being able to pay rent resulting in ongoing financial devastation. Capital One employees have been beyond discourteous when speaking to me and very unhelpful. The only way I was told that I could obtain my funds was when they mailed me a check which would be in 45 days from the date the account was closed. 45 days from the date that the account was closed would have been XX/XX/2023. As of todays date, I have been lied to multiple times by Capital One telling me that theyd mailed a check to me beginning in XX/XX/2023. This was not true. After my second complaint to your agency for the same matter, a Capital One representative had delivered to me a cashiers check via XXXX on XX/XX/2023. I deposited the check and it bounced twice and I have incurred two {$24.00} returned check fees as a result of Capital One issuing me a bad check. I still have not received the monies that Capital One is holding from multiple XXXX deposits. I have suffered extreme and repeated financial and XXXX XXXX from Capital One representatives from them refusing to return my funds to me, lying about checks being mailed, and gaslighting me by trying to tell me that they werent responsible for the check being returned when they knew or should have known that they were sending me a bad check. This is a FDIC regulated bank. All of these conversations have taken place over the phone and all have been recorded by Capital One. I believe that Capital One has violated State and Federal Laws by its actions towards me. Their actions have resulted in extreme undeserved harm towards me and are a violation of my rights under law. I am asking for assistance from your agency with this matter. IMPORTANT NOTE : I am a victim of XXXX XXXX and it is very important that I am safe. I take measures to achieve that to the best of my ability. I ask that your organization not publish my full name and any of my contact information to the public and/or identifying information. In order to resolve this matter Capital One should overnight a check in the equal to the amount of all funds plus the two {$24.00} returned check fees charged to me mmediately. They should also provide me with a detailed explanation of how I violated their terms because I do not believe that I did this.

Consumer Complaint: Late payment on your credit report is a privacy violation. In accordance to fair credit reporting act, XXXX XXXX XXXX, has violated my rights. Under 15 USC 1681 section 602 states I have the right to privacy. 15 USC 1681 section 604A section 2 it also states that a consumer reporting agency can not furnish an account without my written instructions. Under 15 USC 1666B, a creditor may not treat a payment on a credit card account under an open and consumer credit plan as late for any purpose.

Consumer Complaint: Reported fraud on the capital one account. They opened a fraud investigation but I never heard back from them. I followed up and they said the investigation deemed it was not fraud and they couldnt tell me why. I requested for them to open another fraud investigation. During a follow up call, they suggested I change the email address to mine so that I could get a confirmation number. I also made a payment plan after being under the impression from the rep that this would help my credit situation because i am in the process of buying a house. After some advice from my financial advisor, they told me that this would do the opposite. I called to have the payment cancelled, they couldnt find the case number and I was assured no money would be taken from my account. Money was taken from my account days later and I was told by changing the email address and making a payment plan, that I had essentially claimed the account although this was done under their advice.

XXXX on XX/XX/XXXX from Capital One Bank and the other from a company starting with a XXXX I dont recall the entire name at the moment this was on XX/XX/XXXX. Both of these were without my knowledge or consent and have decreased my credit score significantly. Can you please check into this matter and remove these hard inquiries from my credit report as soon as possible. Consumer Complaint: Dear Sir or Madam, after obtaining my credit report, I noticed that it shows late payments on the above account with this company. It specifically states that I was 30 days late. This has damaged my credit worthiness and is extremely troubling. I am sure that CAPITOL ONE AUTO FINANCE is aware and understand that it is required by law that they must take proper care in ensuring the accuracy of this information with my account ; adhering to this of the utmost. They are required to send my statements or bills to my correct address, take care to respond to my change of address requests and accurately record my payments in a timely fashion as well as provide me with a notice 21 days before the due date before you can consider a payment late. They are also REQUIRED by law to provide me with a notice before providing anything on my consumer report that would negatively impact me as a consumer. The law clearly states that If any financial institution that extends credit and regularly and in the ordinary course of business furnishes information to a consumer reporting agency described in section 1681a ( p ) of this title furnishes negative information to such an agency regarding credit extended to a customer, the financial institution shall provide a notice of such furnishing of negative information, in writing, to the customer. They did not do any of the things the law clearly states. The law is also clear that transactions and experiences DO NOT BELONGS ON A CONSUMER REPORT in case you are not aware here is what the law state report containing information solely as to transactions or experiences between the consumer and the person making the report Also make sure late fees are accessed properly. In this regard, I hereby request the following steps to remedy this situation. 1. To ensure compliance with all provisions of the Fair Credit Billing Act, please send me a notarized statement attesting that you have complied with this act in regard to my account. 2. Im requiring written evidence for all the payment you claim that I was late according to my obligations with your company. Including the tracking number of the letter you sent out to place on me on notice 21 days prior to the statement due date. 3. Im seeking written evidence of timely billing and the posting of all payments I made on this account, regardless of whether or not you claim they were late from the time this account was opened to this present date. If they are not able to provide me with this evidence that I am legally entitled to have in writing, I affirm that they please remove all negative references of these late payment 's entries by your company to all CRAs as they were submitted. XXXX, XXXX and XXXX and any others. If I have not received these itemized documentations within the period prescribed by law, I will expect to receive written notification that they have removed all late entries that Ive disputed off my credit report. Consumer Complaint: I attempted to negotiate a repayment agreement during my Chapter XXXX XXXX ; unfortunately, I was pro se and capital one does not acknowledge pro se litigation. I was told numerous times that I would need to hire an attorney if I wanted to be communicated with regarding the case. XXXX months after my XXXX, Capital One randomly repossessed my vehicle after avoiding me for the entirety of that XXXX month period. I was never able to get any response to legal petitions, they did not attend the meeting of creditors, they never wrote me or acknowledged my offer to enter into a repayment agreement, and they stole my vehicle before writing me a letter where they accused me of lying and of stealing from them. They have not sold the former vehicle, and are holding onto it for as long as possible to lessen the value and hopefully send me a massive bill for any remainder. Being autistic, I have XXXX idea what is going on and can not defend myself against this multinational finance company and their army of law firms.
