Consumer Complaint: I'm filing this complaint against capital for overcharging me with interest fees and cash advance fees I have came to capital one regarding this issue of overdraft fees that are keeping me behind on my account ending in XXXX I had tried several times to apply for a hardship program I was denied each time in which i don '' t know how as well I reported the charge from XX/XX/XXXXXXXX of {$140.00} as unauthorized from a card I had lost to capital one no one has gotten back to me and this is the charge they are charging me interest for as well as cash advance fees every time I ask to have some interest charges to be wavied they say they cant do it with no explanation all the money I'm paying to my account is going to interest charges and I can't make the full on time payment because of this issue I'm also have been charged back from another unauthorized charge on my account that I reported from a lost card from XX/XX/XXXX XXXX {$170.00} the claims department claim they need more information I have given them all the information they needed even informing them I do not own a vehicle so the charge is not valid I'm asking for help with this account for a solution.

Consumer Complaint: I was a victim of Identity Theft, while in XXXX, Ohio. I had my wallet, and XXXX XXXX. The individual or group that stole my belongings, were able to access my checking account information, credit cards, passport information, and information about my mortgage. Being a victim of Identity Theft has caused several issues on my accounts, due to Thousands of dollars coming out of my checking account. This account was open in XXXX of XXXX, and is reflecting late payments in XXXX, XXXX, and XXXX. I explained my situation to the customer service manager, and he stated there would be no late payments reported and that we will work with you regarding this matter. I have worked very hard through school and in my career, and if the company is not able to honor the police report, and police officer statement, and remove the late payments reporting for the months of XXXX, XXXX, XXXX of XXXX. I will file bankruptcy on this account. I would like a response in 30 days, in order to proceed with filing.

Consumer Complaint: I am writing to formally file a complaint against Capital One Bank regarding their lack of response to a billing error dispute. The details of the incident are as follows : On or before XXXX, XXXX, 2023 I sent two items in the form of negotiable instruments to Capital One to the address indicted for such payments in the credit card agreement ( Capital One, XXXX XXXX XXXX XXXX, NC XXXX was for the balance dur on the account on the XX/XX/2023 Statement in the amount of {$520.00} and the other was for the XX/XX/2023 Statement for {$490.00}. In good faith and for value, I indorsed these instruments which is a right I exercised under the Uniform Commercial Code. On XX/XX/2023, I sent another dispute attached with another item in the form of a negotiable instrument in the amount of {$520.00} for payment of the outstanding balance still being shown on due on the account. These securities were not handled according to my indorsement and attached instructions, no credit was reflected on my account nor were the securities returned to me. If tender of payment of an obligation to pay an instrument is made to a person entitled to enforce the instrument and the tender is refused, there is discharge, to the extent of the amount of the tender, of the obligation of an indorser or accommodation party having a right of recourse with respect to the obligation to which the tender relates. My fear is that Capitol One is engaging in unfair and deceptive practices against consumer protection laws such as the Consumer Credit Protection Act as well as securities fraud in connection with my financial instruments. In accordance to 15 USC 1681 section 602, It states that i have the rights to privacy it also states in section 604-A section 2 consumer reporting agency can not furnish an account without my written instructions. Under 15 USC 1666-B a creditor can not treat a payment on a credit card account under an open and consumer credit plan as late on an account for any purpose.

After opened the account we deposited {$1000.00} and contact Capital One 360 Saving to confirm the bonus of {$300.00} before we deposit {$20.00}, 000, and Capital One 360 Saving denied the bonus. So we decided to close the account. On XX/XX/2023, we withdrew by making a transfer of {$1000.00} from our Capital One 360 Saving to our XXXX XXXX XXXXXXXX account ( the account is already in Capital One 360 Saving record ) in order to close the Capital One 360 Saving account. But the Capital One refused for us to withdraw and transfer our money back to our XXXX XXXX XXXXXXXX account. On XX/XX/2023, we contact Capital One 360 Saving to request the withdraw/ transfer, Capital One 360 Saving still refuse to pay us.
