Consumer Complaint: Capital One and XXXX XXXX XXXX let 's start by saying this I tried making payments for several months there was some kind of glitch in the system where it would not allow the payment to go through I do not understand it myself by the benefit of the doubt I know what I made ample effort I'm most certainly and they would not listen computers have a way of messing up I got to a point were I was having financial hardship because of lack of work but I still tried paying several times this is eating me up I'm having emotional stress I've always had a job and payed I work XXXX hours a week aways paid my bills 3 credit cards and there's an auto loan on my credit for capital one auto car is paid off I traded it in for another car through XXXXXXXX XXXX Capital One auto loan should be gone it says I'm late

Under 15 USC 1666b a creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose. The is the same Consumer Financial Protection Bureau complaint XXXX CFPB Complaint ID : XXXX against Capital One Bank regarding my Spark Business Basic Checking Account ending XXXX. XXXX. Capital One Bank suddenly closed this account in XX/XX/XXXX without my authorization and without informing me of the reason for the closure. XXXX. Capital One Bank claimed that the final closeout check # XXXX for {$970.00} was issued to me and that Capital One Bank records indicate that I XXXX. XXXX XXXX XXXX cashed the check on XX/XX/XXXX. XXXX. I never received any check from Capital One Bank and the claim that I received the check and cashed it was a lie and a XXXX XXXX XXXX. I challenged Capital One Bank on that claim and pointed out to Capital One Bank that the signature on the cashed check was NOT mine. XXXX. Capital One Bank then asked me to sign an AFFIDAVIT AND AGREEMENT OF FORGED ENDORSEMENT ( attached ). XXXX. I have done so via email ( XXXX ) on XX/XX/XXXX, XXXX, but the next response from Capital One Bank has been complete silence! XXXX. Consumer Complaint: For about 4 years we both have been receiving multiple mailings per month from Capital One to open a credit card. We have been discarding this mail. This past week we noticed that the offer contained a note at the bottom : " to stop receiving " prescreened '' offers of credit from this and other companies call toll free XXXX '' We called this number and we were offered a {$100.00} gift certificate to Walmart . We told the agent that we wanted to opt out of mail from Capital One and we were disconnected. We called back and again were offered the {$100.00} gift certificate and disconnected after asking to opt out. We searched the internet for a number to opt out with Capital One and XXXX was suggested but didn't work. A second search led us to XXXX and after a long hold time we were told they would remove our names from mailings within XXXX days. This complaint is that the number stated on their letter ( XXXX ) is false and is actually a way to get you to sign up for a {$100.00} gift certificate.

I recently looked at my credit report which I haven't in almost a year and I discovered someone open up a account in my name ( Online ) or in store with a fake id. I also researched and seen where somewhere in XXXX XXXX Nevada has rented a apartment in my name so I assumed the card was open up there with a XXXX XXXX Nevada address. This is not me!!!!!!! It is definitely fraud! Please see attached police report made XX/XX/XXXX in XXXX Alabama where I filed a identity theft report. Shortly after in XXXX / XXXX someone open up this account. Please see attached documents I never lived outside the state of Alabama been here all my life. Please remove this fraudulent account off my credit reporting files immediately before I sue your company and hire legal counsel.
