Issue: Getting a credit card

Subissue: Card opened without my consent or knowledge

Consumer Complaint: A Capital One Bank USA account ending in XXXX was opened in my name on XX/XX/XXXX without my knowledge or consent. High credit of {$2900.00} with a XXXX limit was charged and the amount was never paid off. All of this information I obtained through my XXXX credit report. I called Capital One in XXXX upon learning that my identity had been stolen and they informed me that there was an alert on the account and they could not discuss details with me but would get back with me. I never heard back from them until it was turned over to collections and I received a bill for {$3100.00}. This was the first bill I ever received sent through mail to my address, dated XX/XX/XXXX, from collections. I never received an initial card sent to my address. I never received account disclosure and details sent to my address. The first I ever heard from Capital One was once the card was delinquent they began to send text messages to my phone beginning XX/XX/XXXX. Initially, I thought it was a scam so I ignored the first couple texts but then after checking my credit on XXXX, I realized someone had in fact opened an account in my name, charged an initial {$2900.00} to the card and never paid. To this day, I do not know the original address card was sent to, the full card number, and what was purchased. I am going to follow up with frauds department at Capital One.

Issue: Managing an account

Subissue: Problem using a debit or ATM card

Consumer Complaint: on XX/XX/2022 a transaction was made to a utility company that wasn't made by myself and the bank sent me an alert. Because of this I looked at all the transactions and found numerous transactions that wasn't made by myself and filed a claim with my bank. They denied the claim including the one they sent an alert for. I called them and they reopened the claim, yet they denied it again. These charges were not made by me or anyone I knew but because I stated my debit card was always in my possession they denied me. I have contacted some of the merchants and they have agreed to the transactions being fraudulent but I was told my bank has to start a request for the transactions and they would return the funds to my bank. I sent an email explaining this but still have not heard a response from my bank. I don't believe they investigated the transactions because they stated that the transactions they could view was valid.

Issue: Closing your account

Subissue: Company closed your account

Consumer Complaint: Consumer Financial Protection Bureau XXXX XXXX XXXX XXXXXXXX XXXX XXXX XXXXXXXX Subject : Complaint Against Capital One for Unnotified Account Closure Dear Sir/Madam, I am writing to file a formal complaint against Capital One regarding the abrupt and uncommunicated closure of my credit card account. This unexpected action has caused me considerable inconvenience and distress. My Capital One account is now closed On XXXX I attempted to pay several bills using my Capital One card. Unbeknownst to me, the bank account linked for payment did not have sufficient funds, resulting in a failed payment transaction. This was an honest oversight on my part, and I had no intention of defaulting on my payments. And I have not defaulted a payment of {$200.00} went through on XX/XX/2023. However, without any prior warning or communication, Capital One proceeded to close my credit card account. I received no phone call, email, or any form of notification to alert me of any issues or to provide me with an opportunity to rectify the situation. The first indication of this issue came when I attempted to use my card and found it inactive. The lack of communication from Capital One in this situation is highly concerning and, I believe, contrary to fair consumer practices. A simple notification could have allowed me to promptly address the issue, ensuring that the bills were paid and my account remained in good standing. I respectfully request that the Consumer Financial Protection Bureau investigate this matter. I believe that Capital Ones decision to close my account without prior notification or an opportunity to resolve the issue is unjust and requires rectification. I am eager to resolve this issue amicably and am willing to cooperate fully in any required processes to reinstate my account. Thank you for your attention to this matter. I am looking forward to a prompt and favorable resolution. Sincerely, XXXX XXXX

Issue: Improper use of your report

Subissue: Reporting company used your report improperly

Consumer Complaint: I am writing to express my concern and submit a complaint to CAPITAL ONE regarding the improper use of my credit report and the reporting of inaccurate information on my file. I previously sent a letter to your office requesting an investigation into certain unverifiable account. Despite your assurance of conducting a proper investigation, upon reviewing my credit report, I discovered that inaccurate information persists. The discrepancies include but are not limited to, the date opened, date of last activity, date reported, account status, and payment history. It is disheartening to note that such inaccuracies continue to be reflected in my credit report, despite the initial request for investigation. I believe this situation infringes upon my rights as outlined in 15 U.S.C 1681 section 602 A, which emphasizes my right to privacy. Additionally, 15 U.S.C 1681 section 604 A Section 2 stipulates that a consumer reporting agency can not furnish an account without my written instructions. I kindly request a thorough review of my case and the prompt correction of the inaccuracies in my credit report. Your cooperation in resolving this matter is highly appreciated. I trust that, as a reputable credit reporting agency, CAPITAL ONE will take the necessary steps to rectify this situation and ensure the accuracy of the information in my credit file. I have attached an FTC report with the report number XXXX to support this complaint.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: A bank ran my credit report and came back twice with a delinquent account with Capital One Bank. I thought the first time was a mistake ( a couple of months ago in XXXX ) and maybe delinquency was still showing up on an old account. Recently on XX/XX/XXXX when my credit card report came back the delinquency showed a second time. I checked my mobile app and found no account information indicating I had an open credit card at all, just the " credit one '' score. I contacted Capital One via customer service phone line and asked for clarification on why they were reporting this as delinquent. I was told by the customer service representative ( CSR ) that my account was closed due to non-payment and was sent to collections on XX/XX/XXXX. I asked the XXXX, " XXXX '', of the last statement they mailed to my home. XXXX stated this was mailed on XX/XX/XXXX. I asked for a copy to be sent to my email address, XXXX, which was updated with XXXX on the phone at this time. I also asked if they have sent me any other communication since XX/XX/XXXX indicating my account was not paid, via mail or email. XXXX was unable to provide me with any additional information pertaining to their attempts to contact me. His records showed that the last time they contacted me was on XX/XX/XXXX. I confirmed that they did have the correct mailing address on file. I also asked for my account number as I thought this card was paid off and closed several years ago. XXXX said he was not able to provide me with the credit card account number but it would be on the statement once they emailed it to me. I only know the account ends in XXXX and it has a balance of approximately {$850.00} on it. Again, this balance/account does not show at all in my XXXX app. I asked XXXX if they could assist me with removing the negative status from my account as I had not known this account was still open for over 3 years and had been bringing down my XXXX XXXX during that time. XXXX stated because the account was " closed '' and sent to their " charge-off/recovery '' department, he could not assist me. I then asked what date their records showed that they sent this to the recovery department. XXXX stated it was sent on XX/XX/XXXX. I asked if they sent me any notification via email or letter after that date and he said " no ''. I clarified with XXXX I would like a copy of their final notice to me, in writing, of my account balance and the date it was going to " charge-off '', the record of the last payment they received from me ( as I was sure this was paid off ), and the final date they sent me a notification via email or mail. XXXX stated all of this would be emailed to me at XXXX within the next couple of business days. I have not received any communication from Capital One regarding this phone conversation or my request for proof of documentation. Conclusion : Capital One stated they sent me my final statement on XX/XX/XXXX indicating a balance, then sent me a statement indicating a " charge-off '' although they have not been able to provide any proof of this to me. When asked why they did not make any further attempts to notify me of a balance for over 3 years, I was not provided with an answer. I continue to have a negative impact on my credit report because of this without any resolution. I have not received any communication about the status of this account in over 3 years via email, mail, or on my account page as it currently does not even show the account ending in XXXX when I log on to their website. I would like the delinquent information removed from my account and my credit report and proof of balance owed. I have attached a screen shot of my mobile app, logged in to my Capital One Account. It does not show any account information other than my poor XXXX XXXX. I do not have any other proof from this company.
