Consumer Complaint: The original mortgagee, XXXX XXXX, was adjudicated incapacitated. I was appointed by the Supreme Court XXXX XXXX XXXX NY to be the Guardian of her property. I closed XXXX 's personal accounts and open Guardianship accounts. Her HELOC was automatically deducted from her personal acct. I send my Commission to Guardian to Bank of America mortgage department in early XXXX. I still do not have authority to have the payment automatically deducted from the Guardianship account and she is being charged interest and fees and is getting letters about foreclosure. All aforementioned accounts were at Bank of America, which accepted the commission, closed the personal accounts and opened the Guardianship account. It is only the mortgage department, which is making money on fees etc. and therefore has an interest in not accepting the papers, that is not giving me access to the account. XXXX XXXX, XXXX.

Issue: Getting a credit card
Subissue: Application denied
Consumer Complaint: Last 2 years ago, I had opened up an account for a debit card at Bank Of America. Everything was working perfectly fine, It was my favorite bank so far other than using XXXX XXXX. I used it for everything, my work checks, purchasing items, sending money, ect. I had it only for couple months. After a few months of using the card, I had went out to a party & lost my whole wallet which it included my Bank of America Card. I didn't realize that i've lost my wallet until few days later, the minute i found out i went onto my BOA app and locked my card immediately. I made an appointment to go in & tell them what happened so i can get a new card replacement. They told me I am no longer & banned from creating any account or getting a card from Bank Of America. The XXXX lady told me that there was a fake check or fraud activity that happened on the account! I told her it was not me and none of it was my actions. I didn't know what was going on. She gave me a number to call and talk to the agents but at that time, i didn't take it too serious and was rushing to just get a card so i can make sure my direct deposit checks was coming in still. I ended up moving on to just stick with my other debit card which is my XXXX XXXX card. As soon as a i turned XXXX ( which i turned XXXX 4 months ago ) I wanted to apply for a credit card to start building credit .... Every single one of the credit applications had denied me! I got a mail sent home to tell me what was the reason, coming to find out i am on the blacklist. I had no idea this would affect my future. It is unfair to me because I lost the card before i turned XXXX, somebody took advantage of it and used it to try putting in fake checks. Now that i am XXXX and actually have plans ahead of me, i can't even start building my credit because of something that happened 2 years ago that was out of my hands and control!

Issue: Problem with a lender or other company charging your account
Subissue: Money was taken from your account on the wrong day or for the wrong amount
Consumer Complaint: Regarding Claim # XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, California XXXX On XX/XX/XXXX a claim was filed for the transaction with the amount of {$240.00}. When the claim was filed the first thing that I requested is that no provisional credit is issued until the investigation completes, but Bank of America not only ignored my request, but they did so in a way that put my account in a bad position. Claim Filed for a Non- XXXX XXXX XXXX XXXX Issue : Screen lifted when removing the screen protector, this defect falls under the deductibility of {$29.00}. I contacted XXXX and informed them that the screen lifted when removing the screen protector, they advised me to contact XXXX as it should fall under the manufacturers warranty. I did call XXXX after being informed, XXXX said that I need to file it with XXXX. I called XXXX back, so they proceeded to file the claim. After the claim was filed the charge on the account was noticed, XXXX representative stated that once they receive the device back ( defective device ) that the charge will be removed only leaving a charge of {$29.00}. Well after they received it back they never issued the refund, I did not want to go through the bank and wanted to deal with XXXX directly. I called XXXX on 2 occasions on 2 different days, they responded to contact the bank as if there was an agreement between both BOA and them. FACTS : 1. Deductible states {$29.00} 2. Replaced device with a carrier associated type, the reason that I purchased the phone directly from XXXX is to prevent all the bloatware. There was a claim that I filed months ago which was from a gas station, I that was a horrible experience and still not resolved in my end. That experience has allowed me to be specific with this claim. I wanted to provide Bank of America with the following. XXXX. The terms from XXXX show the rates and Deductible. 2. The plan that I was enrolled in 3. Other pertinent information which would have made this claim a certain one. This is now the 2nd time this occurred, BNAK OF AMERICA MADE IT CLEAR THAT I AM NOT TO SEND ANYTHING, THEY ADVICED ME THAT IF ANY ISSUES PERTAINING THE CLAIM ARRISES THAT THEY WILL SEND A LETTER PROVIDED THE FOLLOWING INFORMATION - FURTHER DOCUMENTATION THAT PROVIDES EVEIDENCE TO MY CLAIM BANK OF AMERICA HAS NOT REQUESTED ANY INFORMATION, RATHER THEY TOOK THE FUNDS OUT OF THE ACCOUNT WITHOUT ANY NOTICE. PLEASE DO NOT SAY THAT A LETTER WAS SENT OUT BECAUSE I CHECKED EVERY EMAIL THAT I RECEIVED FROM THE USPS EVERU MORNING ON THE MAIL THAT WILL BE RECEIVED THAT SAME DAY I, THE PERSON WHO FILED THE CLAIM IS GIVEN A PROVISIONAL CREDIT WHEN I REQUESTED THAT THE CREDIT IS NOT ISSUED UNTIL THE CLAIM IS COMPLETED. BANK OF AMERICA HAS ALLOWED THE MERCHANT TO RESPOND TO THE CLAIM ALLOWING A DENIAL AND NOT ALLOWING ME THE OPPORTUNITY TO PROCEED. I AM NEEDING SOMEONE TO IMMEDIATELY REVIEW THE CLAIM AND DO HE RESEARCH, I AM OBLIGATED TO AN EXPLANATION FOR WHY THE CLAIM IS DENIED SO IF IT STILL STANDS THAN FOR MY RECPRDS I WOLLD NEED THAT INFORMATION. BY NOT GIVING ME THE OPPORTUNITY TO PROVIDE ANY DOCUMENTS OR EVEIDENCE SHOWS THAT THE CLAIM IS BEING HANDLED WITH BIAS. MEANWHILE DURING THE RESEAARCH I NOW NEED TO FUND TO BE APPLIED BACK TO THE ACCOUNT UNTIL YOU HAVE COMPLETED THE RESEARCH.

Subissue: Account opened as a result of fraud
Consumer Complaint: On XX/XX/XXXX, I received emails notifying me that a new bank account had been opened in my name at Bank of America, and I do not have any accounts there. I called their fraud department at XXXX and reported the fraud. They said it had been opened online, investigated my claim, and confirmed the account had been opened fraudulently using my name, date of birth, and social security number. They immediately closed the account. This exact same thing happened to me in XXXXXXXX XXXX XXXX, after which I filed all the necessary claims, complaints, and freezes, so I am appalled that it happened again with the same bank. All of the freezes are still in place. How did this happen? Bank of America should not have opened the account with all of the freezes and alerts I have in place.

Issue: Took or threatened to take negative or legal action
Subissue: Threatened or suggested your credit would be damaged
Consumer Complaint: Dear Bank of America, I am writing to express my deep dissatisfaction with the way my credit card account has been handled by your company. As a consumer, I expect to be protected by the laws and codes that are in place to safeguard me from debt and financial instability. However, I feel that your company has violated these protections in several ways. Firstly, I am currently not able to work due to medical issues, and I have been struggling to make my credit card payments as a result. Despite my efforts to explain my situation and request assistance, I have not been provided with any viable solutions. Instead, I have been subject to aggressive collection tactics and have received threatening letters demanding immediate payment. Secondly, I recently closed one of my credit card accounts with your company, only to find that the interest rates on the remaining accounts have skyrocketed. This sudden increase in rates has made it even more difficult for me to keep up with my payments, and I believe it is an unfair and unethical practice.
