Issue: Problem when making payments
Subissue: Problem during payment process
Consumer Complaint: A refund from an overpayment on my credit card was approved XX/XX/2023.1 spoke to customer service on XX/XX/XXXX the minute I saw the double debit from my checking account. I still had not received it by XX/XX/2023. I've called 5 different days since XX/XX/XXXX when this started, spoken to 9 different people in 5 different departments, been hung up on once, have been told wow, that's a long time, just wait another day twice, that the money moves slowly because it isn't going to a Bank of America checking account. Are there different wires? Because it comes OUT of my account within 24 hours! It's XXXX, and an ACH transfer. They told me on XX/XX/2023, that I'd have my money back in my account within 24-48hrs, then again XX/XX/XXXX, again on XX/XX/2023 another 7-10 days because they sent my refund back to the wrong account. I spent an hour and a half on the phone with XXXX XXXX ( where I have my checking account ) and they went above and beyond to help me, no record of any money being returned to me. Regulation Z requires that Bank of America : " Credit the amount to the consumer 's account. Refund any part of the remaining credit balance within seven business days from receiving a written request from the consumer. '' Bank of America doesn't allow written requests anywhere on their website, you only list phone numbers of departments and a vague address of headquarters. I finally was able to get someone via XXXX XXXX to create a secure chat, in which I gave them my routing and account numbers, XX/XX/2023, a whole month after the credit was marked as posted, but I still have not received it. The routing number was completely wrong, which I finally made them check and tell me what the routing number was on XX/XX/23, it started with a XXXX and I knew right away Bank of America had messed up. Bank of America is holding onto almost {$1400.00} that I want back with my missed interest accrual. I have spent hours upon hours trying to get my money back when the original representative at Bank of America on XX/XX/23 put in the wrong routing number, no one at Bank of America could figure that out until I asked them to look? And I still don't have my money back, 3 months later. I have been more than patient.

When I talk to XXXX about reopening my account, they direct me to Bank of America and when I talk to Bank of America, they either tell me there's nothing they can do and that it's " strange '' that account is still closed or direct me to XXXX. I have been in this loop for months now. I have hour-long phone conversations recorded where both parties fail to resolve this issue of reopening my account and I am ready to take legal action. Consumer Complaint: I am filing this complaint against Bank of America regarding their decision to place a hold on my check deposit from the United States Treasury Department, which is in violation of federal and state laws. On XX/XX/2023, I deposited a check from the United States Treasury Department in the amount of {$15000.00}, which represents my federal tax return money. Under federal law, banks are required to make funds available for withdrawal by the next business day following the day of deposit, as set forth in 12 C.F.R. 229.10 ( c ) ( 1 ). Additionally, under state law, banks must make funds available in a timely manner and can not impose an unreasonable hold on deposited funds. Despite these legal requirements, Bank of America has chosen to place a hold on my deposit for a period of ten days, causing me significant financial hardship and placing me in a difficult financial situation. The funds in question are my tax refund, which Im entitled to receive promptly and without unnecessary delay. Moreover, the amount of the check is not an exceptional amount that would justify a hold, as confirmed by legal professionals. I have already contacted Bank of America regarding this matter, but they have refused to release the hold on my deposit. I demand that Bank of America immediately release the hold on my deposit and expedite the transfer of the funds into my account as required by law. I request that the Consumer Financial Protection Bureau take appropriate action to investigate Bank of America 's violation of federal and state laws. I also request that the Consumer Financial Protection Bureau direct Bank of America to release the hold on my deposit and expedite the transfer of the funds into my account as required by law. Thank you for your prompt attention to this matter. Sincerely, XXXX XXXX XXXX & XXXX XXXX XXXX XXXX

Consumer Complaint: This is related to the prior complaint from XXXX where Bank of America charged off my account in XXXX claiming they did not know where I was, when they were already collecting from me on an unrelated Bank of America Account which I eventually paid in full. They have now issued a 1099 to me for what they claim was the balance they wrote off in XXXX. The XXXX is for {$11000.00} for account XXXX. I had previously requested the original agreement which they could not produce and I am not liable for the full debt as stated on the tax document. The debt was discharged by Bank of America in XXXX. They harassed me calling before and after hours and when I complained they admitted their own wrongdoing. This is a continuation of Bank of America harassing borrower 's.

Consumer Complaint: I recently applied for a XXXXXXXX loan for the first time through bank of America. during the application process they said it was time to pay for a property assessment on XX/XX/23 and I needed to pay them XXXX. I asked XXXX their loan person if i should pay it at that time and was the loan looking in my favor. she stated that my employment was already verified and i should pay it so i did with my debit card for bank of America. the next day I was told that my loan was denied that I i had not told them my XXXX was temporary, I stated i told them several times that i was a traveling XXXX XXXX with continued employment from a permanent position with only a few weeks between my last job and that i had XXXX years in same field, I have been with my current job for XXXX months they said i put on pre-qualify application i had same employer for XXXX years which is not correct but i have been working for several years prior and no where did the application did it ask if i was a traveling or contract employee. i said have worked for current several years prior in XXXX. I mentioned to them several times to listen to the recorded conversation and that their employee stated this had already been checked before i had paid the money. why would they do that before i was approved. i feel like they coerced me into paying this fee early. i offered more money down they refused. i mentioned removing money from my auto loan through them they refused. XXXX XXXX became very rude and abrupt while i asked for a refund telling me its because of my income which is huge and then because of my employment and because i didn't say i was a temp but they had my pays stubs from the get-go. then today XX/XX/XXXX XXXX days later they sent me forms dated today with forms of loan basically appearing that i received the loan " loan estimate with his name on it for me to sign. very upsetting thinking maybe i was approved so i called the realtor to stop the termination. I was wrong he stated " I told you You were denied because of your income '' i understand them refusing the loan but believe that them having me pay for a property assessment that that they knew i was denied for was uncalled and uncaring. what am i going to do with an assessment on a place i can not get the loan for. I have been taken advantage of and swindled by this bank

Issue: Opening an account
Subissue: Account opened as a result of fraud
Consumer Complaint: On XX/XX/XXXX someone tried to open an account using my social security number at bank of America. Shockingly BofA sent an email saying this account can only be opened with a physical ID at a branch and you would think that would be the end of this. I called them to inquire about this and they informed me that a flag would be placed on my account to prevent this from happening in the future. On XX/XX/XXXX despite the supposed " flag '' someone did open an account in my name with my social security number. I called bank of America and they told me they closed the account and this will never happen again. On XX/XX/XXXX again Bank of America allowed someone to open an account using my social security number, an address that was not mine and they should have known was not mine because I am an active BofA customer and a name that is not my legal name. On XX/XX/XXXX someone used this account to commit fraud and I was texted about this fraud despite my number not being on this account. ( I believe BofA allowed this fraud to go through because they used my SS number and matched my active account with this fraud account and this exposes a massive security issue ). I called BofA on XX/XX/XXXX to confirm the account was closed and only then did they shut down the account. At the time they claimed that they opened the account based on a XXXX report. This is false on two fronts : XXXX ) According to my XXXX report they never checked the report XXXX ) The address that was used on the account is not in my XXXX report. It appears that BofA has no ability to stop this fraud from occurring as the fraudster did not even need to receive a physical card because they committed fraud using the virtual card in XXXX XXXX. As long as they cant stop someone from opening an account in my name, fraudsters can continue doing this. Additionally, although I have been a BofA customer since XXXX, BofA is communicating with me about this fraud using an email address that is not listed on my account, a name that is not my legal name, and an address that I have not used in 8 years. Attachments : XXXX report showing that they didn't check it and the address they used for this account was not there Email showing that account could not be opened without id Emails showing the accounts that were opened emails showing that the debit card was used Text message that came to me about this debit card being restricted. it was not restricted and my number should never have been on this account. Screenshot showing my actual accounts
