Consumer Complaint: Once again, after successfully paying my new modification for the past 2 years, Bank of America send me a statement increasing my payment from {$380.00} ( principle and interest ) to {$620.00} ( escrow flood insurance ) As in the past 5 complaints Bank of America, intends to alter the terms of the contract I have with them. XXXX XXXX XXXX XXXX Regulatory Complaints Department XXXX XXXX Bank of America ) and I have worked together for the past 10 years trying to get my modification on terms we all could agree on. We finally agreed NO ESCROW just principle and interest. We did 3 trial payments, we signed all the paperwork and I have been paying faithfully for the past 2 years. It was agreed a 40 year modification at 2.75 % {$380.00}. I pay my own insurance and taxes. XXXX XXXX did say if I defaulted on my payment, they may have to add escrow in to the loan. I have NOT defaulted!! I just got notice from Bank Of America that they expect me to now pay {$620.00}. I did not agree to that and I can not pay that amount monthly. I pay my flood insurance yearly ain XXXX and I intend fully to continue to do so. I will be paying bank of America my agreed upon payment and nothing more. I have tried several times to reach XXXX XXXX and he does not return my calls. i have tried to come to terms with customer service and the insurance dept. and they keep switching me back and forth and are not trying to make a resolution with me. I am sure once you enter a contract with someone, you can not change the terms 2 years later. Hopefully, we can work this out without having to get an attorney involved. Bank of America is making it difficult to speak with someone with authority to help me. Thank you for anything you may be able to do to help me at this time. XXXX XXXX

Issue: Struggling to pay mortgage
Subissue:
Consumer Complaint: On or around XXXX of XXXX I received correspondence to a prior claim stating from Bank of america they did everything they could to help me at the time with my mortgage. Nothing could be further from the truth. Firstly after sending documents pertaining to this episode of fraudulent activity to my current place of residence, I noticed that the documents did not contain the more important Deed to the property. When I inquired about the deed I was not given any answers as to why all the documents were without the Deed. Secondly, I have tried to remedy this situation multiple times and am looking for restitution as well as the CFPB to do an investigation into this matter because there inconsistencies with the different documents sent by Bank of america. Since bank of america never established ownership ( through original deed ) I feel they had no legal right to fourclose on my property. In addition to the proven facts surrounding illegal signature 's, Robo signings, and nefarious activities within the bank as well as sworn affidavits and testimony from bank employees it speaks to fraudulent behavior at all levels.

Consumer Complaint: We are a coaching business ( XXXX XXXX XXXX ) that has been going for almost 2 years and we launched a new program that has been very successful. We were notified XXXX of XXXX that because of our increase in volume they were reviewing our account for risk and ask for us to provide them with information. We had a brief message from them with no detail and were told to arrange an appointment. We have been trying to do that but BofA customer service says they can only send the risk department an email. As all of our client payments go through this process they have essentially bought our small business to a stand still. We continue to serve our clients as they have paid in their opinion but Bank of America is holding our funds and refuse to transfer them. We have called every day but to no avail and we need the funds. This is the first time I have ever been penalized for success. They are causing significant consequential damages to our business.

Consumer Complaint: On XX/XX/2023, My wife and I, XXXX and XXXX XXXX applied for a HELOC loan online via the Bank of America website and it stated we would receive a letter in the mail, it didn't go on to state that we were declined. Today XXXX and I received a packet from Bank of America stating that we either need to sign enclosed document or upload documents that would be requested online via the website www.bankofamerica.com/hestatus, well the documentations is very misleading and leads us to believe that we could potentially get a home equity loan on our home that we have been in 22 years and never missed a payment. The representative at BOA stated that we were declined and that letter would follow up. The confusing thing is that on the website, it states that the approved amount is still pending then it says above that application is no longer active, if you can make heads or tails of all this more power to you but BOA cant have it both ways, if we were denied then why in the world would they send out documents leading us to believe that we might get the loan, why didn't we receive just a letter of declination instead, I informed the representative about the issue and she said they send these out to everybody regardless of approval. I dont buy that because that is misrepresentation, I have attached everything for you to review.

Issue: Problem with a lender or other company charging your account
Subissue: Transaction was not authorized
Consumer Complaint: Upon doing my taxes for the XXXX year, I discovered that someone had gained access to my account and began stealing small increments of money via purchases to the XXXX store linked with my XXXX account. Upon discovery I immediately contacted Bank of America. Having been a client of this institute for 17 years I was assured that due to the {$0.00} liability fraud guarantee I would have my claim investigated and at the very least credited back my stolen funds. Log in to Online Banking to report your lost or stolen card. We'll cancel your card and send you a replacement immediately. Remember, you're covered by our {$0.00} Liability Guarantee, so you won't be liable for any unauthorized charges or activity. After attempting to establish the claim, I had to call in numerous times. Bank of America had not only setup incorrect claims with the incorrect merchants multiple times, which resulted in multiple claims being opened. After finally having my claim started, it was denied due to the merchant sending very irrelevant evidence that Bank of America used without context to my claim. ( the evidence being that I linked my bank account to my XXXX account seven years ago ). This was not my issue, it is that someone GAINED access to the account and began using it as their own. After submitting my evidence to support my claim; consisting of XXXX refunding dozens of charges already, Bank of America reopened my claim and had also refunded me approx. 10 claims worth of charges amounting to {$300.00}. They have since stopped refunding the rest of the charges. I have since called multiple times, asked for supervisors, asked for clarification but it seems there are shay practices going on. Im being transferred to different people, different departments, my notes are locked or I cant view this and being told this is odd I cant see these details further this is handled by a back office - and nobody can give me details. This is going on three months with no information. It seems Bank of America is lying and not honoring its fraud protection for a client, a 17 year client with no such events such as this. I am pleading for the investigation into these shady and deceptive practices as I am now a victim of fraud for over {$2000.00} with no help from my banking institute dispute its guarantee to its protection of my funds.

Subissue: Credit card company isn't resolving a dispute about a purchase on your statement
Consumer Complaint: I contracted Bank of America ( BOA ) multiple times in writing and over the phone regarding being overcharged by XXXX XXXX XXXX XXXX XXXX at XXXX XXXX in XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX ignored my attempts to resolve the issue. I tried in person while on site, over the internet, via email and via phone. The merchant overcharged me by XXXX XXXX for renting a car in XXXX. I was quoted XXXX XXXX for an intermediate SUV and ended up with a compact car for XXXX XXXX for 3 days. I opened a dispute with BOA in XX/XX/XXXX. I had multiple dispute claims opened over the following 7 months. The number of the last dispute is XXXX. BOA denied my claim based on the information from the merchant. XXXX 's response to BOA shows the daily charge and all of the fees and taxes applied to it, but there is no explanation why the charge is all of the sudden much higher even though the gave me a lower vehicle class. XXXX 's response to BOA has errors but BOA failed to catch it before denying my claim. Here is an excerpt from merchant 's response : " Amount : XXXX USD '', ... '' Transaction Amount : XXXX USD '', ... and " confirm that disputed charges of XXXXare legitimate '' ( see the page 4 of attached BOA Last XXXX XXXX XXXX ). BOA decided to deny my claim based on XXXX XXXX XXXX XXXX very sloppy response. BOA refused to ask the merchant to explain the base for the daily rate before the taxes and fees and didnt care about the mistakes in merchants response ( correct value of the transaction in XXXX and XXXX dollars ). If the merchant is not punctual in their response to financial institution, how can I be sure they charged me the correct amount? Last time I spoke to Bank of America representative was on XX/XX/XXXX and from their point of view the claim is closed. I pointed out the discrepancies and inaccuracies in merchants response and the fact they didnt address the daily base charge but BOA refused to reopen the claim.

Consumer Complaint: I had Fraud on my bank of America card, high end restaurants and a few other things. They also mistakenly put 2 disputes in there and used that as a reason to deny the fraud claim. XXXX XXXX XXXX and XXXX XXXX are DISPUTES with the merchant not Fraud. Unauthorized charges they decided to claim were " Valid '' and when I did a second review said if I did more my account would be terminated. So a client can't report fraud or they can lose their account?? no wonder Fraud is up, they almost welcome it and treat the Victim like the crook. They have since deleted the claim off my profile so I dont have a claim number, they are being very under handed here.

Issue: Fees or interest
Subissue: Charged too much interest
Consumer Complaint: I have been paying well over the minimum balance for a long time. I have XXXX additional categories in addition to purchases, which are the lowest interest rate. I had Bank Cash Advances and another category broken out as Direct Deposit and Check Cash Advances. The latter have the same interest rate. However, the balance bearing on the interest rate is substantially higher for Direct Deposit and Check Cash Advances than for Cash Advances. The law states that amounts above the minimum should be allocated based on the BALANCE BEARING THE NEXT HIGHEST RATE OF INTEREST. Bank of America should have allocated the payment over the minimum balance to the Direct Deposit and Check Cash Advances balance which had a balance over {$12000.00} more than the Cash Advances. As a result, the Direct Deposit and Check Cash Advances balance continued to increase by several thousand dollars. The Cash Adnance balance was less than {$3000.00}. Based on the intent of the law, the balance that would have the greatest bearing on the interest rate accrual should have been paid first.
