Issue: Getting a credit card
Subissue: Card opened as result of identity theft or fraud
Consumer Complaint: I have been a Bank of America customer since XX/XX/XXXX, and I opened my account with my XXXX passport. In XX/XX/XXXX, a fraudulent credit card application was filed with my name and social security number. However, this application also falsely claimed that I was a XXXX XXXX. I have never claimed to be a XXXX, and I am currently in the XXXX XXXX. I am concerned that Bank of America updated my XXXX status when this application was submitted and during the fraud investigation they did not correct it back to XXXX XXXX. I need written documentation showing that Bank of America erroneously put this information on my file and neglected to correct it as necessary, considering false claims to XXXX XXXX can have devastating effects on XXXX. I have contacted Bank of America, including the Head of Consumer Client Services, several times regarding this issue and they have not provided the documentation they told me would be coming when I spoke to them on the phone. I need this written documentation to prove to the government that I did not make this claim in case the need arises. I have complained to the Attorney General 's office for my state and they were unable to rectify the situation.

Issue: Closing an account
Subissue: Fees charged for closing account
Consumer Complaint: Bank of America put a hold on my direct deposit paychecks today and took the entire amount over {$1300.00}. They said that it has to do with my daughters account, which she closed in XX/XX/2022, having insufficient funds. When they closed her account and sent her her funds, they sent her more than she had on deposit. She contacted them and made an agreement to pay the money back $ XXXX. Last month Bank of America withdrew from my account {$76.00} and {$30.00}. They said this was the monthly charge to payback the insufficient funds. I didnt not give them permission to withdraw any money from my account that would go toward any insufficient funds. My account doesnt have insufficient funds issues. I called them last month to resolve the issue. But they passed me from one department to another. I called them today and they passed me around to several departments. One of their representatives said that the hold would be removed by XXXX XXXX. I have her name and the location that she works at. I went to the local branch and they said that we will have to wait till Saturday morning to see if the hold would be removed. And that somebody from the bank will call me before the end of business day to update me about the status of the hold. They didnt call. I called them before closing. They said the money had been withdrawn and applied towards my daughters closed account that has insufficient funds. They lied to me on the phone and lied to my face, just to get me off the phone and so I would leave the branch.

Subissue: Account opened as a result of fraud
Consumer Complaint: An unauthorized checking account was opened in my name with Bank of America without my permission or consent. I called the bank fraud department and even spoke with a fraud supervisor theyre unable to solve the issue. Im still receiving email regarding that and now received a bank statement in the mail. This is really frustrating and scary and shameful and fishy that Bank of America is unable to resolve this issue.

Issue: Problem with a purchase or transfer
Subissue: Card company isn't resolving a dispute about a purchase or transfer
Consumer Complaint: This is about my California edd prepaid debit card. Over XXXX XXXX dollars was siffoned out of my account starting in XXXX of XXXX. The California edd had put my back pay on my edd card unbeknownst to me on XXXX XXXX. I hadn't received benefits since XX/XX/XXXX, it was an issue on my account, which is why I had not been checking my edd card regularly. I did not receive any deposit alerts even though I had them set up. I did not find out about the restart of my benefits until XXXX of XXXX. By that time it was {$1.00} in my account. I immediately called BOA dispute line and they filed 4 separate disputes 1 ) # XXXX for {$8000.00} 2 ) # XXXX for {$4800.00} 3 ) # XXXX for {$5800.00} 4 ) # XXXX for {$1000.00} I explained to them in detail what happened and ordered a new card. Mind you my original card had no chip. All disputes were denied with the exception of dispute # 3 in less than 10 days. I asked for reconsideration that was denied too, with no valid reason why. I gave up. Fast forward to XX/XX/XXXX I get an email from bank of America stating that dispute # 3 listed above had been opened, confused I called BOA at this time. I no longer had an edd card because it was no need so I threw it away years prior. I ordered a new one XXXX XXXX. I was informed by dispute representative that this was an abandoned dispute that BOA reopened and also informed me, 3 other disputes the ones listed above had been reopened XX/XX/XXXX, and there were no updates and no time frame for it to be resolved. I had no knowledge, no one sent mail anything. Well the rep filed complaint for the disputes that were opened since XX/XX/XXXX. I called 5 days later and dispute # 3 was denied as well and filed another complaint and asked for reconsideration. Once again no resolution. I need all of this rectified. I'm aware of the class action lawsuit against BOA and users of CA edd cards an decision. I need these disputes completed immediately and provisional credit to my account while I wait. I am prepared to take this to court will send demand letter to corporate office.

Issue: Opening an account
Subissue: Unable to open an account
Consumer Complaint: Opened an account with an associate in the branch of Bank of America, everything was online. The next day account was locked and when I called customer service, I was told that I needed to verify my identity in the bank. I went into the bank and was told that there are glitches with the online opening of an account so the associate reopened an account for me. A few days later I deposited my paycheck from work and the teller said it would be in my account on XX/XX/XXXX, it was in the account on XX/XX/XXXX. On XX/XX/XXXX I checked my account online and it said my funds were on hold. I immediately called the customer service number and they stated I needed to go into the bank again to verify my identity yet again. I went to the Bank of America location and the associate called the Risk Management Dept and they were not much help but stated my funds would be released on XX/XX/XXXX. She gave me a number to call to try to get this expedited. I called the number and was told they could not verify my identity but would not tell me why. I called the bank manager at Bank of America to try to fix this situation because I needed my money for living expenses. She stated I could file a hardship and they would possibly release my money sooner, so I called the number she gave me and the supervisor stated that my account was being closed on XX/XX/XXXX and they would send me a cashier 's check with my money at that time. When I asked why they are not able to verify my identity, no explanation was given. I filed the hardship and contacted the bank manager again to try to help me with this situation. My money was finally given to me on XX/XX/XXXX, but this was very scary and I'm afraid to open another account with anybody at this time. I still want to know why they were not able to verify my identity and why they held my money for over a week and a half. This situation has put me very behind on my bills as I live paycheck to paycheck.

Issue: Managing an account
Subissue: Funds not handled or disbursed as instructed
Consumer Complaint: I wrote a check in the amount of {$760.00} dated XX/XX/XXXX to XXXX XXXX XXXX XXXX. The check was cashed on XX/XX/XXXX but XXXX said they never received the check. XXXX asked me for a copy of the check ( front and back ) so that they could investigate. My bank ( XXXX XXXX XXXX ) sent me an electronic copy of the front and back of the check but the back of the check was blank ( nor endorsed ). I also have my XXXX statement showing that the funds were withdrawn from my account. XXXX determined that they did not receive my payment so I still owed them {$760.00}. I ended up sending them a new check for the {$760.00}, otherwise they were going to cancel my policy. At the same time I reached out to XXXX to file a claim. All XXXX would tell me was that the check was cashed by Bank of America -- I believe in XXXX but Im not entirely sure. In order to recoup the funds from BOA, XXXX asked me to submit a Declaration of Unauthorized Endorsement or Altered Item, to be completed by myself and XXXX. This information was submitted to XXXX on XX/XX/XXXX. I received a letter dated XX/XX/XXXX from XXXX stating that the bank that accepted my check ( BOA ) is responsible for repayment and that they ( XXXX ) had initiated a claim on my behalf. I spoke with XXXX on Wednesday, XX/XX/XXXX about the status of my claim and they said they have reached out to BOA numerous times about this situation but have yet to receive a response. Its impossible to get through to anyone at BOA about this situation so XXXX suggested that I reach out to you for help.
