Consumer Complaint: On XX/XX/XXXX I deposited a check in the amount of {$5200.00} ; I asked when the check will clear and was told by the teller funds would be available on XX/XX/XXXX @ XXXX. I received an email on XX/XX/XXXX stating that funds wouldn't be available until XX/XX/XXXX. I called customer service ( 3 ) times requesting the hold on the funds be released ; the first person responded with a wise statement, " maybe you should use direct deposit next time. '' The next representative made a XXXX available for me ; he refused to release the funds due to the clearinghouse needing more time. He also insinuated that the check might have been tampered with, and/or activity in my checking account was usual as reasons why the funds were on hold.

Consumer Complaint: On or about XX/XX/XXXX I submitted a claim against Bank of America with the CFPB stating how my consumer rights were violated and how I would like to exercise my right to rescind the transaction for my auto loan. I received threatening letters about repossession and even a few phone calls. After the case with CFPB was closed and I received a rebuttal from Bank of America representative XXXX XXXX ( Resolution Specialist Regulatory Complaints ) which stated " we have determined that no bank error occurred in the management of your loan. Bank of America respectfully declines your request for a refund due to you agreed to all disclosures at time of application and by signing the contract. Additionally, you agreed to a secured loan with vehicle ending XXXX as collateral ; therefore title will not be released while there are remaining payments on the account. '' My complaint is, I was not properly serviced in my " loan '' transaction. According to 16 CFR 433.1 ( d ) Purchase money loan is a " Cash Advance '' which is received by a consumer in return for a " Finance Charge '' within the means of the Truth In Lending Act, which is applied, in whole or substantial part to a purchase of goods or services from a seller who ( 1 ) refers consumers to the creditor or ( 2 ) is affiliated with the creditor by common Control, Contract or Business arrangement. XXXX XXXX XXXX says right in his statement that the vehicle is collateral, well what did I receive in return for the collateral? I did not receive my cash advance in my transaction, therefore because one violation makes the contract null and void I should still be in possession of the XXXX XXXX XXXX. On XX/XX/XXXX a towing company by the name of XXXX XXXX XXXX XXXX XXXX came to a parking lot I had the car and towed it away on behalf of Bank of America. Under 15 US Code 1692f ( 6 ) Unfair Practices, Bank of America violated my right by taking non judicial action to effect disposition or disablement of the property ( Vehicle ) because there were no present right to possession of property claimed as collateral through an enforceable security interest. Also 15 US code 6802 ( b ) ( 1 ) states, A financial Institution may not disclose nonpublic personal information to a nonaffiliated third party. XXXX XXXX XXXX XXXX XXXX is a nonaffiliated third party. In closing I would like Bank of America to return the Vehicle back to me along with the title and refund me the amount paid to them suming in {$7500.00}. I will be mailing in remainder of proof because I couldn't upload them all.

Consumer Complaint: Bank of America and XXXX XXXX XXXX and myself had a conference call on XX/XX/2023, regarding a double payment of {$400.00} from my BOA checking account to my XXXX credit card account to verify if funds cleared my BOA account. Bank of America told the XXXX representative and myself to call back the next day because the XXXX {$400.00} payments was processing still. On XX/XX/2023, XXXX XXXX XXXX XXXX Representative and myself conference called BOA again and BOA representative verified the XXXX {$400.00} payments had cleared my checking account. XXXX XXXX XXXX XXXX then, credited my XXXX XXXX checking account {$400.00} to correct the double payment error. Bank of America turned around and sent both {$400.00} payments back to XXXX XXXX XXXX XXXX as NSF on XX/XX/2023. I have two complaints with Bank of America. First Complaint is I deposited my check of {$2800.00} in BOA on XXXX XXXX. BOA told me a one day hold until XXXX XXXX. I received the funds {$2800.00} on XX/XX/2023. I then, made payment with XXXX XXXX XXXX XXXX for my credit card with XXXX out my BOA Checking account. Bank of America came back and took the {$2800.00} funds out my account and said check on hold until XX/XX/2023. On XX/XX/2023, BOA put the {$2800.00} back in my account for the second time. I the mean time I called Bank of America and spoke with the call center and was told Bank Of American would honor any payments that came through my account from XX/XX/2023 to XXXX XXXX and I would not receive any NSF. Complaint 2, Bank Of America returned both {$400.00} payments to XXXX XXXX after verification on XX/XX/2023 to XXXX, They ( BOA ) had cleared the XXXX {$400.00} payments. Now, I have received NSF from XXXX XXXX XXXX XXXX on XXXX {$400.00} NSF fees. I was told by Bank of America call center representative XXXX, BOA is charging me two NSF fees as well. XXXX had filed a complaint with BOA for me as well. BOA Complaint number XXXX XXXX XXXX. BOA have me out here looking like a complete fraud to XXXX. Oh and Bank of America removed all the HOLD information from my checking account. Trying to cover up what they did, when they took the money back out my account. However, showing the money in my account as if it was never taking back out. But show both {$400.00} being returned with money in the bank Bank of America is a complete fraud!! ( How is Showing Money Available but returning check fees possible? All a BOA discrimination and defamation conspiracy.

I called the Bank of America on XX/XX/2023 and reported that my card was stolen and Bank of America told they would remove this fraudulent charge. Later on XX/XX/2023 Bank of America added this fraudulent charge back onto my credit card account. I called Bank of America on XX/XX/XXXX and asked them why they had added this fraudulent charge and they told me I had to pay for this even though my card was stolen. I would like Bank of America to re-remove this {$860.00} charge from my account.

And for whatever reason I received a letter from Bank of America stating they have closed my account without telling me a reason. when I would try to log in online I can't and it says in big bold letters account locked contact Bank of america. However I already submitted my taxes and had my bank account info registered for a income tax refund that was already in the process. NOW ON XXXX, The irs sent a ACH to my account that's ( supposedly closed ) but they the bank of america accepted my income tax deposit and never told me So every day I'm checking for status of my $ and when I called B of A I was told they didn't reject the money but it's on " ON HOLD PENDING ACCOUNT CLOSURE '' and to call back next week on the XXXX of XXXX to see if my funds can be released. Now why would they take a irs Payment if they closed my account already? And why is my money being put on a hold?

However, when the money was returned {$45.00} was taken out. I called both Bank of America and XXXX multiple times and both institutions confirmed that they did not charge this {$45.00} ( or any fee ) and no explanation was given for where this money went. Additionally, as a Preferred Rewards Member with Bank of America, all wire transfer fees are waived for me and XXXX does not charge wire fees. Neither institution has any disclosures of {$45.00} charges for any wire transfers that are returned.

Consumer Complaint: I did a mobil deposit of a check from IRS on XX/XX/2023 they put a hold on it. i called on the XXXX and the check had already been cashed and they had the funds from IRS.i went to the branch on monday and was told it would not be in myn account until midnight of the XXXX. they said it was at the clearing house for my protection. and to make sure the funds were good. they know they are good because it had already cleared the IRS.well here it is the XXXX and they still have not put them in my account when they have had them since the XXXXthey have put over draft fees on my account now for things coming in on auto pay. i have made multiple calls to bank of america with no resolve, they offered to " loan '' me XXXX $ but with terms on it, yet not offering to just give me my XXXX $ I have ran out of gas, they are going to turn my electric off tomorrow, and i missed my neices and nephews graduation because they live XXXX hours away and i dont have gas to get there. they have no reason to keep this money from me and have caused me issues in my life. i have banked with them for XXXX years and this is wrong of them and for them to take total control of my life is not right or fair. i will be closing my account the minute they credit me the XXXX $ but i feel they need to be accountable for this and I will be seeking legal assistance as well as filing complaints everywhere I can. I am beyond mad there is not one thing i can do to get my money its not right even thoough they admitted had i taken the check to the bank it would have been just cashed on the spot and i could have walked out with my money so whats the hold up they are just earning intrest on customers money and its wr. like i said i will be seeking legal council to find out my rights in making them accountable in this.
