During the process I was told the check was post dated which is something neither me nor my lawyer who gave me the check noticed which is cool. But the issue comes with the way I was treated by the manager at the time who wouldnt give me her name. She literally said to me and I quote I just dont see why a realty group would give YOU a check ( emphasis mine ) my question is why would she even ask that question? Does it matter why someone would write me a check? Also being that I will be able to cash the check on Thursday the XXXX XXXX XX/XX/2023 will I receive further what I took as discriminatory treatment.

This lender and servicer is acting, without exception with and in BAD FAITH at each and every turn ( XXXX ) is that demand of the Legal Department of Bank of America related to that necessary Loan Modification and assistance with their security interest in that Vehicle which collateralizes the debt, not only have they failed and refused to communicate they also failed and refused so execute the Return Receipt attached to that Certified Mailing causing a Chargeback to be had for that {$8.00} paid to USPS for the service they failed to perform and obtain. It is blatantly obvious there is but XXXX party bound by the terms of that contract and XXXX party that completely flouts the laws behind the contract making that relationship and contract unenforceable in law and fact.

They pulled funds and said they werent there and started a XXXX month cascade of late payments. Was told by representative that when you were in program you could not incure any late payments but when I took this information to supervisor she denied this. This goes back over a year ago with making multiple calls to have them fix this to no avail.

Card to XXXX while receiving benefits I had experienced identity theft and unauthorized transactions due to fraud within my account 2 and a 1/2 years ago. I open the dispute 2 of them one in the amount of {$1900.00} the other 1 in the amount of XXXX. {$180.00} now they have opened and close them numerous times but upon receiving verification documents from me in XXXX of XXXX in reference to my identity theft and the fraud within my social security number that has been taken out by. An unknown person they have reopened the claim both claims and both of them have been in a pending state. I have contacted the number provided to me through Bank of America claims department and all they can do is escalate and write a complaint to the department. In reference to the time frame that has been exceeded as well as the non correspondence of communication and lack of interest based based on my accounts even with the. Documentation verifying everything that I have claimed. Tell the state I'm still trying to get Bank of America to. Please put the account funds back in my account that were fraudulently taken out by another individual who got access to my card. I did not want to take this route. Against speak of America but I think 2 and a 1/2 years is well above and beyond the time frame needed.

Consumer Complaint: On XX/XX/2023 I withdrew {$10000.00} from my account at XXXX in the form a Cashier 's Check. I then walked across the parking lot to Bank of America to deposit it into my checking account, which I have had for over twelve years. At the time I deposited it, I was informed that the bank might put a hold on half of it, but {$5000.00} would be credited to my account right away because in their words, " it's the law. '' Later that same day I was informed via email that Bank of America had put a hold on the entire amount until XX/XX/XXXX. The reason given was : " A hold was placed on your check ( s ) because check specific information indicates item may be returned. '' I called the bank and was told there was no way to get the deposit cleared earlier. Had I been informed that the bank was going to put a hold on my money, I would have walked back across the parking lot to get cash.

Consumer Complaint: On XX/XX/XXXX Bank of America charged a rush replacement fee for sending my debit card. This was because fraudulent activity on my wife 's card ( same account different debit number ) resulted in the associate accidently cancelling my card instead of hers. I was offered free rush delivery to make up for the mistake, but was told " you will receive a {$15.00} rush delivery fee on your account, call back when you receive your card and we will waive the fee. '' On XX/XX/XXXX. I still had not received the card. I called explained the situation to the associate who assured me they would rush another card to a different address to ensure I receive the card. I was told the first rush delivery fee will be waived and again " call back and we will waive the rush delivery fee '' This second fee was charged on XX/XX/XXXX. I called back on XX/XX/XXXX and was told the fee would be waived and it would take approximately 5 business days to appear on my account. On XX/XX/XXXX I called customer service asking why the fee was not replaced on my account as was told " the second fee went under review and your waiver was denied and once fee review decision is made it is final '' I talked to a supervisor and customer service manager XXXX who refused to give me a reason why it was denied the second time and intentionally casting the review process as omnipotent while keeping the specifics of what exactly was disputed opaque. The manager refused to acknowledge the contract made when the associate told me over a recorded phone call that the fee would be waived on all occasions and that I certainly would not have bothered with rushed delivery if I was not told that it was being given to me free to make up for the inconvenience of going on from XX/XX/XXXX without a debit card. The manager refused to provide further contact information to dispute the fee saying flatly " the fee is not getting waved '' and going so far as to obviously lie " the computer system has denied the waiver and it can not be changed. '' I understand that the {$15.00} fee may seem trivial, however, I think this case is quite extraordinary in how blatantly unethical it is -- violating a guarantee given to a customer and going so far as to almost flaunt how powerless I am to appeal.

Consumer Complaint: On XX/XX/2022 approximately somewhere between XXXX and XXXX XXXX I was called after I had received a text saying do you approve of this XXXX transaction of {$3500.00} I replied no and got a phone call right after saying this was Bank of America, fraud protection, and if I approve the XXXX transaction, I stated that a do not approve the transaction and to stop it. They asked me to open up my app and give them the confirmation number that was done. I stated that I was at work and that had to be done quickly I didnt want to get in trouble for being on my phone, they stated that they would get the funds back into my account at XXXX XXXX that evening. I called them back and asked them about the transaction and where it was that they stated that they dont know what I was talking about and asked if I was scammed I stated that I was and that I needed to have it stopped they said I had to get XXXX authorization form from my phone company make a police report and to freeze the count until they were done with their investigation. Every 30 days I had a peeled the decision that they had made and they kept making me run through hoops after hoop, after hoop, saying that they need this from the Place report they needed the phone company to send a letter stating that the number that had called me was in fact, the scammer who had scammed me out of the money Ive done all I could I have called currency capital of currency. I called the banks over and over again I had to open up a new account. I have done so much more And I still have not received the money back. I have done some research and found that Bank of America has been involved with multiple fraud scammers. I was not the only one people have gone to news stations reported them and have received the money back but I cant seem to get mine back. I have almost lost my house almost lost my car. Im so behind on my bills.

Trying to get my funds back, since then I was denied and then reconsidered the claim then got separated, three were found in my favor, I then contacted CFPB to assist in making an effort to reason with Bank of America card holder and still no results, I am unsure how these decisions are decided but I am ready to seek legal counsel? To get this issue resolved? I've given them a police report ive gone inside the bank and sent copies of my social security card, ive even given them a name who I thought it could be that has done this to me and still nothing.
