Consumer Complaint: Bank of America Forged financial documents when we applied to refinance our loan in 2008. We where unaware they did this until recently. Bank of America then tried to foreclose on our home based off of forged financial documents and forged signatures. We did not have the assets they claimed we had at the time of the refinancing and we were never given any of those documents. Bank of America then placed over XXXX in fees to our original mortgage of XXXX making our loan over XXXX off of a forged refinancing loan. We ask that Bank of America place our loan back to the original amount and take off all of the fees they placed after forging and lying on our refinancing loan. Ho is Bank of America allowed to get away with breaking the law and adjusting loans based of forgery and deceit? We want our loan to go back to the XXXX and all the fees placed to be taken off.

Issue: Getting a credit card
Subissue: Card opened as result of identity theft or fraud
Consumer Complaint: In XX/XX/XXXX, Checking, Savings & Credit Card were opened from Bank of America online in my name. Then a cash advance was taken out on the credit card in the amount of {$1400.00} & mailed to my address. B of A states the cash advance was mailed to me because they ( B of A ) detected suspicious activity and closed the checking and savings account so the check/cash advance needed to be mailed since there was no where to deposit the money. I received the check and since I knew I did not open any accounts from B of A I kept the check in my stack of documents I began collecting from B of A and wrote the words " VOID '' across the check. I began working with XXXX XXXX XXXX ( XXXX ) and together we called B of A multiple times on different days and at different times and were continually transferred, hung up on, sent to the wrong departments and wasted HOURS of my life that I will never be able to get back. No one could help us so XXXX suggested that I go into a local branch of B of A that they should be able to help me. The only thing that was different was that the Relationship Manager that assisted me ( XX/XX/XXXX ) called and was told that I needed to deposit the cash advance check of {$1400.00} back into the credit card to get anything done. They would not accept my check since the word " VOID '' was written across the check. So B of A had to create another {$1400.00} cash advance check and mail back to me again. I received the check in the mail, went back to the local bank ( XX/XX/XXXX ) and had the same Relationship Mgr. deposit the {$1400.00} check on the credit card account. The Relationship Mgr. called & spoke with someone in the collections department and they stated that the late fees and interest charges along with derogatory marks on my credit should be corrected and this should take place in 2 weeks and I will receive a letter in the mail stating this. Instead of any of this happening I received a letter stating that B of A is " unable to complete your request '' and provided a phone number to call to receive an explanation. I called the number ( XX/XX/XXXX ) and no one can help me and I have derogatory marks on my credit and the fees and interest charges continue to add up. Now B of A has sent my balance due ( XXXX ) to a debt collector ( XX/XX/XXXX ) and they are trying to charge off my debt. I have filed a police report, report the information to the FTC and am in the process of also filing a complaint to the XXXX XXXX XXXX.

Consumer Complaint: On XX/XX/023 I applied for an Auto Loan with Bank of America in which they denied me an extension of my credit for {$30000.00} for a Truck with 60 Month Term. This violates my rights as I am a consumer and natural person. This adverse action against a consumer is against the law according to the Equal Credit Opportunity act which is codified in 15 USC 1691c and is pursuant to civil liability under 15 usc 1692k. You are subject to criminally liability for violating 15 USC 1691 as I have Proof that I was discriminated against by Bank of America due to the response I received. Bank of America is in violation of 15 USC 1642, USC 1681m and 12 Cfr 1002 because I, the consumer made an application in good faith, but credit was not issued. Furthermore, because my social security number ( credit Card ) was used and I received No benefit. This is more proof of Fraudulent activity ( unauthorized use of credit card ) on behalf of Bank of America. If Bank of America fails to make any reasonable procedures to resolve this matter and compensate me for the use of my credit card I will indeed make Bank of America criminally and civilly liable for all actual damages pursuant to 15 USC 1681n and 15 USC 1681o.

Subissue: Card was charged for something you did not purchase with the card
Consumer Complaint: In XX/XX/XXXX, we stayed in XXXX to attend the XXXX XXXX. Shortly after the trip, charges from XXXX started to appear on my credit card. I immediately reported the card as compromised to Bank of America and filed a fraud claim. There were three fraudulent charges made : XX/XX/XXXX XXXX XXXX {$290.00} This has been refunded XX/XX/XXXX XXXX XXXX XXXX {$300.00} XX/XX/XXXX XXXX XXXX XXXXXXXX {$400.00} After waiting for over a month, I called to see what happened to the two charges made by someone at the XXXX. The person on the call said the claim got stuck and he was restarting it. I waited another month and nothing happened so I called BofA back again. This time, I complained that the I was being charge interest on those charges because they were still being reported as part of my balance. I also complained that the balance reported to credit bureaus was not accurate and was affecting my credit. The person told told me she would issue an immediate credit for {$710.00} plus any interest I was charged since the fraudulent charges occurred. As of today, there has been no adjustments made and BofA is not taking the necessary action. They are also nearly impossible to get on the phone.

I contacted BOA in XXXXXXXX After repeated calls they assigned me case number XXXX. On XXXX XXXX XXXX I was told that they were unable to locate any information under the above-mentioned case number. They repeatedly told me that they can not open a claim unless we can verify the signatures on the check. They finally sent us a copy of check at the end of XX/XX/, which did not bear signatures of the payee and was not deposited into payees bank account. Finally, they opened a claim on XX/XX/ and assigned me claim number XXXX. They then asked us to request an affidavit, which we did and returned the affidavit to BOA. On XX/XX/, BOA sent me a letter stating that they can not process the claim because the claim was filed more than a year after the unauthorized transaction, which is incorrect. On XX/XX/, BOA sent me another letter stating that they can not process the claim because the claim was filed more than 60 days after the unauthorized transaction, which is incorrect.
