Issue: Managing an account
Subissue: Funds not handled or disbursed as instructed
Consumer Complaint: Went to Bank of America in XXXX Florida. Spoke with a banker who provided me with the phone number XXXX. I spoke with XXXX who informed me that my case was close in regards to handling my brothers estate due to another individual coming into the bank, and claiming relations to my brother XXXX XXXX. The probate team for bank of America claimed that a granddaughter claimed his assets. My brother does not have any children and never had a spouse. I provided Bank of Americas probate team with my certified documents that I have attached to this complaint. Bank of America stated that it will take them a week to verify the validity of my documentation. I followed up with them on the following Wednesday, which was XX/XX/2023 and they confirmed the validity of my documentation, but was not able to provide me with any additional explanation as of what took place with his funds and what the next steps will be. I followed up again on XX/XX/XXXX and I spoke with XXXX, who stated that they will mail me some sort of documentation. I did receive a notice from Bank of America not necessarily, addressing any of the questions asked, but stating that they have received my request and the accounts were close. The documentation did not address who the funds were provided to, no guidance on if I need to do any type of FDIC claims, and no inclination of how his assets will be retrieved. There are a couple of accounts that are involved a checking and a savings account at Bank of America and the account numbers are XXXX & XXXX. At this point, I feel like Bank of America is giving me the runaround and avoiding the problem at hand, which is what happened to the XXXX XXXX dollars in his accounts. I took the liberty to attach the documentation per your investigation. Thank you in advance.

Subissue: Account opened as a result of fraud
Consumer Complaint: Bank of America opened a checking account in my name without me requesting this account. Around XX/XX/2023 I received an email stating my new account has been approved. I never applied for an account. I called their fraud department on XX/XX/XXXX to report the fraud. I called back again on XX/XX/XXXX to follow up. I was assured that the account would be closed following an investigation. On about XX/XX/2023 I received in the mail a new debit card for my account with Bank of America. I tried calling the fraud department back again but whenever the line picks up it just goes dead. I have never had an account of any type with Bank of America.

Consumer Complaint: The presence of a derogatory rating on my account is causing me great concern. I am deeply worried about the impact it may have on my credit. It has already led to the denial of a recent loan application and an increase in the interest rates on my existing credit accounts. I want to emphasize the severe financial and emotional distress that this negative rating has caused me and will continue to cause until it is resolved.
