Issue: Managing an account
Subissue: Problem using a debit or ATM card
Consumer Complaint: My checking account was hacked through the use of a cloned ATM card issued through Bank of America. Over {$1400.00} unauthorized charges were made on my card. In addition, on XXXX occasions someone deposited a payroll check for {$600.00} in my account which did not have my name anywhere on it. This was XX/XX/XXXX. But on XX/XX/XXXX, the bank reversed the deposit because of fraud. Then the same check was deposited again on XX/XX/XXXX and reversed on XX/XX/XXXX. The person had to be in possession of a cloned card because my card was NOT stolen to my knowledge. But someone made charges and withdrawals which were out of character for my account. Although the charges may have been seemingly legitimate, they were not made or authorized by me. The temporary credits Bank of America made were all reversed on XX/XX/XXXX. That account had already been made deposit only and a new checking account and ATM card was issued. Because it takes 2 months for a change in direct deposit, my social security and XXXX XXXX check are still deposited in the old account until XXXX. With the negative status of my old account, my entire XXXX XXXX check was absorbed. Also my payments for life insurance, car insurance and several utilities were reversed. With only funds from my Social Security check available, I was able to pay my rent of {$910.00} leaving me only {$16.00} for the month. At he age of XXXX, maintaining my life insurance policy is critical to my financial stability. Bank of America said I authorized or gave my card to someone to create those charges. But no me is authorized on my account. I have been a good customer for over a decade. Nothing like this has ever occurred before. This financial status is a threat to my health. As a XXXX year XXXX survivor, require medical equipment and medication to deal with damage from XXXX. I do not suffer from XXXX or XXXX. I know my card was always in my possession. So a cloned card is the actual culprit. I need my claim reinstated and all funds including my XXXX XXXX check must be returned so I can correct my financial situation. A Bank of America representative said to get a loan. How can I get a loan with a balance of less than {$20.00} and no further deposits until XXXX.

Next morning I found more fraudulent transactions. I called the bank again and they said they will take care of everything. In the meantime all my money were transferred to fraud account.

Consumer Complaint: Im requesting some assistance on a bank draft I deposited into my Bank of America checking account. I was told that a portion of the check would be available next day, that is also written on my deposit slip. The next day, it was not available in my account. When I called BOA they could not give me a reason why, when I asked when it would be deposited they said we can not tell you that as we do not know, possible 7 days due to the hold. I requested why it was held, and asked for more details. They said they do not know why exactly there is a hold. This check was written on a bank draft, which is guaranteed funds from a XXXX XXXX account. Ive spoken to BOA every single day since Ive deposited it, they still have not given me a reason for hold, or a possible check clearing date. They refuse to release the partial amount that was written on my deposit receipt/slip.

Consumer Complaint: I had contacted Bank of America recently regarding a fraudulent transaction that occurred on XX/XX/XXXX for the amount of {$210.00}. I never authorized this transaction or the merchant to bill me for this amount nor am I familiar with the merchant/business. I had just gotten a resolution letter from the bank stating that the claim was denied due to the face " Payments were made to the account and statements were mailed '' as a reason for validating this purchase. This bank has already been a pain to deal with ever since I've opened my account with them, I've been regretting ever getting in business with them as they're being recently paying fines for violating the law several times. I've been unable to view any mail as I mentioned to BOA in a separate correspondence regarding my credit limit decrease that I've been facing financial and mental difficulties due to my husband being hospitalized and then passing away unexpectedly causing my card to go past due and to incur fees and transactions that I haven't been able to look. Now they're forcing me to pay for a transaction that I never authorized due to the simple fact that " A statement and payments were made to the account ''. I never looked at my statements and lost track of my finances and when I found out my account was past due and at risk of closure I immediately paid the account no questions asked which I then later reviewed and called in the fraud department to investigate and inquire about this,

Consumer Complaint: The existence of a derogatory rating on my account is causing me significant concern. I am deeply worried about its potential impact on my credit. It has already resulted in the denial of a recent loan application and an increase in the interest rates on my existing credit accounts. I want to emphasize the severe financial and emotional distress that this negative rating has caused me and will continue to cause until it is resolved.

Issue: Problem when making payments
Subissue: Problem during payment process
Consumer Complaint: On XX/XX/XXXX, Bank of America deducted {$16000.00} from my XXXX XXXX checking account, the full balance amount of my credit card balance via auto-pay deduction. This essentially zeroed out my bank account balance. I contacted both XXXX XXXX and BOA to as the auto-pay was supposed to only cover the minimum payment due ( I couldn't confirm the setup details of the auto-pay as I set it up before the balance hit my account statement and BOA doesn't allow you to click into auto-pay details if you don't have a balance due ), the payment was adjusted and I was refunded the amount minus my minimum payment on XX/XX/XXXX for a total of {$16000.00}. I was assured by BOA that my auto-pay covering the full balance due was canceled and I would just have to login to set up a new auto-pay for the minimum balance due. However, I would have to wait until balance was reapplied to my XXXX statement since you can not view or edit auto-pay with a XXXX balance statement and the XXXX statement still reflected my full balance payoff of {$16000.00}. On XX/XX/XXXX, a new withdrawal was made from my checking account for the full balance of {$16000.00}. I immediately contacted BOA that this was another error. I was informed that I was originally told the incorrect info, it wasn't possible for auto-pay to be cancelled on the banks end and that I would have to login and edit the auto-pay once the payment was reversed and that I would have to wait again until the following months statement posted in order to have a non-zero balance which would allow me to edit the auto-pay. They would also reverse the deduction and had me confirm account number and routing info for my XXXX account to ensure that BOA has the correct information to reverse the payment. However, I instead of reversing the whole amount or adjusting the original deduction, the amount that they determined that they would refund me is {$16000.00}. I received a letter dated XXXX confirming the refund approval for {$16000.00}. BOA also separately processed a payment of {$350.00} from my XXXX account dated on XX/XX/XXXX. I was informed that the refund would take up to 10 business days to show up in my bank account. While the balance has been applied against my BOA credit card amount, I never received the funds in my XXXX account. Following those 10 business days, I still haven't received the funds and have called multiple times. BOA has assured me that the funds have been transferred back, however, when I escalated to a manager, they mentioned that somehow the transaction was placed back into a review stage AFTER the refund was approved and the XXXX approval letter was issued. Not only is the amount not refunded to me, the prior rep lied as the manager was able to remove/delete the auto-pay from my account. However, since all of this has occurred, the account was also showing that my payment was past due and I was being charged an additional late charge of {$40.00}. This manager said that the account wasn't taking note of the {$350.00} payment and that she would have the late fee and overdue notice removed from my account, this would be reflected on the account within 48 hours ( it has been over a week and still nothing has changed ). Also, she would stop the original refund, reissue it and funds would be available within 10 business days, although she put a rush on the request. I still have not received a dime from BOA but I've been credited the whole amount of the debt on my statements. I have finally reached out to resolve with XXXX, who can hopefully reverse the original transaction. However, I've had an empty bank account since the end of XXXX due to either ineptitude or fraudulent information provided by BOA each time I've contacted them.

Consumer Complaint: I already have a case with CFPB. It's been over 15 days and I haven't heard anything. Actually it's been well over 2 years since I made the initial claim. Money was stolen from my account and if you look at the name of the person who stole it and you'll see he's since been arrested for fraud. If you look at the transactions my understanding is that he used XXXX XXXX and paid from an account that is clearly not his both XXXX account and bank account. I have requested a new card and they have not sent that or corrected the issue nor have they communicated with me

Subissue: Card was charged for something you did not purchase with the card
Consumer Complaint: There was a charge on my CC for {$1600.00}, when I noticed the charge I immediately called Bank of America informing them I did NOT make the purchase & that I was driving ti my house in Michigan on said date & only stopped at a XXXX XXXX XXXX XXXX XXXX XXXX XXXX in XXXX XXXX. Says Transaction date was XX/XX/XXXX at a New/Used Car/Truck dealer online. I confirmed w/ my Husband and he also did NOT make the purchase, prior to calling Bank of America . We have 3 OLD Cars w/ no car notes. I have a XXXX XXXX XXXX Original owner & my Husband has a XXXX & XXXX ( unsure of his purchase dates off hand, but was NOT this year! ). When I looked up the website claiming I made the purchase it looks fake, barely anything on the site, I emailed them with NO RESPONSE, no other way to contact them other than their site that says so, but only through there and doesnt provide the email to me. No phone number. When I looked up the address ( XXXX XXXX XXXX XXXX XXXX XXXX XXXX, which I have NEVER been to in my LIFE! ) affiliated with the purchase it is a Residential area. I have absolutely NO IDEA what the purchase even was, because it wasnt me or my Husband. Where were the goods delivered they claim I bought? I only have my XXXX in XXXX XXXX that has a XXXX doorbell camera & my XXXX in XXXX XXXX area that has a Package room. I told BOA this and they made a claim. As of this Friday they put it back on my CC claiming the merchant claims it was me. I am LIVID & requested they reopen, which they did Claim # XXXX I made an appointment tomorrow to go into the branch in person. This purchase was not me & Im willing to pursue charges on this merchant, as well as BOA if they do not rectify this situation. I have absolutely no reason to lie. The customer service representative stated Based on my purchase history they arrived at the conclusion it was me. WHAT?! Thats exactly what I said LOOK AT MY PURCHASE HISTORY! I buy for my current Homes & Cars, THATS IT! If/when I get another car it will be NEW & NOT USED! I do not understand how they can claim I made a purchase I do NOT have the goods for. So NOW he said theyll send me the merchants claim-proof, which I will then go file a police report. I have no idea who these people are, what the website does exactly, what theyre claiming I bought for {$1600.00}! But I will fight this until the end. PLEASE HELP ME!
