Consumer Complaint: Cashier's check from a local credit union in XXXX AZ was deposited on the evening of XXXX XXXX via ATM at Bank of America in XXXX, AZ. The bank sent a notification via email stating funds would be available for withdrawal on XXXX XXXX XXXX XXXX XXXX XXXX. The funds were not made available and after contacting Bank of America they stated funds would be available on XXXX XXXX XXXX I asked why the notification would state XXXX XXXX and they advised it was a mistake. The item in question is a cashier's check. Funds have not been made available and no other notifications have been received. The bank will not honor theirfunds availability notification we received. Federal regulations state that cashier's check money should be made available to the depositor. Regulation CC (12 CFR 229) implements two lawsthe Expedited Funds Availability Act (EFA Act), which was enacted in XXXX XXXX and became effective in XXXX XXXX, and the Check Clearing for the 21st Century Act (Check 21), which was enacted in XXXX XXXX and became effective on XXXX XXXXXXXX XXXX. The regulation sets forth the requirements that depository institutions make funds deposited into transaction accounts available according to specified time schedules and that they disclose their funds availability policies to their customers. It also establishes rules designed to speed the collection and return of unpaid checks and describes requirements that affect banks that create or receive substitute checks, including requirements related to consumer disclosures and expedited recredit procedures. Regulation CC contains four subparts. The first three implement the EFA Act, and the fourth implements Check 21. Specifically, Subpart ADefines terms and provides for administrative enforcement Subpart BSpecifies availability schedules, or time frames within which banks must make funds available for withdrawal; also includes rules concerning exceptions to the schedules, disclosure of funds availability policies, and payment of interest. After speaking to multiple supervisors (XXXX XXXX XXXX XXXX and a few others, and pending close to three hours on the phone, the bank representatives 3 of which are supervisors could not provide an explanation as to the delay of funds and said nothing more could be done. The funds would be available on XXXX XXXX. I asked to speak to their legal counsel or compliance department and they said they did not have a department available to them and we were done with the call.

Consumer Complaint: I received a copy of my XXXX XXXX and XXXX XXXX XXXX consumer report and I've noticed false and misleading information from Bank that I've committed allege fraud. On behalf of disputing the inaccurate information with XXXX XXXX and XXXX XXXX XXXX they have concluded that the information within my file has been investigated and was indeed verified as accurate by BANK OF AMERICA. Both corporations have also confirmed that they are unable to provide me with copies of documentation of proof on how the information is accurate and verified in my file for checking account fraud that is being furnished to them by Bank Of America. On XX/XX/2023 I've sent certified mail with return receipt, Tracking number is XXXX. I am yet to hear a respond and the investigation and any proof supporting their claim of the allege fraud. This is causing me great stress and defamation of my character. I have attached two letters supporting my case for this specific situation to get resolved.

Consumer Complaint: IRS - fraudulent account made in my husbands name In early XXXX, I received a notice for a Bank of America credit card that I had no knowledge of. I first visited the local Bank of America to see if they could find out for me what was going on. They could only tell me that it was a legit account. When I called the Main office, I got nothing but a run around from them. The only thing I found out was that the card was apparently taken out by my late husbands name back in XXXX. I was told I was also on it as a user on this card.The strange thing is, I have had no knowledge of this, no monthly bills, no correspondence of any kind under that card. We did have two other cards with that bank so they definitely had access to all the pertinent information to creat a new card. They also had records of {$600.00} and {$700.00} dollars on the account. In XXXX, my XXXX daughter was born and we were living on my teaching salary and a small sum from the VA. Not long after that we purchased our first house. Nowhere on our credit reports did this card show up. In the lattter part of XXXX we looked into buying our forever home. This time we were getting a VA loan. If you know anything about that, you must know that you have to have all your ducks in a row financially or you do not get the loan. Again nothing showed up. During the years from XXXX we have purchased several cars and a cottage down in XXXX XXXX XXXX Again nothing showed up about this account when doing the financing. In XXXX, we worked with XXXX XXXX XXXX so that we could get all of our credit cards paid off. When they pulled up our credit report, nothing showed up at that time either. They were all sent letters asking if they would agree to work with this company and us and because we had two other cards with Bank of America I would have thought that it would come up then, but no questions from Bank of America at that time on this account and why it was not included. I have worked with the Fraud Department of Bank of America and they insisted that it was a legit account, but could not give me answers as to why I have never had any correspondence from them. I received notice of cancellation from the Bank in XXXX. At this point I also sent in a complaint to the IRS Fraud Dept., but because Bank of America says its legit, it is legit. I am now charged with {$9000.00} in back taxes on an account that is not mine. This is really a summary of what has gone on and it is stressing me out and effecting my health. Please any help you can give me will be greatly accepted. Im at a loss for what to do next. I should not have to pay for something that is not mine. Consumer Complaint: Bank of America has unlawfully charged me monthly maintenance fees on my two UTMA custodial accounts for my minor children. Ive been repeatedly charged $ 12 monthly maintenance fees for both of my UTMA accounts over several years. Ive tried to have this issue fixed several times but the waiver of being a minor has not been placed correctly and we continue to be charged on these two UTMA accounts, Id like all fees returned for both custodial accounts as this practice is unlawful. Ive called in several times and also gone into branches, Im told its fixed then it starts again. Originally I was told a {$25.00} weekly transfer will waive the fee but the accounts are UTMA accounts and dont require a minimum amount. It seems to be the wrong account type has been the issue and bad information has caused this issue.

Consumer Complaint: On XX/XX/2022, I called Bank Of America to find out my debit card balance from my XXXX XXXXXXXX claim. I was told I had a balance of {$2100.00}. On XX/XX/2022, I went to the Bank of America ATM in XXXX, CA to withdraw the {$2100.00} from the account. To my surprise, the money was not there. I called Bank Of America and was informed that the {$2100.00} was transferred to another account. I informed the Bank Of America representative that I did not transfer the money nor did I authorized anyone else to do so. I was informed that Bank of America would issue a new debit card but I would have to speak to EDD about replacing the {$2100.00}. I spoke to EDD and they informed me that once the money hits the bank, it is considered paid and anything that happens to the money thereafter is not their problem. EDD suggested I file a police report which I did but my local police department could not do anything about it. I have also filed a complaint with the internet crime complaint center but I have not heard from them yet. That complaint was filed on XX/XX/2022. Since then, I have not been able to recover the {$2100.00}.

Consumer Complaint: On XX/XX/2023 I got paid and received son 's XXXX, I paid rent at our new apartment at the XXXX, XXXX, Texas had to use checking account and routing number otherwise there is a large fee for Debit card use. The amount was {$890.00}, my balance was {$1500.00}, I also paid my electricity bill with XXXX XXXX {$65.00}, XXXX {$69.00} and XXXX XXXX XXXX ( Gas ) {$62.00} and credit card {$30.00}. Bank of America processed the same day, XXXX XXXX and XXXX but they did not process my rent, gas or credit card payment and on XX/XX/2023 a payment hit my account I did not authorize from a company called XXXX for {$200.00} & {$200.00} a total of {$410.00}. I immediately contacted BOA the morning of XX/XX/XXXX when I discovered this merchant posting and filed a claim, it was pending still. The agent said she'd stop the payment and file a fraud claim and I'd get a temporary credit. Today, XX/XX/XXXX, I looked at my account and my bills had processed, my rent, gas and credit card and I had {$46.00} in my account, I went into the lobby of the BOA here in XXXX, Texas, XXXX, Texas near my new apartment and withdrew {$20.00}. I knew my balance was low but I was happy my bills were paid. I paid them all on the XXXX but XXXX XXXX, any holiday, BOA messes up processing some payments. I contacted XXXX the merchant and told them I never gave them authorization to charge my account and she said it was from when I put in information from old school bookstore account and that my rentals were late. I told XXXX, XXXX that I used a Book Voucher of {$300.00} my Financial Aid at school ( XXXX XXXX ) and we had the option of keeping our book which total about {$200.00} for two books or less, but now the school has taken down the XXXX website because XXXX bought them and the rules are different. I don't see the FAQ that provided previous information nor my account or order history. The XXXX said they'd charge my account 4 times and they don't make the prices of textbooks but online new information it says if lost or stolen the books would be upto 75 % and 7.5 % late. Then she said they already were paid the {$410.00}. Now at XXXX BOA sent me an email saying my Rent payment, previously processed today XX/XX/2023 would be returned and I'd have a negative balance. Meanwhile the credit is still their from the fraudulent payments of {$410.00} but they're going to let my rent payment bounce and I paid all bills on the XXXX. We just moved here XX/XX/2023 to an XXXX unit for my XXXX son, I am his caretaker and we can't be late on rent and rarely if ever are. BOA does this all the time they take days to process payments but if I go to XXXX or XXXX 's and use my Debit it comes out immediately. So please help. Seems as though they are trying to make us pay more.

Consumer Complaint: Received first phone call from XXXX ( saved in my contacts as my Bank number ) at XXXX, informing there was fraudulent activity of someone trying to open an account in XXXX XXXX and performing XXXX XXXX. They gave me a cancellation code and said another rep from the XXXX department will call to get information in order to help track the fraudulent activity. Received another phone call from same number at XXXX. " Agent '' introduced himself as XXXX XXXX ID # XXXX, explained there were 2 transactions that were placed in my name. He instructed me to send money to " XXXX '' and " XXXX '', the first for XXXX and the second for XXXX. This had to be done this way to track the fraudulent activity. He was very aggressive and made me very nervous- at one point I asked him to hold and I called my bank on husband 's phone and when I hung up to get a phone call back he said that he could see in his system that I had called and that sinceI requested to speak to another agent, he would have to hang up and my account would be unsecured. Told me to not access the account for 24 hours. Called me the next days but when I confronted him he hung up.

Consumer Complaint: I opened a Bank of America Customized Cash Rewards credit card. The company does not allow you to set up autopay or pay your credit card bill online without a checking account. To open a checking account, I must enroll in direct deposit or maintain a minimum balance of {$1500.00} ( for the Advantage Plus account, the lowest option assuming one is not a student or under XXXX ). My complaint is that commonly accepted payment methods such as autopay or online payments are directly linked to opening a checking account. This was NOT disclosed in the terms and conditions during the application process or in the cardholder agreement. This is an underhand way to charge credit card customers with an existing primary banking relationship a {$1500.00} fee for using the credit card. Additionally, the {$1500.00} minimum checking account balance accrues no interest which creates an opportunity cost ( XXXX is currently at 5.31 % ). Bank of America has a clear incentive to undertake this scheme. The company is experiencing higher deposit costs and deposit outflows amidst rising competition from alternatives such as Money Market Funds, High Yield Savings Accounts, and Treasury Bills. Non-interest bearing deposits are Bank of America 's cheapest form of funding. The more customers it can force to open non-interest bearing checking accounts, the better the company 's financial performance will be.
