Consumer Complaint: Discovered fraudulent transactions on my account in which someone hacked into my XXXX. They then used my account to siphon funds from my account. Upon discovery of this I notified Bank of America, provided a letter from XXXX whom also confirmed this was fraud. I provided Bank of America with a case # for XXXX as well as a letter indicating it was fraud. Even after providing compelling evidence, Bank of America continues to refuse to honor their XXXX $ fraud protection. I have also spoke with the payment processor company XXXX who also confirms fraud, sent me a letter as well and indicated Bank of America absolutely has the authority to recover my funds and refuses to do so.

Consumer Complaint: Back in XXXX of this year, Bank of America began charging me fees of {$25.00} a month for my " advantage with tiered interest checking '' account. I have had this account since XXXX and never paid fees, it existed prior to their preferred rewards program. When I called to resolve this issue, the representative said she would be able to reverse the fees. I immediately saw a {$50.00} credit, but she said she had made an error on the third fee, but had resubmitted it and I should see it process in 2-3 business days. Their explanation for the appearance of the fees was that my average daily balance had dipped below the $ XXXX required for the preferred rewards program and without that, I no longer qualified for waiving the maintenance fee. I questioned why my account would have a maintenance fee for falling below $ XXXX when the terms for an " advantage with tiered interest checking '' it states : " {$5000.00} or more average daily balance in checking or linked Regular Savings '' This particular checking account does not often have $ XXXX in it, but I have several other accounts at BofA and combined, they are always well above that threshold. I made a followup call inquiring about the remaining {$25.00} that was not refunded and eventually spoke to a supervisor who assured me they would review the phone transcript and refund the {$25.00} if the representative had indeed promised I would get the refund, this was XX/XX/XXXX. Today, I was checking to see if there was any change in the account and see that the account was changed from " advantage tiered checking '' to " advantage relationship banking ''. This was not a change that was discussed with me and I did not authorize it. This is an account type that is no longer available and I am upset that it was changed without my consent because the required daily balance to avoid fees for " relationship banking '' is double ( $ XXXX ) that required for " advantage tiered checking '' ( $ XXXX ). In addition, they are telling me that they " reviewed '' the case and will not be refunding the {$25.00} fee from XXXX, despite the supervisor on XXXX and the rep on XX/XX/XXXX telling me they would refund it. The supervisor also told me that in his system, my account has been advantage relationship banking as far back as XXXX, which is completely false. Consumer Complaint: I am apart of a group of women who collect XXXX cups from all over the world. We pooled our money to purchase cups from oversea sellers for preorders. On XX/XX/XXXX, I paid 50 % deposits ( {$1500.00} ) to XXXX XXXX XXXX via XXXX ( XXXX ) because this is a presale meaning that I must pay the items 6 months in advance before the item is release. She ensures me that all the cups that are preordered will be secured if we paid the total amounts that we placed the orders. She sent me the invoice for {$3000.00} but I paid {$1500.00} ( including {$4.00} XXXX fee ) so I only had to pay {$1500.00} by XX/XX/XXXX. Fast forward to XX/XX/XXXX, XXXX XXXX sent me the tracking for 51 cups, but only to find out that the tracking ( tracking # XXXX via XXXX ) was never updated because every week I have been tracking the package since she gave me and as you can see that tracking is false. It keeps saying Shipment Information Received, meaning that the package never left XXXX nor XXXX house. She told me that XXXX going to get an email from XXXX about the package and I never gotten any of those in my email nor text messages. And because of this, I have asked XXXX to cancel the orders and refund me my money except she never responded, however I have been hearing from her sister-in-law and her closest contact, she said that she refused to send refunds to anyone who annoys her so like me. Im getting screwed by XXXX. Before going through my bank, I have called XXXX to help me filed a chargeback for this transaction and they said that because it is out of 180 days, they cant do anything and was told I must file it with my bank. Even before XXXX, I have tried reaching out personally to XXXX by calling and texting whether thats through XXXX XXXX or XXXX, and she stopped responding to my messages in XXXX. Yes, to banks, this amount ( {$1500.00} ) is a small amount but as for me and my clients, this is a huge amount, and it is our hard-earned money that we used to pay to secure the cups. Since I have had no communication since XXXX, my family and I hired a private investigator to go to her address that I have on file, and the private investigator told us that the house looks beaten down like no one has lived there for over a year. I am not the only person that XXXX XXXX is scamming. There are so many people that is willing to help me to get the written statements from them to help me with my case that I will be attaching here as part of my case for you guys to listen and for my voice to be heard. On top of that, I also found out that XXXX XXXX has run away to her parents house in XXXX, XXXX and stopped communications altogether. We also filed a police report and the police sent XXXX letter to respond, and she hasnt responded to that police letters. You can see that I have taken many steps before reaching to my bank to assist me, trying to refund the money ( {$1500.00} ) that XXXX refused to send a refund. I hope you guys understand and reconsider my case again, but this time favor my side especially when you see the documentations that Im attaching you and you guys will realize that I am not the only p7erson that she personally scam. Theres a group of us. You can see here that she promised many of her clients that she was going to refund on XX/XX/XXXX which was very well within XXXX 180 days scope to get the money back, but never did and this was the last conversation that we ever heard from XXXX XXXX. Thats the only reason why I didnt file a claim because she made an agreement with me to post and when I followed up with her, she disappeared. During that time, I went through a lot of things ( i.e. XXXX and XXXX ) because Ive been a victim of harassment and racially profiled because Im XXXX from my previous employer and until this day, Im still trying to find a legal aid service / lawyer that can take my case on because they screwed my final paycheck on my last day of the resignation.

They charged me several overdrafts fees for funds I had in the bank and when I bought 3 or 4 items then I withdrew a large amount 3 days after I purchased my items they took out the large amount first then charged me 3 or 4 times an overdraft fee several times. Bank of America did that several times while I had an account with them and that is why I switched to another bank in XXXX, I was not allowed to get a checking account due to my history at Bank of America.

Consumer Complaint: I first notified you of the fraudulent activity months ago by a letter sent through the regular mail which you received. I know you received it because you responded telling me you needed me to call. Unfortunately, I travel a lot and calling is not so simple all the time specially, when you give me an XXXX number that doesnt work outside the United States XXXX somebody should educate your staff so theyre aware of that. Eventually, I have time and I call just a few days ago. First time transferred three times. I finally get a woman on the phone is actually able to help. I explain the situation and she wasnt really sure why the fraud claim wasnt processed. But she told me dont worry she understood the situation and that she would make sure that she had all the information she needed and start the investigation. Apparently all of a sudden I got your attention since you havent been able to help for months prior to this. Now, all the sudden after multiple letters telling me to call, you send me a letter bear weigh two days after Ive called and tell me that youve completed a reevaluation of the claim. When did you evaluate the claim to begin with because you never communicated that with me, there was never a credit issued to the account. I want to know what date it is, that you evaluated the claim initially, and how you communicated that with me? And you were able to reevaluate the claim in such a short amount of time that seems virtually impossible. If you have signed contracts I want to see a copy of every single one of them. I want to see my signature on there. Because just because the thief that stole my credit card signed a contract doesnt mean that I signed it. You know this I shouldnt have to tell you this I dont know why youre being so difficult. I am uncertain if you have not just broken the law. Because I did my part and theres supposed to be a XXXX liability for fraud. I didnt have the card in my possession. I didnt give permission to anybody else to use my card I didnt benefiting anyway from the card being used I never signed any contracts nor did my authorized user, we didnt even have the card and from the representative I spoke to just a couple days ago they were transactions in Indiana and Illinois and Tennessee XXXX I mean I dont even know how thats possible to be an all of those places. I guarantee you after this we wont necessarily be closing the account, but we will make no effort to use these cards. You clearly can not be trusted to protect protect your customers when something goes wrong.

Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to ensure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX and XXXX are consumer reporting agencies and I am the Consumer. These agencies have failed to do so. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states " It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services.
