Consumer Complaint: XXXX # XXXX Bank Of America Back in XXXX, this year 2023, I made a deposit on my account. of almost {$4100.00}, of which {$3800.00} and some change was XXXX checks on my brother 's name. Bank of America closed my account and returned the existing balance except the amount of the checks on my brother 's name. I am being trying to get in contact with the department that it does the investigation since they Bank of America treating the deposit as a fraud. Since I made many calls to see were its the money, even I ask to return the money to the company who's issue the checks and nothing it's been done. I need your help to get my money brother 's money back. We work hard to get the money and survive. Bank of America has not right to keep my money. Consumer Complaint: On Tuesday XX/XX/XXXX, at XXXX, I submitted a " Next business day, {$0.00} fee, ACH XXXX XXXX XXXX XXXX cutoff time '' using my personal Bank of America checking account. As of Thursday XX/XX/XXXX, after XXXX, the recipient hasn't received the funds. Have called several times Bank of America and they can not explain the reason why ACH transfer was not received during the promised timeframe by the recipient 's bank, XXXX. Money has been debited from my account as far as I can see in my Online Banking Account. After several calls and speaking with different departments, from Consumer Accounts, to Fraud Department, they always answer mentioning " I am the right person to assist you with this '' and they have not been able to proof where my money is and/or expedite the transfer. Bank of America does not provide you with a proof of ACH transfer showing exact details, account number and/or routing number to be able to track the ACH. I requested for that and they mentioned that will be delivered after XX/XX/XXXX. Also, the status in the Online Banking portal of Bank of America is inconsistent in different views, some showing status as " Cleared '' and other as " In Process ''.

Consumer Complaint: On XX/XX/2023, I requested a credit card payment adjustment of {$1500.00} and {$1700.00} in which I would get both those amounts back to my original payment method and I would have to pay off the XXXX amounts again. On XX/XX/2023, the adjustment was accepted and I was charged {$1500.00} and {$1700.00} again on my credit card ( which is what is supposed to happen ). The problem is that I did not get that amount back to my original payment method. I have contacted Bank of America over and over since then and even visited their branch stores, but they are not able to help me. They even closed my case without a resolution.

Yet they are still sharing my Private information. I never received a disclosure or an opt out notice. Per 15 USC 6801 - 6805 requirements. I never gave Bank of America permissions to share any of my private and transactional information to any non affiliated third parties! XXXX XXXX XXXX is the company that has my transactional and private information provided by Bank of America. Ive been denied access to a new bank account because of your willful ignorance, lack of care and communication. XXXX XXXX XXXX is NOT. an affiliate of Bank of America. Federal non-affiliated definition is companies not related by common ownership or control. They can be financially not financial companies. According to your privacy notice you dont share with companies such as XXXX. They are non-affiliate to your company. This is a direct violation of my right to privacy, Violation of private policy and the terms and conditions. So unless youd rather settle this matter in court while I seek actual damages Id suggest you remove my information immediately and pay to my account {$1000.00} per violation of every MONTH you have shared my transactions and private non-public information! This complaint is my official invoice to you. The total of monthly reporting transactions as of : XX/XX/2023 is XXXX. XXXX monthly reportings is a total of {$33000.00}. Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services.

Consumer Complaint: On XX/XX/XXXX I sent a Bill of exchange payment of {$3400.00} by Restrictively indorsing the coupon they had sent me in the mail and sent this instrument to the payment address on the coupon. ( Image 1 ) has the tracking information. I attached a cover letter ( Bank of America XXXX XXXX XXXX ) explaining the process and if they needed further information who they can reach out to. After not hearing back I decided to call Bank of America on XX/XX/XXXX and they told me that they did not receive any payment. I explained how I sent a valid payment to the address on the coupon. They told me to call back later to see if it would update in their system. I called back on XX/XX/XXXX and they said that they had not received payment or that it was lost. I then explained that if you guys lost or destroyed my payment per XXXX XXXX the amount due must be discharged. They did not discharge the debt and said that I was incorrect. I then sent another payment of {$3500.00} Registered mail to CFO XXXX XXXX with no response ( Image XXXX ). I was then notified that my account was closed on XX/XX/XXXX without my authorization. On XX/XX/XXXX I then sent Bank of America a Notice of Claim letter, my Power of Attorney document, and the contract for my credit card account. ( Bank of America Notice letter 1 ). I did this following the Federal Reserve Act section 16 which states that " In no event shall such collateral security be less than the amount of Federal Reserve notes applied for ''. This notice letter is a tender of payment and makes it a collateral security. I did not receive any update ( Image 4 ) tracking information. I was then called continuously by Bank of America saying that I owed a debt that I already paid, which I explained that I had sent them multiple payments. They again said that they did not receive anything from me. I then sent another Notice of Claim letter ( Bank of America Notice letter 2 original ) on XX/XX/XXXX ( image 5 for tracking ). They have not responded to this letter either. They have also reported my non-public transaction history to XXXX, XXXX, and XXXX without my written authorization. Bank Of America has been knowingly and willingly breaching their fiduciary duties and acting in bad faith per Federal Reserve Act Section 29. They are knowingly causing me substantial financial loss and reporting incorrect information to unaffiliated parties.

Consumer Complaint: A person that I had long lived with opened several fraudulent accounts in my name, including with Bank of America. I did not know of its existence until a credit report was run. I then confronted the individual who opened the account. I have disputed the account with Bank of America directly multiple times now, but they are insistent the account is mine. I have requested information that convinces them of this, but they haven't done that. I filed reports with the local sheriff 's department, the credit bureaus, the FTC, and the FBI. By now, most creditors have acknowledged this and closed and deleted the fraudulent accounts from my credit reports.
