First, the XXXX card purchase should have been declined if the account did not have sufficient funds. Consumer Complaint: According to the Fair Credit Reporting Act, 15 USC 1681 section 602 states, There is a need to insure that consumer reporting agencies exercise their grave responsibilities for fairness, impartiality, and a respect for the consumers right to privacy. XXXX, XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isnt shared which is backed by 15 USC 6801 which states It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic information. BANK OF AMERICA is a financial institution by definition under that title. Pursuant to 15 USC 1681a, ( 2 ) Exclusions : ( A ) ( i ) report containing information solely as to transactions or experiences between the consumer and the person making the report ; Reporting Transaction history is illegal. Per 15 USC 1681b Permissible purposes of consumer reports -In accordance with the written instructions of the consumer to whom it relates. I never gave written instructions authorizing the creditor to send my personal information to any credit bureau. The Creditor did not get my consent to add anything to my consumer report, which is a violation of the Fair Credit Reporting Act. -P.L . 90-321 ( 82 Stat. 146 ), states that any agency can only get my consumer report in response to a request by the head of a State or local child support enforcement agency ( or a State or local government official authorized by the head of such an agency ). 15 USC 1681 section 604 section 2 states that In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. BANK OF AMERICA is the financial institution and the Consumer reporting agencies XXXX XXXX XXXX XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX XXXX XXXX XXXX ; Also BANK OF AMERICA, whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unlessthe consumer is given an explanation of how the consumer can exercise that nondisclosure option. BANK OF AMERICA ; Never informed me of my right to exercise my nondisclosure option. Not only that, 15 USC 1681C ( a ) ( 5 ) states, Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. These accounts are adverse items they are reporting again without my permission which is against the law. 15 USC 1681s 2 ( A ) ( 1 ) states, A person shall not furnish any information relating to a consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 USC 1681e states Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX, XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that A consumer may exercise the right to opt out at any time. Consumer Complaint: On XX/XX/23, I made a few deposits via the Bank of America mobile banking app. One deposit was for {$150.00}. I received notice that it was not legible and had been charged back to my account. I tried again to deposit it remotely. It never turned up. On XX/XX/23, my account reflected that the bank withdrew {$150.00}, two dollars less than this deposit. I dont know whether this withdrawal was related to the {$150.00} attempted deposit. On XX/XX/23, I deposited a different check in the amount of {$160.00} remotely. The bank canceled the deposit on XX/XX/23. On XX/XX/23, I physically went to the closest branch. I handed the check and deposit information to the manager of the branch, XXXX. I left the bank, but I never saw it credited so I called BOA. I was told that the check was never deposited. Now, BOA tells me that I have to get a replacement check. The vendor on the check will not confirm whether it has been negotiated and refuses to issue another check. It doesnt believe me. Im in the same position with the {$150.00} check. A couple of months ago, I deposited several checks into the BOA ATM on its branchs grounds. The deposit totaled over {$1000.00}. I hadnt kept a record of the checks, the vendor or the amount. I was unable to recollect less than {$100.00}. The bank manager, XXXX again, told me that the bank has nothing to do with the ATM machines. Further, that they had no ability to contact the owner of the machine. I tried to contact the company I thought was the owner but got no answer.

Consumer Complaint: Subject : Complaint Regarding Unauthorized Withdrawals from Savings Account Dear CFPB, I am writing to file a complaint against Bank of America for automatic errors or unauthorized repeated deductions from my savings account. On XX/XX/XXXX, I manually repaid {$78.00}, but three days later, I strangely received two additional withdrawals, one for {$74.00}. I do not have automatic payments set up, and the balance should be {$78.00}. I promptly contacted Bank of America, but they insisted that I discuss this matter with the security department after XXXX. I expressed my unavailability during the holiday season and requested them to stop the second withdrawal. However, they stated that I must wait three days before contacting them again for a refund. This inexplicable and unsettling pattern of multiple unauthorized debits, coupled with the inconvenience of constant disturbances, is unacceptable. Consumer Complaint: Under the Fair Credit Reporting Act ( FCRA ) sections 602 ( a ), 6801, and 1681, consumer reporting agencies like XXXX and XXXX must handle their duties fairly, impartially, and respect consumer privacy. As a consumer, I have the right to prevent sharing of my private data without consent, as stated in 15 USC 6801. 15 USC 1681 section 604 ( a ) ( 2 ) mandates that consumer reports can only be furnished with the consumer 's written instructions. Financial institutions, considered furnishers of information to credit agencies, must respect customer privacy as per 15 USC 6802 ( b ) ( c ). The FCRA prohibits disclosure of nonpublic personal information without informing consumers of their nondisclosure options ( 15 USC 6802 ( b ) ( c ) ). XXXX and XXXX failed to inform me of this right. According to 15 USC 1681C ( a ) ( 5 ), consumer reporting agencies can not include adverse information without authorization, violating the seven-year reporting limit. Furthermore, 15 U.S. Code 1681s2 ( A ) ( 1 ) prohibits furnishing inaccurate information, and 15 U.S. Code 1681e mandates reasonable procedures to avoid FCRA violations, which XXXX and XXXX are not following. As outlined in 12 CFR 1016.7, I retain the right to opt out of these reporting services at any time, which I am exercising now

Consumer Complaint: These disputes have been escalated several times, and I have provided extensive documentation to support my claims. However, despite my efforts and the escalation of these matters, the inaccurate late payment accounts persist on my credit reports. I was the victim and Im not sure why the CRA is not complying with the law. The other bureaus have followed suit. Im very confused why this one seems to ignore my requests. I am concerned that despite my continued efforts to resolve these issues, the inaccuracies in reporting have not been rectified. I question why your bureau has not conducted a thorough investigation into the validity of the late payment accounts and failed to provide accurate information on my credit reports. The lack of resolution suggests a deficiency in your investigative processes. BANK OF AMERICA XXXX - Those payments were made on time. I am requesting that the late payment markings be updated to reflect my accurate payment history. I am aware that under the Fair Credit Reporting Act ( FCRA ), credit reporting agencies are obligated to conduct reasonable investigations into disputed information. I am troubled by the apparent failure of your bureau to fulfill this obligation, resulting in the continued reporting of inaccurate information.

Consumer Complaint: Bank of America accepted and held funds from the IRS and claimed they were stolen ( Bank of America said the check ( s ) was a fake ) The IRS confirmed the funds were transferred over to the accounts and have not been flagged or sent back meaning the checks cleared Bank of America did receive funds in full from the IRS once the deadline for the hold pasted they froze the account and refused to speak with me and later after three months closed the account and refused to refund the funds to me or the IRS citing that they do not cash third party checks but even with that policy they were supposed to return the funds per their policy. Basically, Bank of America took a total of {$57000.00} which was from both the checking and savings combined each account was credited such as follows the checking 's total was {$28000.00} and the savings was {$29000.00} and Boldy stated that they can legally do so. There is not and never has been any court orders or judgments that they had orders for to take such action and even the IRS stated the funds were issued correctly and funds were disbursed to them without any holds or issues. I have even voluntary provided documentation that it wasn't a third part check ( s ) but the Bak refused to return the money even went so far to report me to the XXXX XXXX for using fake checks which was a lie. Bank of America Closed the account in XX/XX/ stating they were going to send a certified check Never did I receive one upon calling back to Bank of America I was told that no funds will be returned that I can not bank with ever again and the funds will be kept by the bank indefinitely. From the month of XXXX XXXX XXXX XXXX I visited several branches in person all had no way of helping me other than telling me to call the XXXX number where they wouldn't answer simple questions about the account but instead locked me out XXXX online access and told even more lies.
