Consumer Complaint: 1. XXXX XXXX my Account was opened with American Express bank. On XX/XX/XXXX the account was Charged off for the amount of {$1200.00}. 2. XX/XX/XXXX my account was opened with XXXX XXXX XXXX. On XX/XX/XXXX the account was charged off for the Amount of {$23000.00}. This companies are in clear Violation of Language Fraud, Identity Fraud, and the XXXX XXXX XXXX XXXX. Not only did my bank violate the terms and conditions that they granted to me at the time of the account opening. The Credit Reporting agencies XXXX, XXXX, and XXXX have Also Violated my rights as a Consumer and broke the law by doing so. Now According to the Codes and the Federal Trade Commission i the consumer Must give Consent for Said banks and third party companies to use or give out my Private Information. I the consumer must give Consent for the Third party Companies such as XXXX XXXX XXXX, XXXX, XXXX, And XXXX to Report ANYTHING ON MY CREDIT. Per the Fair Credit Reporting Act as a Federally Protected Consumer I Am Now OPTING OUT of ANY & ALL authorization that I the Consumer may have Given you Written, unwritten, verbal or nonverbal per 15 usc 6802. 16CFR 313.13. Furthermore Every 30 days im supposed to receive the Option to Opt Out, which was never Expressed nor sent for me to Properly conduct my Affairs.

Consumer Complaint: I bought a American Express Gift Card at my local XXXX for {$200.00}. I tried to use the card on countless merchants online and the card got declined by each one. I call the American Express Gift Card support and they were no help. They told me the card was activated despite the declined transaction and they advised me to just keep trying at different merchants which was no help because I was already trying that. Now I am stuck with a gift card that wont work.

Consumer Complaint: I I have around XXXX American Express gift cards given to me over the course of 3 years, totaling $ XXXX. Not a single card works for purchases inside stores or online. You call the customer service number, and it won't give you a human to speak to. I found another number for them on XXXX and the representative confirmed multiple cards were active and had money on them. However, when asked what I can do to use my cards, he kept repeating that there is no fraud and that I can use the card in stores and online. I explained to the representative that I was unable to use the cards anywhere, he just kept repeating the same lines about being able to use them in stores or online. He gave no help with how to retrieve the money or fix the issue. I am livid, this was what I was going to spend on XXXX gifts. At this point, they are stealing money and doing nothing to resolve the issue. I've talked to other people, and they've had the same issue with American Express cards. I don't run into this problem with visa gift cards. What can I do to solve things? They aren't giving consumers any choice but to allow them to steal their money. Thank you

Consumer Complaint: I purchased an American Express gift card worth {$270.00} on XX/XX/2023. Tried to use it at 5 major merchants. Each were declined. XXXX, XXXX, XXXX XXXX, XXXX and XXXX. XXXX {$250.00} XXXX {$7.00} XXXX XXXX {$220.00} XXXX {$200.00} XXXX XXXX {$200.00} Each time a transaction was declined I called American Express customer service and each agent told me to try another merchant. They said they were protecting my funds and those are blocked merchants. So try another merchant or wait for 24 hours to try again, ( which I did and it still declined ). No more advice for them. They are all saying the same thing and they also said a refund takes 3-4 weeks to be sent out if I request one.

Consumer Complaint: I the creditor/consumer and natural person was denied credit by American Express when I applied for a American Express gold card. I countered there offer to extend credit to me the applicant/creditor, applicant defined in [ 12 CFR 1002.2 ]. Per [ UCC section 1-201 ( 13 ) ] and [ 15 USC 1602 ( g ) ], I am defined as the creditor and my social security number, which is a credit card per [ 15 USC 1602 ( l ) ] and pursuant to section [ 1602 ( n ) ], I am the card holder. The law clearly conveys that banks can not lend there own money as there is no lawful money in circulation and debts can only be paid in gold or silver. Per Article 1, Section 10 of the U.S Constitution, stating that " No State shall make any Thing but gold and silver Coin a Tender in Payment of Debts. '' And your banking institution is creating credit based upon the consumers signature, taking consumers promise as obligations of the U.S., taking it to the U.S Treasury and then giving consumers their own credits. So pursuant to [ 15 USC 1691 ( a ) ( 3 ) ], I in good faith exercised my right under the CCPA, only to face unjust discrimination of extension of my own credit, a clear violation of [ 15 USC 1691 ( a ) ]. When I provided American Express with my social security number and name that in turn made it a security and the inquiry appearing on my consumer report is evidence that someone got paid. So I hereby put your organization on notice and would like to inform you that I never gave consent to this reporting. This report being furnished by you on my behalf. So I am holding you liable under the Gramm Leach Bliley Act. And I am hereby rescinding your companies right to sale my security to a third party. Adverse Action against a consumer is 100 % against the law according to the Equal Credit Opportunity Act which is codified in [ 15 USC 1691 ( a ) ] and [ 12 CFR 1002 ] and in pursuant to civil liability under [ 15 USC 1692 ( k ) ]. You are subject to criminal liability for violating 15 USC 1691 ( a ) as I have proof that I was discriminated against by American Express due to the response I received. Furthermore, because my social security number/credit card was used and I received no benefit, this is proof of fraudulent activity, unauthorized use of a credit card on behalf of American Express . Your trust indenture, as outlined, appears to involve securities fraud by lack of proper disclosure to consumers as well as other clear violations of sharing my non public information to third parties without my consent, it reads as follows ; The Company periodically securitizes Card Member receivables and loans arising from its card business, including Card Member loans and receivables XXXX, through the transfer of those assets to securitization trusts. The trusts then issue debt securities to third-party investors, collateralized by the transferred assets. Card Member receivables are transferred to the American Express Issuance Trust II ( the Charge Trust ). Card Member loans are transferred to the American Express Credit Account Master Trust ( the Lending Trust, collectively the Trusts ). The Trusts are consolidated by American Express Travel Related Services Company , Inc. ( TRS ), which is a consolidated subsidiary of the Company. The Trusts are considered VIEs as they have insufficient equity at risk to finance their activities, which are to issue debt securities that are collateralized by the underlying Card Member receivables and loans. Details on the principles of consolidation can be found in the summary of significant accounting policies ( refer to Note 1 ). I would like to point out that this is in fact securities fraud. Proper disclosure is not provided to unsuspecting consumers. Our regulators, including regulatory examiners, are increasingly focused on ensuring that our privacy, data protection and information security-related policies and practices are adequate to inform customers of our data collection, use, sharing and/or security practices, to provide them with choices, if required, about how we use and share their information, and to safeguard their personal information in accordance with applicable privacy, data protection and information security laws. In the United States, certain of our businesses may be subject to the privacy, disclosure and information security provisions of the Gramm-Leach-Bliley Act ( GLBA ) and its implementing regulations and guidance. Among other things, the GLBA imposes certain limitations on the ability of a financial institution to share consumers nonpublic personal information with nonaffiliated third parties ; requires that a financial institution provide certain disclosures to consumers about its data collection, sharing and security practices and affords customers the right to opt out of the institutions disclosure of their personal financial information to nonaffiliated third parties ( with limited exceptions ), and requires the financial institution to develop, implement and maintain a written comprehensive information security program containing safeguards that are appropriate to the financial institutions size and complexity, the nature and scope of the financial institutions activities and the sensitivity of customer information processed by the financial institution. Fair Credit Reporting The FCRA regulates the disclosure of consumer credit reports by consumer reporting agencies and the use of consumer credit report information by banks and other companies. Among other things, FCRA places restrictions ( with limited exceptions ) on the sharing and use of certain personal financial and creditworthiness information of our customers with and by our affiliates. The FCRA was significantly amended by the enactment in 2003 of the FACT Act. The FACT Act requires any company that receives information concerning a consumer from an affiliate, subject to certain exceptions, to permit the consumer to opt out from having that information used to market the companys products to the consumer. We have implemented various mechanisms to allow our customers to opt out of affiliate sharing and of marketing by the Company and our affiliates, and we continue to review and enhance these mechanisms to ensure compliance with applicable laws, rules and regulations and a favorable customer experience.

Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the financial institution and the Consumer reporting agencies XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services.

Consumer Complaint: I received an XXXX from my employer as a XXXX bonus gift with a balance of {$200.00}. I tried to use the card at XXXX XXXX week ago and it was declined. Then today, it was declined again when I tried to purchase XXXX pairs of jeans from XXXX for {$90.00}. I called the Amex Rewards Card number ( XXXX ) today XX/XX/23 and spoke to a representative right away. He could see that I was trying to purchase something from XXXX and could see the exact amount, but could not explain why the card was being declined. He told me to " Try it again in a while '' or to " Use the card at a different merchant ''. I told him that I wanted to make a purchase at XXXX, not some other merchant and asked him if there was anything he could do on his end to allow the payment to process. He could not help me and just repeated the previously mentioned statements about waiting and trying again or using it at a different store. This is the XXXX store that has declined the card ( first store was XXXX ), but I did not reach out to the company at that time.
