Consumer Complaint: CFPB LATE PAYMENT There seems to be an error on my consumer report furnished by ( American express and XXXX XXXX ). On my consumer report, there is a late payment reported which is causing me damage to me as a consumer and limiting my ability to extend credit. I allege that ( American express and XXXX XXXX ) is willfully and knowingly furnishing inaccurate information and defaming my character as a form of extortion. According to 15 U.S. Code, A creditor may not treat a payment on a credit card account under an open-end consumer credit plan late for any purpose. According to 12 CFR Appendix B to Part 1022 I never received any the model notices stating that any negative information would be furnished to my consumer report. Why is this inaccurate information being reported when I have never received notice of the information and congress has stated there shouldnt be any late payments? Is ( American express and XXXX XXXX ) attempting to cause some form of harassment to me and violate my right as a consumer purposely? I was never given a reasonable way to opt or limit sharing my creditworthiness according to their privacy policy. Payment defined under 15 U.S Code 78m Payment is define as commercial development of oil, natural gas, or minerals therefore what form of payment has ( American Express and XXXX XXXX ) has been excepting for the last years of under the United States Code it is define as commercial development of oil, natural gas, or minerals? Is there a yield of the investment on the account due to me? Has the true nature and fitness of the agreement been provided to me? The inaccurate, false and fraudulent information being furnished on my personal consumer report needs to be corrected immediately as it is causing damage and defaming my character. I am demanding a response within an appropriate time of 5 business days to answer each concern I have raised in this complaint or I allege that there is a due yield of investment that has been misapplied as a billing error and shall be Returned back to me.

Consumer Complaint: I applied for a Blue Business plus credit card on XXXX XXXX and XXXX XXXX and was denied because Amex said they obtained my XXXX score from XXXX and used it in making the decision to deny me. Adverse action against a consumer is AGAINST THE LAW according to the Equal Credit Opportunity Act which is codified in 15 U.S.Code 1691c and is Pursuant to civil liability under 15 U.S.Code 1692k. Amex is subject to criminal liability for violating 15 U.S.Code 1691 as I have proof that i was descriminated against by AMEX due to the response I received. AMEX is in violation of 15 U.S.Code 1642 .15 U.S.Code 1681m and 12 CFR 1002 because I, the consumer mad an apllication in good faith, but credit was not issued.

Consumer Complaint: I received a call back in XXXX about being past due on a personal American Express credit card. I explained to this company I didn't open, apply nor have any knowledge of this account that was opened. I called a supervisor with AE and was told the account was opened by XXXX XXXX ( My ex-wife ) but my social security was listed. I explained again this was NOT my account. I met with XXXX XXXX and she gave me copies of documents she received and continues to receive about this account. The bills are coming in XXXX XXXX, not XXXX XXXX. I disputed this information with XXXX, XXXX and XXXX XXXX. XXXX and XXXX refuse to remove this from my credit file even after sending in the proving documents. A pre-approved post card was sent to XXXX which is how she applied. A supervisor told me this could have been an error on the pre-filled application. My credit was good with no late payments EVER until this account was posted on my credit file. XXXX XXXX states American Express won't accept a payment from her because my social security is listed not listed. XXXX has since filed Bankruptcy and this debt was discharged. American Express continues to report past dues on my credit file and the credit bureaus won't investigate and fix this error on my report.

Consumer Complaint: On XX/XX/2022, I XXXX XXXX ( the consumer ) sent out a billing error notice to American Express ( 12 CFR 1026.13 ) pertaining to periodic statements I received from the financial institution. American Express has yet to disclose the Finance Charge. 12 CFR1026- Truth in Lending Act ( Regulation Z ) was put in place to protect people when they use consumer credit. After receiving a response from American Express about the billing error notice American Express informed me that they would be investigating my dispute. American Express replied to the consumer using the online portal to inform me that he was not responsible for the balance of {$4000.00} while the investigation was being conducted. Upon the conclusion of the investigation, American Express sent the consumer a response informing him that everything was correct in accordance with the card member agreement. American Express stated, the interest charges and the late payment fees are correct in assesses to the account as per the terms and conditions of your card member agreement. American Express is calculating the consumer 's credit use within the periodic period and making me either pay the full amount of credit being used or a minimum amount for the credits used by the consumer and adding interest onto the balance without disclosing the APR or finance charge. American Express disputed what the consumer is stating and now claims that the consumer owes a new balance of {$6.00}, XXXX regarding the consumers account. Consumer Complaint: In XX/XX/2019 my American Express Blue card was closed. Shortly after it was closed by American Express ; about 2-3 months after it was closed I begin receiving called from a debt collector stating that American Express had turned over the debt to them. I amount stated was several thousands more than my authorized charges. I immediately did two things- I notified the debt collector that the debt was not mine and that the amount reported was higher than any amount I ever used. I suspected fraud. I notified them both verbally and a couple days later in writing. I further sent them a debt validation letter per the Fair Debt Practices Act formally requesting that the collector validates the debt and clearly stating my dispute of this debt. Additionally that same day I contacted American Express and communicated the same thing to them. I was told that they no longer had the account and that I should only communicate with the debt collector to resolve it. After a few months of waiting on the debt collector, I received another call from the same debt collector demanding payment. I asserted again that I had previously sent a debt validation letter ( the amount that was claimed was and is still in dispute ). After speaking with a supervisor I was informed that American Express had not yet responded to their request in order to provide me the information as required by law. I was further told that they were going to send the debt back to American Express and I would not receive any more calls or letters from them. Per their word, I never heard from that debt collector again. However, about five months later a different debt collector hired by American Express began contacting me. I again informed them verbally and by mail within the required 30 days that the amount of debt was incorrect and I sent them a formal debt validation letter per the Fair Debt Practices Act formally requesting that the collector validates the debt and clearly stating my dispute of this debt. Again, I heard nothing for several weeks. I again called American Express who again said that they no longer had the debt and that I needed to discuss my account with the debt collector. After several weeks I called the debt collector and was told similar to the first debt collector that American Express had not responded to their request and they had nothing to provide me. Apparently that debt collector sent the account back to American Express. I never heard from them again. Sadly this process would happen once more ( now for the third time with again a different debt collector ). Again, the same request and again American Express did not respond to apparently the debt collector they hired to collect on this debt that was not mine. After the third debt collector sent the debt back to American Express I heard nothing else from any additional debt collectors hired by American Express, nor did I hear from American Express in over a year. American Express has reported to all three major credit reporting agencies this debt, in spite of knowing for several years that I disputed the debt due to fraud. American Express had refused to comply with federal laws governing debt reporting and fraud investigation request by a consumer. Instead American Express had used three different debt collection agencies to try and ignore the requirements of the Fair Debt Collection Act. The have bluntly violated the requirements by hopping from debt collector to debt collector knowing full well that the debt is not mine, and making no attempt to follow the requirements of the FDCA. I am asking that a full investigation into their blatant violation and disregard of the Fair Debt Collection Act, be opened. As of todays date American Express still has not opened a fraud investigation, nor communicated the results of this fraud, and in spite of four requests for validation of the debt- choose to ignore all three and instead hop from debt collector to debt collector instead of complying with FDCA .

Consumer Complaint: In XX/XX/2022, I applied for an American Express Gold Business Card. I was denied because they reported that I had previous credit cards that were in collection status. In XXXX I conducted a fraud complaint regarding the business card denial with the American Express fraud security department. In XX/XX/2022, American express fraud department confirmed the fraudulent accounts, yet refused to grant the card. I was instructed to reapply. I voiced my concerns that the re-application would cause damage to my credit score based upon the repetitive application for the same card, despite American Express 's confirmation that their denial was based upon incorrect information that was initially acknowledged prior and during application for the business Gold card. American Express engaged in discriminatory practices with the denial of the Gold card, based upon the fact that the applicant is a Veteran and minority business owner and the denial for the Gold Card was based upon a denial factor that the issuing company verified was fraudulent at the time of application. Since the issuer confirmed that the sole reason for the denial was found to be fraudulent ; then this applicant ; like those like him would have qualified for the Gold Card initially. Under normal circumstances, there would be no reason for a reapplication and an identical credit score pull would not be required.
