Issue: Problem with a purchase or transfer

Subissue: Card company isn't resolving a dispute about a purchase or transfer

Consumer Complaint: I received a prepaid Amex gift card. I cant use it to make purchases anywhere. They keep getting declined. Ive tried six different stores. I reached out to the company for help and could not speak to a live person. I was able to find one store that accepted it. I went back to that store to use it again and they tried four times to get this card to work. So ten different times this card has been getting declined. Ive seen on social media that others are having this issue. My balance on the card is {$93.00}. I just want to be able to use it or get a cash equivalent. Its a lot of money to my family.

Subissue: Problem with rewards from credit card

Consumer Complaint: I called American Express on XX/XX/23 to inquire about a 30 % transfer bonus to XXXX that I was not seeing on my account but was seeing on other peoples accounts. The agent let me know that if it was something offered to other people, she would offer it to me as well. She then prompted me to transfer XXXX XXXX points to XXXX and assured me that the remaining 30 % would be applied to my account. Shortly after, I received a call saying that she would not be able to offer me the additional 30 %. She prompted me to move points equivalent to over {$1000.00} USD without making sure that the 30 % would be applied. I asked for a XXXX review and no one reached out to me. I have called in for the last 7 weeks because no one from American Express would call me. On one of my call backs, the XXXX on the line said that the agent from my original call made a mistake and misinformed me. I called in once again today only to be told that there is no compensation or refund that can be offered to me at this time besides a 30 % transfer bonus on any new transfers. I would have never transferred the bonus if I knew that I was not going to be getting the bonus 30 % and trusted the guidance of the agent on the line. I am requesting that Amex makes this right and refunds me the points.

Issue: Fees or interest

Subissue: Problem with fees

Consumer Complaint: When I wanted to set up my auto pay on my account when I charged my rent to my American Express and used the Plan it option. There was no calculated amount I did not know when to set it up. Then it's like the bill is due the XXXX I'm swamped at work and it's XXXX and XXXX XXXX they did not send mean reminder the day of or the next day it wasn't paid there was a late fee already on there more than 5 % what is due. I'm paying so much in interest in these guaranteed payments to you and you're charging still an obscene over 10 % rate to me and I'm paying it. I did it twice. When I wanted to pay there was no way to setup auto pay on the '' adjusted amount " as soon as I got the email asking if I forgot to pay I paid it but I already got a late fee. You got the money in 2 days. How did the {$29.00} late fee go to collecting? Did it cost that much to email me to pay? Did it accrue that much interest the {$500.00} payment in 2 days accrued {$29.00} in cost? This is obscene and predatory and there is no way this is good decent business practices. They told me because I had XXXX other issues prior in the 7 years I had my account for {$18.00} total they would still charge the {$29.00}. That is crazy to me and I will not pay it. There needs to be an option for consumers to fight these predatory charges in a way that doesn't destroy their credit. It legit is a system set up against the consumer and the financial service industry is getting so greedy taking a percentage fee of every transaction in the world it's no wonder I choose to use XXXX when I can. I'm hoping that AMEX can show me in good conscience how it cost then {$29.00} to collect that payment and truly justify the late fee as not some predatory interest rate against the struggling young recent college grad. I'm definitely willing to fight this in every way even though {$29.00} isn't much to me and obviously it's nothing to you, but it's my integrity I'm not willing to compromise.

Issue: Improper use of your report

Subissue: Reporting company used your report improperly

Consumer Complaint: I am submitting a formal complaint against American Express, expressing significant concerns about potential privacy law violations, particularly the insufficient disclosure of opt-out rights. As a responsible credit cardholder, I expect institutions like American Express to uphold transparency, fairness, and compliance with regulations. Recent observations raise serious concerns, warranting a thorough investigation into American Express 's practices. My primary concern is the apparent lack of disclosure regarding consumers ' right to opt out of information sharing, a crucial aspect of privacy. Section 15 USC 6802 ( b ) ( c ) mandates clear explanations, but American Express may not effectively communicate this information. The absence of opt-out information, a right under 12 CFR 1016.7, is troubling, hindering informed decisions and raising compliance questions. Beyond opt-out disclosures, concerns extend to potential Fair Credit Reporting Act ( 15 USC 1681 ) violations. Section 602a emphasizes fairness, impartiality, and respect for consumer privacy, areas where American Express may lack full compliance. The apparent lack of information on opt-out options may signal broader insufficient privacy disclosures. Section 15 USC 1681C ( a ) ( 5 ) prohibits certain adverse information disclosure without proper authorization, necessitating clear privacy disclosures under The Privacy Act of 1974. Notably, under 15 USC 6805, the privacy notice reveals involvement with third-party companies, implying potential Privacy Act and terms and conditions violations. 16 CFR Part 313 and 16 CFR 433.2 outline requirements for privacy practice information. Emphasizing 5 USC 522a in relation to identity theft, protecting personal information is vital, and any false use of identity, as suspected with American Express, contravenes the law. Additional concerns involve potential FCRA Sec 603 ( d ) ( 2 ) ( a ) ( I ) violations, as it prohibits having a consumer report containing solely transactional information. Such violations breach consumer trust and ignore fundamental principles of consumer protection. Lastly, 15 U.S. Code 1681s2 ( A ) ( 1 ) A underscores the importance of furnishing accurate information to consumer reporting agencies, a responsibility that must be upheld. In light of these concerns, I urgently request a thorough Consumer Financial Protection Bureau investigation into American Express 's practices. I implore the Bureau to address opt-out and privacy disclosures, considering relevant laws, and ensure compliance with privacy laws and consumer protection statutes. I appreciate your attention to this matter and trust the Consumer Financial Protection Bureau will take necessary steps to safeguard consumer rights.

Issue: Improper use of your report

Subissue: Reporting company used your report improperly

Consumer Complaint: I am writing to file a formal complaint against American Express, underscoring significant concerns related to potential violations of privacy laws, particularly emphasizing the lack of adequate disclosures regarding opt-out rights, and drawing attention to the provisions of The Privacy Act of 1974, 15 USC 6805, 16 CFR Part 313, 16 CFR 433.2, 5 USC 522a , and FCRA Sec 603 ( d ) ( 2 ) ( a ) ( I ). As a responsible credit cardholder, I expect financial institutions, such as American Express, to uphold the highest standards of transparency, fairness, and compliance with pertinent regulations. Recent observations have raised serious concerns, necessitating a thorough investigation into the practices of American Express. My primary concern revolves around the apparent lack of disclosure regarding consumers ' right to opt out of information sharing, a critical aspect of consumer privacy. Section 15 USC 6802 ( b ) ( c ) mandates financial institutions to provide clear explanations on how consumers can exercise their opt-out rights. However, it appears that American Express may not be effectively communicating this crucial information to its cardholders. Furthermore, the absence of information regarding the option to opt out, a right afforded to consumers under 12 CFR 1016.7, is deeply troubling. This omission not only hinders consumers from making informed decisions but also raises questions about compliance with regulatory requirements mandating the provision of clear and accessible information regarding opting out. In addition to the lack of opt-out disclosures, my concerns extend to potential violations of the Fair Credit Reporting Act ( 15 USC 1681 ). Section 602a of this act underscores the importance of financial institutions exercising their responsibilities with fairness, impartiality, and utmost respect for consumer privacy. American Express may not be fully compliant with these provisions. Moreover, the apparent lack of information regarding opt-out options may indicate a broader issue of insufficient privacy disclosures. Section 15 USC 1681C ( a ) ( 5 ), which explicitly prohibits financial institutions from disclosing certain adverse information without proper authorization, underscores the necessity for clear and explicit privacy disclosures, particularly in light of the provisions of The Privacy Act of 1974. Additionally, under 15 USC 6805, I note that the privacy notice included in the terms and conditions reveals the involvement of third-party companies, including XXXX, XXXX, XXXX, XXXX XXXX, and XXXX XXXX XXXXXXXX XXXX This implies that my privacy rights may have been violated by American Express under both The Privacy Act and the terms and conditions. I am also aware that 16 CFR Part 313 outlines requirements for financial institutions to inform consumers about their privacy practices and rights, and 16 CFR 433.2 further delineates specific requirements related to creditors and consumer leases. Furthermore, I emphasize the critical importance of 5 USC 522a, particularly in relation to identity theft. Protecting personal information is paramount in preventing identity theft, and American Express must adhere to the highest standards in safeguarding consumers ' sensitive data. I suspect that American Express may have falsely used my identity, and I draw attention to 5 USC 522a, which prohibits the unauthorized use of personal information. Adding to these concerns, American Express appears to have violated FCRA Sec 603 ( d ) ( 2 ) ( a ) ( I ), as the law states that it is illegal to have a consumer report containing information solely as to transactions or experiences between the consumer and the person making the report. Any such violation contributes to a breach of consumer trust and a failure to adhere to the fundamental principles of consumer protection. Finally, I draw attention to 15 U.S. Code 1681s2 ( A ) ( 1 ) A, emphasizing the importance of furnishing accurate information to consumer reporting agencies. Any failure to ensure the accuracy of shared information may potentially contravene this stipulation. In light of these grave concerns, I urgently request that the Consumer Financial Protection Bureau conducts a thorough investigation into the practices and procedures employed by American Express. Additionally, I implore the Bureau to address the lack of opt-out and privacy disclosures, considering The Privacy Act of 1974, 15 USC 6805, 16 CFR Part 313, 16 CFR 433.2, 5 USC 522a , and FCRA Sec 603 ( d ) ( 2 ) ( a ) ( I ), and take appropriate measures to ensure compliance with privacy laws and consumer protection statutes. I appreciate your attention to this matter and trust that the Consumer Financial Protection Bureau will take the necessary steps to safeguard consumer rights. Issue: Trouble using the card

Subissue: Trouble using the card to spend money in a store or online

Consumer Complaint: A {$100.00} gift card for American Express was purchased on XX/XX/2023. XXXX XX/XX/XXXX and XX/XX/XXXX of XXXX several attempts to purchase items on XXXX failed to go through. Several more attempts to link the card to my XXXX and XXXX account had failed as well. A current attempt is being made to spend some money on XXXX ( money does not leave balance until item is being prepared for shipment which can take days ). Note, there is NO mention anywhere on the card that it is unavailable to use on ecommerce sites. What the included terms and conditions do state however is that, The Card may be used at merchants and retailers in the United States that accept the American Express Card. The websites mentioned all state to accept American Express. Despite that, the card does not work across any. An attempt was made to access the site AmexXXXX, and to call the customer service line at XXXX XXXX XXXX XXXX, only to be told to spend it somewhere else or in a physical store. All attempts to use the card online have failed, and all of my purchases are made online making this card useless. Furthermore, it is the responsibility of the bank to state what websites/locations that the card would work with if this was going to be an issue. Otherwise, attempting to use the card turns into a guessing game on where the card works or doesn't work, wasting significant valuable time.

Issue: Problem with a purchase shown on your statement

Subissue: Credit card company isn't resolving a dispute about a purchase on your statement

Consumer Complaint: On XX/XX/XXXX I was charged {$380.00} for three doctor 's appointments by XXXX XXXX XXXX. I reported that this entire charge is void because one of the appointments did not actually take place ( XX/XX/XXXX ) and the other two were paid for by my insurance. The merchant had fraudulently charged me for one appointment, and double-charged me for two others despite my insurance ( XXXX ) paying them. Even though I showed proof of of my insurance paying for the charges, American Express refuses to credit my account for the dispute amount of {$380.00}. The credit card 's dispute reason for this charge is incorrect, since the appointment or the services from this merchant were not received. I have provided proof of the insurance paying for the other XXXX charges, and a copy from the insurance rejecting the claim for an appointment the merchant fraudulently claimed ( XX/XX/XXXX ). Thus, the {$380.00} should be credited back to this user 's credit card account.
