Consumer Complaint: In XX/XX/XXXX I applied for a XXXX XXXX XXXX Credit Card which I have never done before. American Express said if I spent {$4000.00} in XXXX months I would receive XXXX XXXX XXXX points on my American Express card ending in XXXX. In the month of XX/XX/XXXX I confirmed with numerous agents that I met the qualifying {$4000.00} spend amount and would receive the XXXX points. XXXX such agent was XXXX in XXXX XXXX on XX/XX/XXXX. I did not receive the XXXX points and in XX/XX/XXXX I wrote to the CEO of American Express XXXX XXXX. I was later told in XXXX that both the phone calls as well as the letter to XXXX XXXX were lost. As the letter I wrote was certified to the CEO so someone at American Express headquarters had to sign for it. Consumer Complaint: On the evening of XX/XX/, I was contacted by someone claiming to be from the American Express fraud department. The number on the caller ID matched the American Express phone number XXXX, which is why I thought the call was legitimate. The man claimed they had detected suspicious activity on my card and asked if I'd made any large purchases in XXXX XXXX. I was immediately very concerned. He had my card number and read to me the balances I had paid on the last three statements of my American Express Credit Card Account, which matched the information I had in front of me- another reason why I thought he was calling from the fraud department. He said his name was XXXX XXXX. He also provided his phone number should the line get disconnected. The number he gave was XXXX He then proceeded to suggest I implement additional fraud alerts. He asked for my mother 's maiden name and social security to confirm my information, which I gave. He asked me to press *-something to activate a fraud alert on my phone. He also said that he was setting up alerts on my email. Only when I received my card statement this month, I realized that I had been scammed. The fraudster made three separate charges at the XXXX XXXX XXXX XXXXXXXX XXXX, in XXXX XXXX, totaling {$29000.00}. ( I live in Maryland and have not traveled to XXXX in years. ) I contacted my credit card company, American Express, right away. Initially, they credited me for the unauthorized transactions and said they would immediately send me a new card, which they did. On XX/XX/, I received an update from American Express stating that I am responsible for giving my card information to the fraudster, which I did not, and responsible for the balance. The scammer ( s ) already had my card number. I noted that there was no verification from the card company authorizing the transactions. Apparently, the fraudster had verified it through my email ( I'm in the process of setting up a new email account ). I requested that American Express begin an investigation and file a chargeback as I did not receive the items they claimed I purchased. They said they would investigate further and recommended I contact the FTC and police. Today, XX/XX/XXXX American Express closed the investigation and stated I must pay the total amount of {$29000.00}. I am writing to state that someone from American Express with my information was able to illegally make purchases in another country using my credit card information. I am in the process of filing a police report.

It is imperative to highlight the crucial provision within 15 USC 1681 section 604 ( a ) ( 2 ), which explicitly stipulates the limited circumstances under which a consumer reporting agency may furnish a consumer report solely in alignment with the written instructions provided by the respective consumer. I emphasize once again that XXXX, XXXX, and the financial institution acting as a furnisher of information to credit agencies lack any form of consent, written or otherwise, to disseminate my private information. I hereby assert my unequivocal right to revoke any and all forms of consent, whether explicit or implied, that XXXX and XXXX XXXX have erroneously assumed. According to 15 USC 6802 ( b ) ( c ), the onus lies with the financial institution to duly inform the consumer of their option to exercise the right of nondisclosure. Regrettably, the ( furnisher of information to credit agencies ) has failed to fulfill this obligation. In light of the violations as mentioned above, I wish to bring to your attention the pertinent clause within 15 USC 1681C ( a ) ( 5 ), which categorically forbids the inclusion of adverse items of information in a consumer report without the requisite authorization. It is my firmly held belief that the adverse item currently being reported in relation to my account is a direct violation of this statutory provision. Moreover, I draw your attention to the stringent stipulation of 15 U.S. Code 1681s2 ( A ) ( 1 ), which explicitly prohibits the provision of inaccurate information pertaining to a consumer to any consumer reporting agency. I assert that any attempt to offset debts by furnishing information to credit agencies must adhere to the provisions within this statute. 31 USC 5118 ( d ) ( 1 ) : This section outlines the stringent requirements for currency and security paper used for obligations of the United States. While seemingly unrelated, I believe it underscores the gravity of accuracy and security in reporting financial obligations. 50 USC 4305 ( b ) ( 2 ) : This provision pertains to the safeguarding of classified information. While distinct in nature, it underscores the overarching principle of protecting sensitive information, further accentuating the need for consumer reporting agencies to exercise the utmost diligence in their reporting practices. In accordance with 12 CFR 1016.7, I am formally exercising my unequivocal right to opt out of your reporting services. It is my expectation that you will acknowledge this decision and promptly cease the reporting of my information. I trust that you recognize the gravity of the situation and the potential legal ramifications. I strongly urge you to undertake immediate corrective actions to rectify the violations outlined above and ensure compliance with the FCRA and the additional statutes cited. Consumer Complaint: I am submitting this dispute with American Express. I have been using the Amex Gold card, and I have added one Amex offer to my card. The detailed offer terms will be attached, but basically it says if more than XXXX dollars are spent on the XXXX property XXXX XXXX, XXXX dollars would be given back in the form of statement credit. I added this offer before I have booked and stayed in XXXX XXXX -- XXXX by XXXX, which is a XXXX XXXX XXXX, with its name of the list of qualifying hotels. The XXXX stay is from XX/XX/XXXX to XX/XX/XXXX, and the final charge posted on the statement is XXXX dollars, which satisfies the spending qualifications. However, the offer is not redeemed. I have tried contact Amex customer service for about 5 times, and have asked for escalation. The feedback is they denied my application saying the transaction is not made in the eligible locations. However, I have met with all the requirements for the redemption of the offer. I have added the offer to my card before booking the stay, booked the stay on a XXXX app, spent more than the required amount using the card with offer added. I don't find any of the steps would be ineligible for redeeming the offer. The hotel name is on the list of the participating hotel list, and even the name of the transaction indicates that it is in the eligible list. From the hotel list though, the XXXX XXXX is on the last page and the XXXX hotel counting backwards. I have trusted Amex and prioritized Amex cards in all my spendings, and I have never encountered issues like this. I have contacted Amex for many times, but as the decision on this case is not satisfying and even not reasonable from their internal examination, I have to contact them in this way. I will upload the hotel folio, the offer terms, the list of the eligible hotels, and the conversation between me and the customer service.
