Issue: Managing an account

Subissue: Deposits and withdrawals

Consumer Complaint: I have previously filed complaints against XXXX XXXX XXXXXXXX and XXXX XXXX bank. This complaint is against SunTrust Bank. As Stated in the other complaints, I have been subjected to the violation of the provisions of Chapter 63, 77, 95 and 96 of the US Codes continuously for the pass 20 years. I have been enslaved by the local public Officials of XXXX County NC and Suntrust Bank was culpable, complicit and liable. The rule of law in 18 USC 1956, 1961 and 1589 all address those who benefit in specified unlawful activity. The statute of limitation in all three Federal Statutes including 21 USC 84XXXX state that as long as the last occurrence was with 10 years. in my case, the last house that was stolen stemming from what they started in XXXX was stolen in XX/XX/XXXX. They public Officials of XXXX County XXXX XXXX XXXX XXXX XXXX XXXX XXXX. as the federal Statutes was written, anyone that profit and or benefited is as liable as the next person. Due to the Suntrust Bank 's participation in the embezzlement of millions, my income dropped from about {$500000.00} a year to {$0.00}. I have been enslaved from XXXX until current ( or equivalent ). My children were being threaten doing the times of the embezzlement and that cashing of many company checks as late as XXXXXXXX by XXXX XXXX as the SunTrust bank in XXXX XXXX XXXX XXXX XXXX XXXX. Suntrust Banks facilitated the embezzlement of about {$1.00} million allowing XXXX XXXX to withdraw as much as {$150000.00} within a two-week period and over {$50000.00} in cash in increments between {$11000.00} and {$20000.00} in cash in a single day. The Banks has a responsibility to notify the authorities of felonious or suspicious activity. Suntrust bank could have easily looked into the records of the NC Secretary of state to assure the XXXX XXXX XXXX was the only officers in the company to be withdrawing that kind of money. Doing the time in which XXXX XXXX was withdrawing upward of {$50000.00} a day, Suntrust Bank had in one month over {$400.00} ( XXXX XXXX ) the same month in XXXX Charges. in a Four-month period, XXXX XXXX embezzled oveXXXX {$600000.00} incase proceeds of specified unlawful activity as defined in 18 USC 1956 . There is an element in that the local public officials/ lawyers/ court officer keep me busy with new fraud, threats of abuse of the law and legal process as defined in 18 USC 1961 , 1589 and 21 USC 848 . Stealing a XXXX man 's money, equity out of his homes ( 1009 Fieldgrass Place in XXXX County and XXXX XXXX XXXX in XXXX County ) and proceeds out of company work will force a man to work to sustain the life that he has worked for or suffer substantial injury as defined in 18 USC 1589 ( c ). The rule of law again reference those who benefit from stated illicit activity are liable for damages. Suntrust Bank allowed my XXXX wife ( now ex-wife ) to duplicate the original bank account for XXXX XXXX and facilitated a {$1.00}, million-dollar embezzlement scam at the request of my that company lawyer XXXX r XXXX who was disbarred for what he had done. The matter is being investigated by the Office of the Special master referred by the U.S Court for Federal Claims in Washington DC case no XXXX. I went their invoking, exerting and claiming my rights established by Congress and told them what the local lawyers in XXXX County had done over the past two decades to my family, community and companies. I was licensed as a general Contractor in XXXX, license no XXXX. It was Suntrust Bank that played a large roll in destroying that company and license. I was later licensed with XXXX and due to the continual aggression, we have not been able to commence the same work that was stopped due to Suntrust Bank. I want to build a trade skill training school to start replenishing that which we lost. Being out of work for over a decade, many of the older family members who taught me construction as died off. I just feel it is appropriate to explain the injury they caused. the Offcie of the Special masters is looking into NC 's discriminatory practice of law and all the organizations/ non-individuals that profited. if I need to, i will file and additional complaint against Suntrust bank in the Federal Courts in Washington seeking relief pursuant to 18 USC 1593 " NET GORSS INCOME LOSS '' which will be about {$100000.00}, XXXX or more, I can prove what I could have made by simple calculation but that too is not my responsibility but the responsibility of the USDOJ. one thing is for sure, I have plenty of time to file the complaint against Suntrust in Washington DC pursuant to 28 USC 455 " without a conflict of interest with North Carolina. I have made that argument before, and the Jurisdiction in DC was accepted. The Banks in NC rely on NC discriminatory and unconstitutional practice of law which i address in my complaint that is being investigated by the XXXX XXXX XXXX XXXX in Washington DC.

Consumer Complaint: Suntrust bank and XXXX XXXX. Issue: Closing on a mortgage

Subissue:

Consumer Complaint: XXXX. XX/XX/XXXX, I submitted an application with BB & T/Suntrust , now dba as Truist, for a refinance of my existing mortgage loan with BB & T ( Loan Number XXXX ). 2. Based on national standards, expected timeframe for refinance of existing mortgage with same lender was 30-45 days with minor deviations expected. Anticipated refinance completion was XX/XX/XXXX based on the refinance process being a simple refinance with no cash out, just a lower interest rate. The application was to be processed as an Assets for Income Refinance versus a standard loan application. To support this request, my wife and I documented we receive ( a ) {$6500.00} monthly from Social Security, ( b ) have liquid cash assets of {>= $1,000,000}, ( c ) own real estate valued at {>= $1,000,000}, ( d ) annual dividends and capital gains of {$750000.00}, and ( XXXX ) joint personal and loan debt of {$600000.00}. 3. BB & T/Suntrust requested XXXX supporting application documents on XX/XX/XXXX ( 26 days later ), which were submitted immediately. Follow up requests for information occurred over the next 30 days. All requested materials were submitted within XXXX hours of request. XXXX. XX/XX/XXXX ( 56 days later ), I was informed by the BB & T loan processor, XXXX XXXX, that the Underwriting process was 90 % complete. Additional materials requested by XXXX XXXX were submitted immediately. XXXX. On XX/XX/XXXX ( 132 days later ), I was informed by the loan processor that the Underwriting process was 95 % complete. Additional materials requested were submitted immediately. I immediately contacted my BB & T Loan Originator, XXXX XXXX, requesting information as to why this loan process was now at 132 days from initial application with no end in sight. I was informed that the Underwriting department was behind due to a flood of applications and Loan Processors were behind due to training on the Suntrust mortgage loan software that was being adopted in the merger with BB & T as they became Truist. During this 132-day period, multiple loan expirations were extended due to the confusion at BB & T . XXXX. Approximately XX/XX/XXXX ( 137 days later ), I was informed that BB & T had misplaced several application documents and requested we send replacement documents. At the same time, BB & T informed me the property appraisal was stale and a new appraisal would be required. In the interim, we updated the loan documents several times at the request of BB & T. BB & T expressed no disqualifying concerns with the materials submitted. XXXX. XX/XX/XXXX ( 166 days later ), the closing agent for XXXX XXXX XXXX XXXX, XXXX XXXX, was informed by XXXX XXXX, the Lending Processor for BB & T, that I still do not have a set closing date as of yet. The file is still in Underwriting. I spoke with the Underwriter and I should it back today or tomorrow. The POA has been approved to use. I will keep you postedthanks. XXXX. XX/XX/XXXX ( 166 days later ), XXXX XXXX from XXXX XXXX and Title, informed me The lender asked for several documents that had already been emailed to XXXX XXXX so I emailed everything he requested again, so hopefully they have everything they need to proceed with refinance. I asked if lender can close XX/XX/XXXX but have not received a response. The XX/XX/XXXX closing date was canceled as BB & T was unable to provide final documents to XXXX on a timely basis for a XX/XX/XXXX closing. XXXX. XX/XX/XXXX ( 196 days later ), XXXX XXXX from XXXX XXXX and XXXX, informed me BBT/Truist has finally approved this loan. Should be contacting you shortly. 3 day Closing XXXX went out this morning. Hopefully we can close Tuesday or Wednesday of next week depending on your schedule and the bank following up as required. XXXX -tuned, as will I also. Thank you. XXXX. XX/XX/XXXX ( 200 days later ), XXXX XXXX informed me Per lender XXXX XXXX, BB & T processor, left office with an emergency so working with XXXX XXXX now. Still NO lender closing docs have been sent to me, will keep you posted. Several starts and stops occurred during the next day. XXXX. XX/XX/XXXX, BB & T finally closed on the loan, 201 DAYS AFTER THE INITIAL APPLICATION WAS MADE VS. TYPICAL 45-60 DAY REFINANCE PROCESS. XXXX. Although, I was able to secure the loan at a 2.25 % rate instead of the 2.5 % originally locked-in, due to mortgage rate changes over seven months, I paid approximately {$2800.00} in unnecessary/additional interest charges on my original loan. This amount was calculated by using the approximate difference of {$7900.00} in interest I paid for the period XXXX XXXX XXXX, XXXX on the original loan, versus {$5000.00} I would have paid on the new loan for the same period. 13. In summary, I believe BB & T slow-walked this refinance process to net the greatest amount of interest possible because of how long the process dragged out due to internal staffing and performance issues. BB & T indirectly acknowledges this in the XX/XX/XXXX email from the Loan Originator, XXXX XXXX, to XXXX XXXX at XXXX XXXX and Title, which states, This is a very old refinance. The cost to the region to extend the loan is high. The client has updated the loan documents numerous times. My understanding is I was not alone in this slow walk process, as several other loans were dragged out unnecessarily by BB & T. I did discuss this matter with XXXX XXXX, XXXX mortgage office for BB & T/Truist , who indicated there was little he could do financially in this matter.

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Their investigation did not fix an error on your report

Consumer Complaint: When an item shows up as a duplicate an your credit report, it should easily be removed with a dispute letter to the credit reporting agency. Unfortunately, this is not the case with the incompetent employees working for XXXX. who rely heavily on their XXXX and XXXX XXXX systems to do their jobs. Randomly, checking my credit report around mid XXXX, I came across the same furnisher on my XXXX credit file with two completely different account numbers. REGIONAL ACCEPTANCE XXXX # XXXX with balance XXXX and second XXXX # XXXX with the same balance XXXX. I disputed and asked of the item to be removed. XXXX found it as verified. To my knowledge, I have one account with this lender. And have no idea where the second account came from. I am requesting legal action to have this incorrect information removed from my credit file immediately. Or I will be forced to take legal action.

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Investigation took more than 30 days

Consumer Complaint: Dear Sir or Madam, 1. SUNTRUST BK Account XXXX Please correct this inaccurate information on my credit report. I recently pulled my credit report from your Bureau and my attorneys and I had a chance to go over my credit report and in amazement, that you have decided to report me 30 days late on this account in XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX, XXXX XXXX also, 60 days late on this account in XX/XX/XXXX, XX/XX/XXXX. Lastly, 90 days late on this account XX/XX/XXXX, XX/XX/XXXX. I immediately disputed this information with SUNTRUST BK and the results of the investigation came back " verified ''. Not only was I never late on this account, but according to the Fair Credit Reporting Act ( FCRA ), the information furnisher is required to notify me of the insertion of negative listings. Since I have disputed the lates with the creditor, and you obviously " verified '' them, I am very curious as to what kinds of " records '' you may have for this alleged account. I am very confident that you are in violation of the ( FCRA ) and ( FCBA ) sections ( 1666, 1666a. 1666b., and 1666c. ) as stated below : 1666. Correction of billing errors ( b ) Billing error ( 4 ) The creditor 's failure to reflect properly on a statement, a payment made by the obligor or a credit issued to the obligor. ( 5 ) A computation error or similar error of an accounting nature of the creditor on a statement. ( 6 ) Failure to transmit the statement required under section 1637 ( b ) of this title to the last address of the obligor which has been disclosed to the creditor, unless that address was furnished less than twenty days before the end of the billing cycle for which the statement is required. ( 7 ) Any other error described in regulations of the Bureau. 1666a. Regulation of credit reports ( a ) Reports by creditor on obligor 's failure to pay amount regarded as billing error After receiving a notice from an obligor as provided in section 1666 ( a ) of this title, a creditor or his agent may not directly or indirectly threaten to report to any person adversely on the obligor 's credit rating or credit standing because of the obligor 's failure to pay the amount indicated by the obligor under section 1666 ( a ) ( 2 ) of this title, and such amount may not be reported as delinquent to any third party until the creditor has met the requirements of section 1666 of this title and has allowed the obligor the same number of days ( not less than ten ) thereafter to make payment as is provided under the credit agreement with the obligor for the payment of undisputed amounts. ( b ) Reports by creditor on delinquent amounts in dispute ; notification of obligor of parties notified of delinquency If a creditor receives a further written notice from an obligor that an amount is still in dispute within the time allowed for payment under subsection ( a ) of this section, a creditor may not report to any third party that the amount of the obligor is delinquent because the obligor has failed to pay an amount which he has indicated under section 1666 ( a ) ( 2 ) of this title, unless the creditor also reports that the amount is in dispute and, at the same time, notifies the obligor of the name and address of each party to whom the creditor is reporting information concerning the delinquency. ( c ) Reports by creditor of subsequent resolution of delinquent amounts A creditor shall report any subsequent resolution of any delinquencies reported pursuant to subsection ( b ) to the parties to whom such delinquencies were initially reported. 1666b. Timing of payments ( a ) Time to make payments A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose, unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by section 1637 ( b ) of this title is mailed or delivered to the consumer not later than 21 days before the payment due date. Because I take my credit very seriously, I contacted every name and account that was listed on the report. I was again very shocked by the multiple names, account numbers and figures. Included with this letter, is every letter written to those who have hampered my ability to obtain credit. I believe that any judge that looks over the report would agree that it is a violation of both the FCRA, CCPA and FACTA. The following accounts were listed on your report and I have demanded from them a full accounting and five years worth of records to see if their accounts were in violation of the FAIR CREDIT BILLING ACT ( FCBA ). We also demanded signed contracts, agreements or any legal paperwork that would tie us to the following accounts. Under the FCRA, you are required to conduct an investigation on this account if I request it. I DEMAND to see all 100 % verifiable proof that I was indeed Verifiably late on these accounts and the creditor fulfilled its obligations under ( FCBA 1666 ( a ) ( 2 ) ), As I was never notified of a billing delinquency on my accounts, which the creditor must do under section ( FCBA1666 ( b ) ( 6 ). I DEMAND to see proof that I was mailed my statement to the correct address notifying me of both payment due date and delinquency of payment on the account. If you can not provide 100 % Verifiable proof and proper documentation that the CREDITOR fulfilled its obligations under the ( FCBA ) and ( FCRA ), I therefore demand these late payments be removed from my account or I will be forced to be in contact with the Attorney General of my State and the Consumer Financial Protection Bureau. I therefore am submitting my written request to you to conduct an investigation. Per the FCRA, you have 30 days to conduct this investigation and respond to my request. If you do not respond within this time period, per the FCRA, you must remove this negative information. Thank you for your time, XXXX XXXX SS # : XXXX Date of Birth : XX/XX/XXXX XXXX : Consumer Financial Protection Bureau po box 4503 Iowa City, Iowa 52244

Consumer Complaint: I'm a guitar XXXX, and I needed a quality case for a vintage acoustic I had recently purchased. I placed a want ad on an internet guitar forum that I often frequent, buy & sell, and am well known from years of participation. I received a response on XX/XX/2012. The scammer presented four very nice pictures of a case that would work quite well. His pricing, including shipping, was at market value, so there were no red flags raised at this point. I responded that I would like to buy it and please send me your XXXX XXXX He responded that he preferred to be paid by XXXX. I had only received money from family members using XXXX and really didn't know how to even use it. He said he would walk me through it and provided an e-mail address ( XXXX ) to which I should send the money. My first red flag was the email address he had contacted me from which is different than the aforementioned e-mail. It is XXXX. I had never seen that e-mail provider before, so I did a XXXX search. The XXXX search told me that it was a legitimate e-mail servicer, but something else came up in the search : a warning from another on-line forum member that XXXX had scammed him. So, I wrote him again and asked a lot of questions. He said he was in XXXX The XXXX is based in XXXX, so that made sense. I told him I needed a tracking number, and he said he was going to take care of all of it after work. Seeing it was early in the morning, that seemed like a reasonable thing to say. Of course, after all of this he has gone completely silent. But, I suspected a scam early that morning, and here is where the big problem comes in as far as I'm concerned. My bank, Truist was recently formed by a merger between Sun Trust and BB & T. I had been a Sun Trust customer since their inception, and they always had superior cusomer service. On my bank account, it said this transaction was still pending. But, when I called customer service, I had a 30 minute wait and ended up speaking with a woman from the XXXX who I couldn't understand. I requested she connect me with an English speaking rep, and she transferred me to the same place I had started from when I got this lady. After holding for over half an hour, I gave up and went to the bank. Here I got an even bigger surprise. I had done business with the rep I spoke to many times over the years. She was apologetic about the poor customer service, but said there was nothing she could do as this was a result of the merger. She told me to go home and go on my on-line banking to file a fraud claim. I am convinced that I would have received adequate customer service, we could have stopped this transaction while it was still pending. That's where my bank failed me miserably.

I called and was told that it was my fault for paying twice, which is not what happened. I was only paying XX/XX/XXXX and Not paying for XX/XX/XXXX yet! I called my bank and they said I'd have to wait for the second ach to fail and then request reversal as they could not do anything. Over the weekend my bank had removed the problem double payment and did not charge me. They sent me an email that the second payment overcharge was {$0.00}. I thought the issue was resolved. Today when I checked my bank they had a new ach from Suntrust/aka Truist. I called and spoke to several people who tried to explain my choices. I ask several times for the complaint department after Truist staff confirmed I had an outstanding complaint and after waiting a long time they said they were going to forward me to the appropriate person to handle this matter. It went directly to a person 's voicemail, which I left a detailed message that I plan on sending in my complaint to the SEC and XXXX and others. Today Suntrust/Truist has once again tried to take funds out of my checking account via ACH. I had to file multiple complaints with the FDIC regarding XXXX XXXX ( also not reflecting on my credit reports ( all three ) Many of my CC reduced my available credit b/c of the identity theft and yet it has not been reported. I have asked each and every one of my credit cards and my bank to alert all the credit bureaus ' about the errors and was assured they would do so but after reviewing all 3 of my reports I see that is not the case.
