The law applies to all schools that receive funds under an applicable program of the U.S. Department of Education. FERPA gives parents certain rights with respect to their children 's education records. These rights transferto the student when he or she reaches the age of XXXX or attends aschool beyond the high school level. Students to whom the rights have transferred are " eligible students. '' Generally, schools must have written permission from the parent or eligible studentin order to release any information from a student 'seducation record. Schools must notify parents and eligiblestudentsannually of their rights under XXXX. The actual means of notification ( special letter, inclusion in a PTA bulletin, student handbook, or newspaper article ) isleft to thediscretion of each school. Based on the said laws & codes I exercise myrights as anconsumer because my personal information is being used unlawfully.Further his isnow a " Charge-Off '' considered a certificate of indebtedness per theIRS and incomecan not be reported. The IRS Clearly defines a charge off as Gross orOrdinaryincome, INCOME DOES NOT GET REPORTED ON THE CONSUMER REPORT which infact makes reporting of this account inaccurate! I provided ascreenshot from the IRS website. By Definition, the IRS Clearly says a Cancelled debtor Charge off is Income. The reporting of this account as a debt is inaccurate & unlawful. As well as sharing orselling my personal student loan info per the TheFamily Educational Rights andPrivacy Act ( FERPA ) ( 20 U.S.C. 1232g ; 34 CFR Part 99 ). The 1099-C, which was sentto XXXX last year in 2023 also proves that this is discharged, so why is it still on myconsumer report?

Subissue: Reporting company used your report improperly

Consumer Complaint: My Fair Credit Reporting act consumer rights have been violated. On XX/XX/2024 I submitted letters to each Consumer Reporting agency requesting that both my name and my address be updated on my credit reports. I also asked that the name I requested to be on my credit report be the only one listed as it is my only name, and the only name I open accounts with. I also requested the address I sent to them be the only one listed as it is my correct address and where I receive all of my mail. As of XX/XX/XXXX my rights have been violated in two ways. I have not received a response from any of the credit reporting agencies. It has been over 30 days as it is now XX/XX/2024. I have also been violated, because none of my personal information has been update.
